Do you need a building permit in Vicksburg, MS?

Vicksburg requires building permits to erect, modify, remove or repair residential, commercial and industrial structures, subject to the city’s listed exemptions.1 The Building & Inspection Department must approve a complete set of plans for code compliance before issuing a building permit.1

A qualifying driveway is exempt only when it is no more than 30 inches above grade, is not over a basement or story below, and is not part of an accessible route.9 Mississippi’s owner-builder exemption concerns residential-builder licensing; the exemption does not remove Vicksburg’s building permit or inspection requirements.617

Who issues Vicksburg building permits, and how do you reach the office?

The City of Vicksburg Building & Inspection Department handles building permit plan review and directs applicants with building permit fee questions to its office at 805 South Street or 601-634-4528.10 The department’s email is [email protected].10 For parcel zoning questions, contact the city’s Zoning Administrator Assistant at 601-634-4526 or [email protected].11

Ask the building office which plans and building permit fees apply to your proposed home, addition or repair.10 Vicksburg inspects projects issued a building permit; the inspection sequence depends on the scope of work.7 Inspection requests must identify the inspection type, permit number, requested time and date, site location and contractor name, with at least 24 hours’ notice.7

Does Vicksburg have zoning, lot-size rules and building limits?

Vicksburg’s zoning ordinance requires buildings and land uses to be permitted in the applicable district, except as otherwise provided in the ordinance.2 In Vicksburg’s R-1 Single-Family Residential Zone, a dwelling needs a lot of at least 10,000 square feet and a width of at least 90 feet at the building setback line.4 In R-2, the corresponding minimums are 7,000 square feet and 70 feet.5

Buildings and accessory structures may cover no more than 35% of a lot in either R-1 or R-2.1213 R-1 structures have a 35-foot height limit unless the ordinance’s additional-setback provision or a stated height exception applies.14 Ask the city zoning contact to identify the parcel’s district and applicable yard setbacks before positioning a home or accessory structure.11

How do septic permits work inside Vicksburg?

Mississippi State Department of Health establishes statewide onsite wastewater rules, and the appropriate county Department of Health handles local inspections.3 A new onsite wastewater system requires MSDH permit paperwork; the Permit/Recommendation is nontransferable, valid for 2 years, and can become void after extensive grading or deviations from the submitted plot plan.15

A permanent water-meter connection requires permanent sewage disposal through a sewer line or septic system; where public sewer is unavailable, applicants need MSDH paperwork.16 MSDH environmentalists provide soil and site evaluations and a Permit/Recommendation suitable for installation.17 Contact MSDH about the proposed lot before relying on a conventional drain field: only 10.8% of Warren County soils are rated not limited for that use, a countywide screening measure that calls for site evaluation rather than proving septic is impossible.18

Can you live in an RV or tiny home on Vicksburg land?

We could not confirm a Vicksburg rule expressly allowing residential RV occupancy, temporary camping or tiny-home occupancy on private land; ask the city zoning contact about the proposed use and parcel.11 Vicksburg’s zoning ordinance still requires the use to be permitted in the parcel’s district.2 A small structure’s building permit exemption should not be treated as approval to occupy a dwelling: Vicksburg requires a Certificate of Occupancy for an erected or modified building before occupancy.18

Vicksburg allows accessory apartments only within an existing detached single-family dwelling in A-1 or A-2, for qualifying relatives or caregiving employees, and prohibits renting those apartments.19 Mississippi also requires inspection before occupation of factory-built homes subject to its installation program; state installation approval does not establish that a city zoning district allows the home.202

What are the steps to building a home in Vicksburg?

  1. Confirm the parcel’s Vicksburg zoning district and whether the proposed home is a permitted use with the city zoning contact.211
  2. Resolve sewage disposal before seeking permanent water service; where public sewer is unavailable, apply to MSDH for the required paperwork.16
  3. Submit complete building plans to Vicksburg’s Building & Inspection Department for approval before the city issues the building permit.1
  4. Arrange the required city inspections as construction progresses, allowing at least 24 hours for inspection requests.7
  5. Pay appropriate fees before final inspection and receive the city Certificate of Occupancy before moving in.8

For a new subdivision, Vicksburg requires final plat approval before issuing a building permit.21 Outside city limits, Warren County has no county zoning laws, a different answer from Vicksburg’s city zoning.222

Watch-outs

  • We could not confirm Vicksburg’s minimum dwelling floor area or residential RV and tiny-home occupancy rules; ask the city zoning contact before buying for those uses.11
  • Vicksburg requires a Certificate of Occupancy before occupying an erected or modified building or changing the use of existing land or a building.8
