Zoning, building permits and septic rules in Berkeley, Missouri

The City of Berkeley, Missouri (St. Louis County) sets its own zoning under Chapter 400 of its code1 and issues building, mechanical, electrical and plumbing permits itself2. Septic permits and private wells are not decided by the city's zoning code; ask the St. Louis County Department of Public Health3. We could not confirm the city's building code edition or permit fees.

Does Berkeley, Missouri have zoning?

Yes. The City of Berkeley zones all land inside its limits under its own Chapter 400 Zoning Regulations, not unincorporated St. Louis County's code1. The city is divided into these districts: R-1, R-2, R-3 and R-4 for residences, C-1, C-2 and C-3 commercial, M-1 and M-2 industrial, F (floodplain), P (park), AD (airport), and DT-1 and DT-2 downtown4. There is no agricultural district on that list, so a rural-style lot or farm use is not a built-in category here4.

The city's Economic Development department regulates zoning, subdivision and signs10. Land divisions fall under the city's Chapter 405 Subdivision Regulations11.

What are the lot size and setback rules in Berkeley's R-1 district?

In the R-1 single-family district, Berkeley requires at least 20,000 square feet of lot area per family and a lot at least 75 feet wide5. Required yards are 40 feet in front, 10 feet on each side and 30 feet in the rear (or 20% of lot depth if larger, up to 50 feet)6. Maximum building height in R-1 is 35 feet or two and one-half stories12.

A driveway in an R-1 front yard may not exceed 20 feet in width, and each lot gets one driveway13. We have not confirmed the R-2, R-3, R-4 or commercial district figures, so ask the city before assuming the R-1 numbers apply to your lot5.

Do you need a building permit in Berkeley, and who issues it?

Berkeley issues building, mechanical, electrical and plumbing permits through its own city office, and some permits also need a zoning approval form2. Call the Inspections and Code Enforcement division at (314) 400-37132. For the zoning form, the city directs applicants to Public Works2.

We could not confirm the building code edition the city has adopted, the permit fees, whether owner-builders are exempt, or the certificate-of-occupancy process, so get these from the division before you budget. The county's Chapter 1115 building code applies to unincorporated St. Louis County, not to land inside Berkeley's limits14.

How do septic permits work inside Berkeley?

We could not confirm who permits septic systems inside Berkeley city limits. Missouri requires a construction permit before installing or repairing most onsite wastewater systems, and some single-family lots may be exempt15. In St. Louis County that permitting authority is the county Department of Public Health or the county plumbing department, depending on the system and whether the property is in an incorporated area8.

St. Louis County averages about 1,944 people per square mile16, so many lots in town are likely on public sewer, but we have not confirmed this for Berkeley. Before you plan a septic system or a well, call the St. Louis County Department of Public Health at (314) 615-06003.

Can you live in an RV, mobile home or tiny home in Berkeley?

Berkeley allows no trailer coach or mobile home to be parked, used or occupied in any district except as its Chapter 415 trailer park rules provide7. Living in an RV or trailer on an ordinary residential lot should therefore be treated as not allowed unless the city confirms otherwise. We could not confirm the city's rules on tiny homes, temporary camping or accessory dwellings; ask the zoning office at (314) 524-331310.

Short-term rentals also need a city permit under Article XIII of Chapter 40017.

Building a home in Berkeley: the steps, in order

  1. Confirm your lot's zoning district on the city's zoning map and read the district rules in Chapter 4004.
  2. Ask Public Works whether your project needs a zoning approval form2.
  3. Check whether the lot touches the floodplain (F) district; all construction must follow Chapter 410, Flood Damage Prevention9.
  4. Apply for building, mechanical, electrical and plumbing permits with the city's Inspections and Code Enforcement division2.
  5. Ask the county health department about septic or well rules if the lot has no public sewer or water3.

What to check before you buy land in Berkeley

Berkeley sits in St. Louis County, whose typical home value is about $293,45818 and whose effective property tax rate is 1.2%19. The nearest city of 100,000 or more people is about 15 miles from the county center20. Flood zoning matters: any construction in the floodplain district must follow the city's flood damage prevention chapter9.

For land outside city limits, use the St. Louis County page: the county's rules differ from the city's.

Watch-outs

  • City rules apply only inside Berkeley's limits; the St. Louis County building code and zoning ordinance govern unincorporated land, so confirm the lot is inside the city before you rely on either21.
  • We could not confirm Berkeley's adopted building code, permit fees or owner-builder rules; call (314) 400-3713 before you design2.
  • Missouri law requires a permit for all development in a floodplain, in addition to any city rules22.
