Does Denton Township, Michigan have zoning?

Yes. Denton Township administers its own zoning ordinance, and the county leaves zoning to the townships: Roscommon County states that "Building and zoning are done through each individual township"12. The ordinance sets a Forest/Residential (FR) district, a Lakefront Residential (LR) district, a further residential district and a commercial district11.

In the FR district, the minimum parcel size is 2 acres with at least 210 feet of frontage; planned unit developments need 20 acres8. Accessory buildings in FR must sit at least 20 feet back from the front lot line12. In the Article 7 residential district, the ordinance appears to set a 12,000 square foot minimum lot for a single-family home with 75 feet of frontage13, front and rear setbacks of 25 feet, side setbacks of 7.5 feet14 and a 30-foot height limit15. Multiple-family units in that district must be at least 640 square feet16. We did not find a minimum size for single-family homes. Confirm the district for your parcel with the Denton Township zoning office17.

Do you need a building permit in Denton Township, and who issues it?

Michigan law requires a written application to the appropriate enforcing agency before a building or structure is built, and again when its use changes5. Roscommon County does not issue them for the townships: "For local building departments and permit information, contact your local township building department"18. We could not confirm which agency issues building permits for Denton Township, or what it charges, so call the Denton Township office first17.

A new or altered building may not be occupied until the code official issues a certificate of occupancy19. Michigan's current building code is the 2021 edition, effective April 9, 202520. A driveway onto a county road also needs a Road Commission permit21.

How do septic permits work in Denton Township?

Septic permits for Denton Township come from the Central Michigan District Health Department, which serves Roscommon County from its Prudenville branch422. For a new build, a septic permit is required before a building permit, and a vacant property must be marked or flagged for the sanitarian's site visit6. A reserve area for future drainfield replacement is required6. Roscommon County's soils are a caution: 0% of the county's soils rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system23.

A well permit is also required from the health department before a building permit24. If a property already has a septic system or well, an evaluation is required when a building permit is needed25.

Can you live in an RV on your land in Denton Township?

Only briefly by right. In the Forest/Residential district, camping with five or fewer tents, travel trailers or recreational vehicles on one property as a temporary dwelling is permitted for no more than 30 continuous days726. Camping beyond 30 days requires a special use permit and site plan review7. Campgrounds of six or more units are a separate special use27.

The ordinance lists mobile home parks as a special use in the FR district28. We did not confirm the rule for a single manufactured home on its own lot, or for tiny homes and accessory dwellings, so ask the zoning office before buying17.

Building a home in Denton Township: the steps, in order

  1. Call the Denton Township zoning office to confirm your parcel's district, setbacks and any land division needs17.
  2. Get the septic and well permits from the Central Michigan District Health Department; the septic permit comes before the building permit624.
  3. Ask the township which agency issues building permits, then apply in writing5.
  4. Apply to the Road Commission if you need a new driveway onto a county road21.
  5. Request a certificate of occupancy when the work is complete; it cannot be issued until fees are paid and permits are finaled19.

What stays with Roscommon County, and what to check before you buy

Septic and well permits, and driveway permits on county roads, stay with the health department and the Road Commission2221. For land outside the township, see the Roscommon County page, because each township sets its own zoning2.

Michigan exempts a person building their own home on their own property from residential-builder licensing, but building permits, codes and zoning still apply9. About 77.1% of Roscommon County is wooded and 98.4% of the land is gentle slope2930. The effective property tax rate is about 1%31.

Watch-outs

  • We could not confirm which agency issues building permits in Denton Township or what the fees are; ask the township office before you plan a build17.
  • Floodplain, land division and sewer connection rules for Denton Township were not confirmed; ask the zoning office about each17.
  • RV stays beyond 30 continuous days need a special use permit and site plan review, so do not plan to live in a camper on bare land without township approval7.
  • A septic permit is required before a building permit, and building before the permit is issued violates the sanitary code6.
