Zoning, building permits and septic rules in North Muskegon, Michigan

North Muskegon, Michigan runs its own zoning ordinance and requires a building permit for construction inside city limits12. Building permits and zoning compliance come from the city's inspection and planning offices at City Hall34. Does North Muskegon, Michigan have zoning, and what does it mean for lot size and setbacks?

Yes. North Muskegon adopted its own zoning ordinance, Ord. 568, in October 2024, and the city also publishes a zoning map110. Zoning here is a city rule, not a Muskegon County rule: the county only publishes a model ordinance for cities and townships to borrow from11.

Dimensions depend on the district. In the TRD district, the first column of the city's dimensional table, a detached single-family home needs at least 800 square feet of floor area and a lot of at least 5,000 square feet67. The MRD district allows detached single-family lots of 3,000 square feet7. TRD setbacks are 25 feet in front, 25 feet in the rear and 5 feet on one side, with 15 feet total for both sides8. TRD buildings top out at 35 feet and may cover 50 percent of the lot1213.

We could not confirm the full district names or which district a given street falls in. Ask the zoning administrator at City Hall for the district of the exact parcel4.

Do you need a building permit in North Muskegon, and who issues it?

Yes. North Muskegon requires a building permit for construction inside the city, and the city issues it, not Muskegon County2. Michigan's statewide construction code requires a written permit application to the local enforcing agency before building14. Zoning compliance is a separate approval that applies to projects that create, increase, extend or expand a use4.

Permits are picked up at City Hall, and when plan review applies, the permit is not issued until review is complete3. The city's fee schedule lists a $95 minimum permit fee that includes one inspection and $65 for each added or re-inspection; the schedule is dated January 1, 2024, so confirm current amounts at City Hall9. Starting work before the permit is approved can bring an investigation fee equal to the permit fee2. Contractors must register with the city3.

How do septic permits work in North Muskegon?

Septic permits are not a city matter. Muskegon County Public Health has jurisdiction over on-site sewage disposal throughout the county, including all cities, villages and townships5. A permit is required to install a new system, replace one or add to one1516.

The county fee schedule lists $175 for a septic system permit17. A permit stays valid for 2 years unless the Health Officer approves an extension15. Where a public sewer is available, plumbing must connect to it instead18. We could not confirm which North Muskegon streets are on city sewer, so ask City Hall before assuming a septic system is needed or allowed.

Buyers of a property with an existing system can request a paid evaluation from the county16.

Can you live in an RV or tiny home in North Muskegon?

We could not confirm North Muskegon's rules for living in an RV, a tiny home, an accessory dwelling or a manufactured home. The zoning ordinance defines manufactured homes, but its use rules for them and for RVs were not confirmed. Ask the zoning administrator before buying a lot with that plan4.

Two points narrow the question. State rules about campgrounds, which apply once five or more recreational units share a parcel for temporary living, do not answer whether one person may live in an RV on a lot19. For tiny houses, state guidance says local zoning, building, electrical and plumbing permits and approvals still apply20.

Building a home in North Muskegon: the steps, in order

  1. Confirm the parcel's zoning district and any lot-split needs with the zoning administrator4. Land divisions inside the city are submitted to the city21.
  2. Ask City Hall whether the address has city sewer; if not, apply to Muskegon County Public Health for a septic permit16.
  3. Submit the building permit application with plans; plan review, where required, finishes before the permit issues22.
  4. Register any contractor with the city3.
  5. Schedule inspections through the city's inspectors3. Michigan requires periodic inspection of permitted construction23.
  6. Request a Certificate of Occupancy; a new building may not be occupied until the code official issues one24.

What stays with Muskegon County, and what to check before you buy in North Muskegon

The city decides zoning and building permits inside its limits, but septic permits and well permits sit with county and state health authorities525. For land outside the city, see the Muskegon County page, because the city's rules do not apply there.

Before buying, check three things. First, the floodplain: Michigan requires an EGLE permit for work in the 100-year floodplain of rivers, streams and drains, and prohibits new residential construction in a floodway26. Second, driveway access: a driveway onto a state trunkline highway needs a state permit in addition to the local building permit27. Third, taxes: Muskegon County's effective property tax rate is about 1.3 percent28, with a median bill of $2,280 a year29.

Watch-outs

  • The district names in the zoning ordinance's dimensional table were not fully confirmed, so verify the exact district and its numbers with the zoning administrator before relying on the TRD figures here10.
  • The building permit fee schedule is dated January 1, 2024; confirm current fees with City Hall9.
  • We could not confirm the building code the city enforces, owner-builder rules inside the city, short-term rental rules or floodplain rules; ask the Inspection Department3.
  • Michigan's owner-builder exemption concerns residential-builder licensing and does not remove building permit or inspection requirements30.
