Building permits, zoning and land rules in Bellaire, Michigan

The Village of Bellaire in Antrim County requires a village zoning permit before covered construction or a change of use, and Antrim County issues the separate building permit.12 Bellaire also has its own zoning ordinance, including strict limits on RV occupancy.34 Properties served by an available public sewer must connect under village rules; where sewer is unavailable, the Health Department of Northwest Michigan evaluates the site and issues the septic permit.56

Do you need a building permit in Bellaire, Michigan?

Yes. Before covered construction or a change in use or occupancy inside the Village of Bellaire, the owner or agent must apply for a building permit; ordinary repairs have a limited exception.12 Antrim County Construction Code Department issues Bellaire's building permits and retains the building, plumbing, electrical and mechanical permits.213

A county building permit is separate from village zoning approval. Bellaire requires a zoning permit before covered construction, reconstruction, structural exterior alteration, moving a structure, changing a use or beginning construction excavation.1 Re-roofing, siding and window replacement on an existing building are among the stated zoning-permit exceptions, as are qualifying accessory buildings under 200 square feet; a building-code permit may still be required, so confirm both approvals before work.1

Does Bellaire have zoning, and what are the R-1 lot and setback rules?

The Village of Bellaire has its own zoning ordinance, administered and enforced by the Village Zoning Administrator.3 The ordinance establishes multiple districts, so first confirm the parcel's mapped district and permitted use rather than applying a residential standard villagewide.14

In the R-1 Single-Family Residential District, the minimum lot is 6,000 square feet and 50 feet wide.10 R-1 principal-building setbacks are 15 feet in front, 5 feet at the side and 10 feet at the rear, with additional corner, street-side, riverfront and projection rules.15 The R-1 schedule caps height at 3 stories and 35 feet and sets a 20-foot minimum dwelling width, subject to the stated exceptions.1617 The reviewed rule does not set a minimum dwelling floor area or answer tiny-home occupancy generally, so ask the Zoning Administrator to classify a proposed tiny house.

Can you live in an RV, manufactured home or accessory dwelling in Bellaire?

Bellaire allows limited RV occupancy rather than open-ended RV living. On a vacant parcel, one RV may be occupied for up to 30 days in a calendar year, no more than 15 consecutive days, and a zoning permit is required.4 On a lot with a dwelling, no more than one RV may be occupied at once and the annual limit is 15 days.4 Group gatherings with multiple RVs are allowed once per calendar year for no more than 10 consecutive days with approved temporary sanitary facilities and a zoning permit.18

A newly sited manufactured or mobile home on an individual lot must meet the district's setbacks, floor-area and dwelling-width rules, use an approved permanent foundation or basement, meet installation and anchoring standards, and have its wheels and axles removed.19 An accessory dwelling is limited to one per parcel and 800 square feet, must be within a principal or accessory structure rather than standing alone, and requires owner occupancy or qualifying owner management plus an additional parking space.11

How do sewer, septic and well permits work inside Bellaire?

Bellaire requires qualifying occupied buildings to connect to public sanitary sewer when the property abuts the relevant right-of-way and the sewer is within 250 feet; connection is due within 30 days after official notice.5 A separate village provision requires a water or sewer connection within 90 days after the county health authority requires replacement of a septic tank, drain field or well for a property within the stated service-area conditions.20

Where public sewer is unavailable under the village rule, a private wastewater system may be used only through the permit and health-department process.21 The Health Department of Northwest Michigan evaluates the site and issues the septic permit before installation, and the system is subject to final review.22 Water-supply-system permits also go through the health department, while Bellaire generally restricts private wells unless a stated exception applies.9 Countywide, only 8% of mapped soils are rated without severe limitations for a conventional septic drain field, so a parcel-specific site evaluation should come early.23

Building a home in Bellaire: what are the steps?

  1. Ask the Village Zoning Administrator to confirm the parcel's zoning district, allowed use, lot dimensions and site standards.24
  2. Resolve public water and sewer availability before fixing the site plan; where public sewer is unavailable, obtain the health department's site evaluation and septic permit, and address any private-well permit.5229
  3. Complete the village zoning-permit form, sign it, include the required fee and submit it to the village offices.2
  4. Apply separately to Antrim County Construction Code Department for the building permit and any plumbing, electrical or mechanical permits.13
  5. Keep work progressing and request county inspections; a county-administered permit can be cancelled after 6 months without a requested and conducted inspection.25
  6. For a new residential home, complete the required blower-door test before the county issues the certificate of occupancy.26

What should you check before buying land in Bellaire and Antrim County?

Confirm that the parcel is actually inside Village of Bellaire limits because Bellaire zoning does not govern land elsewhere in Antrim County. Bellaire administers its village zoning, while Antrim County has no countywide zoning ordinance and other local units may apply their own rules.327

Ask for the zoning map designation, permitted use, utility availability, any prior zoning approvals and the buildable area after setbacks.14 For a new driveway or reconstruction or paving of an existing driveway in an Antrim County road right-of-way, obtain the Road Commission permit.28 Waterfront county-permitted projects must provide elevations and flood certification before back-fill inspections.29 Floodplain requirements specific to every parcel inside the village were not confirmed, so ask the Village Zoning Administrator and County Construction Code Department before buying waterfront or low-lying land.

Watch-outs

  • A Bellaire zoning permit and an Antrim County building permit are separate approvals; receiving one does not replace the other.12
  • Bellaire's RV rule allows only short stays and requires a zoning permit for occupancy on a vacant parcel.4
  • Public-sewer availability can eliminate the private-septic option, while an unavailable sewer triggers health-department review rather than automatic permission for an off-grid system.521
  • Tiny-home occupancy, a general lot-coverage limit, short-term rentals and parcel-specific floodplain approval were not confirmed; ask the Village Zoning Administrator for a written parcel-specific answer.24
