Does Belfast, Maine have zoning, and what does it mean for RVs and tiny homes?

Yes. The City of Belfast, in Waldo County, has its own zoning ordinance, and Belfast's Planning and Codes Department administers the zoning code61. The area inside the bypass has Residential 1, Residential 2, Residential 3, Downtown Commercial, Waterfront Mixed Use 1 and Waterfront Mixed Use 2 districts6. We could not confirm the districts outside the bypass, so check the city's zoning map for a specific parcel.

Belfast does not allow RVs to be used for permanent housing, and that includes prebuilt tiny homes sold under the state RV classification3. Campgrounds and RV parks are not allowed in any zoning district inside the bypass10. Site-built tiny homes are permitted, with the same review and inspection as any other dwelling, and the city says there is no size restriction on an onsite-built very small home2. HUD-certified manufactured and modular homes also qualify as permanent dwellings8.

Accessory dwelling units are allowed in all zoning districts inside the bypass, subject to performance standards9. Lot size, setback and height tables were not available to us, so ask Planning and Codes before you design1.

Do you need a building permit in Belfast, Maine, and who issues it?

Belfast's Planning and Codes Department publishes a Building Permit form, plus electrical and plumbing permit forms, and takes applications through an online portal1. The city says every dwelling unit is subject to the building, plumbing and electrical codes as adopted, and that site-built homes go through review and inspection117. New HUD-certified mobile homes and modular homes are the one exception, because they are inspected at the factory7.

In short: inside Belfast city limits, plan on a city building permit and inspections for a new home. We did not confirm the permit fees, the exact inspection stages or whether an owner-builder exemption exists, so ask Planning and Codes at 207-338-3370, ext. 1251. Waldo County does not issue building permits or control zoning for Belfast or any other town4. Maine requires a certificate of occupancy before a building in a larger municipality can be occupied, so do not move in before the city signs off12.

How do septic permits work inside Belfast?

Septic permits in Maine follow statewide rules: a new, expanded or replacement subsurface wastewater system needs a permit before work starts, and the local plumbing inspector examines the application and issues it5. Applications generally require a site evaluation prepared by a licensed site evaluator5. Municipalities set their own permit fee, at or above the state minimum13.

Belfast's Planning and Codes page lists the state's HHE-200 Subsurface Wastewater System Permit Application among its permit forms1. Whether the city sewer reaches a given lot, and whether a new home must connect, is something we could not confirm, so ask Planning and Codes before assuming you need a septic system at all.

Soils matter countywide: only about 8% of Waldo County soils rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system on lots without sewer14.

Building a home in Belfast: the steps, in order

  1. Confirm the lot's zoning district on the city's zoning map and ask Planning and Codes about lot size, setbacks and height, which we could not confirm1.
  2. Ask whether public sewer and water serve the lot; if not, hire a licensed site evaluator for a septic design5.
  3. If you are dividing land, check the city's subdivision chapter15.
  4. Apply for the building permit, and electrical and plumbing permits, through the Planning and Codes portal1.
  5. Get the septic permit from the local plumbing inspector before any septic work begins5.
  6. Pass the city's inspections during construction7.
  7. Get the certificate of occupancy before anyone moves in12.

What stays with Waldo County, and what to check before you buy in Belfast

Waldo County does not control permitting or zoning; each municipality handles its own, and the county government has no authority over land use or comprehensive planning416. The county's own Commissioners' Office is in Belfast but does not issue building permits17. For land outside the city, see the Waldo County page, because each town sets its own rules.

Before buying, check floodplain status: Maine communities use a Flood Hazard Development Permit where a parcel is in a flood-prone area, and we did not confirm Belfast's floodplain rules18. Shoreland rules can also add limits for waterfront lots19. Waldo County's effective property tax rate is about 1.1%20.

Watch-outs

  • A prebuilt tiny home sold as an RV cannot be a permanent residence in Belfast, so buy a site-built or HUD-certified unit instead3.
  • We could not confirm Belfast's lot-size, setback, height, fee or floodplain rules; ask Planning and Codes at 207-338-3370, ext. 125 before you buy1.
  • Belfast's septic authority inside city limits is not confirmed here; ask Planning and Codes who issues septic permits for your address1.
