Zoning, building permits and septic rules in Ashburnham, Massachusetts

The Town of Ashburnham, Massachusetts adopts and administers its own zoning bylaw1, and building permits come from the town's building commissioner under the state building code2. Does Ashburnham, Massachusetts have zoning?

Yes. The Town of Ashburnham adopts and administers its own zoning bylaw, Chapter 250, and no building, structure or land may be used except as the schedule of use regulations allows1. Floodplain, water supply protection and other overlay districts apply on top of the base districts1.

In the R-A residential district, a lot needs at least 45,000 square feet and 150 feet of frontage8, with a 20-foot front yard and 10-foot side and rear yards11. The R-B district asks for 60,000 square feet and 200 feet of frontage12, with 40-foot front and 25-foot side and rear yards13. Ask the Building Department which district your parcel sits in before relying on either set.

Massachusetts zoning cannot regulate the interior area of a single-family home14, though the state building code still applies.

Do you need a building permit in Ashburnham, and who issues it?

In Ashburnham the building commissioner issues building permits, and construction of an accessory dwelling may not start until that permit is issued2. The Massachusetts state building code applies to every building in every city and town5, and the town bylaw requires conformity with it15. Building permits in Worcester County are handled by each municipality rather than the county4.

We could not confirm the town's inspection steps for an ordinary new home or its permit fees, so call the Building Department, which also handles zoning enforcement16.

Doing the work yourself: a person building their own home is not required to register as a home-improvement contractor10, but that exemption does not waive the building permit.

How do septic permits work in Ashburnham?

The Ashburnham Board of Health reviews and permits on-site sewage disposal3. The town bylaw says no building permit is issued until the sewage disposal works permit, when applicable, has been obtained from the Board of Health6. Statewide, local boards of health administer septic permits under state minimum requirements and may adopt stricter rules17.

Soils matter here. Only about 1% of Worcester County soils rate as not limited for a conventional drain field18, so expect a site evaluation and possibly an engineered system. In the floodway, septic tanks, cesspools and leaching fields are not permitted19.

Wells: the state lets a town require a local site permit from well drillers20; we could not confirm Ashburnham's well rules, so ask the21.

Can you live in an RV or tiny home in Ashburnham?

Living in an RV, camper or motor home in Ashburnham is allowed only inside a permitted and inspected campground, or under a temporary permit from the Board of Health7. A parked camper on your own lot is not an exception to that rule.

Tiny homes: the Massachusetts tiny-house statute applies to municipalities designated as seasonal communities that adopt bylaws permitting them22. We could not confirm that Ashburnham is such a community, so ask the Building Department.

The practical route to a small second dwelling is an accessory dwelling unit. These are allowed by right at 300 to 900 square feet9, and more than one on a lot needs a Planning Board special permit23. A manufactured home may be placed on the site of a residence destroyed by fire while it is rebuilt, for up to 12 months24.

Building a home in Ashburnham: the steps, in order

  1. Find your zoning district and confirm lot area, frontage and setbacks with the Building Department8.
  2. Check the floodplain overlay, which restricts fill, new construction and septic in the floodway19.
  3. Get septic approval from the Board of Health, which comes before the building permit when it applies6.
  4. Apply to the building commissioner for the building permit2.
  5. If you divide land into lots, the Planning Board's subdivision rules apply25.
  6. Do not move in until the building commissioner issues a certificate of occupancy; for accessory dwellings this is required explicitly26.

What stays with Worcester County, and what to check before you buy

Worcester County has no functioning county government for permits, so the Ashburnham offices above are your contacts, not a county counter4. For land outside Ashburnham, see the Worcester County page.

Before you buy, ask the Land Use Department about the district, any floodplain overlay and whether town sewer or water reaches the lot; subdivision lots must connect where town sewer or water is accessible27. Worcester County's effective property tax rate is 1.3%28. Farm use may have protection under state zoning law29, but we could not confirm Ashburnham's own farming rules.

Watch-outs

  • Yards in the R-A district may not be used for parking or storage of recreational vehicles, trailers and boats11.
  • Short-term rental of an accessory dwelling is discouraged and allowed only by Planning Board special permit30.
  • We could not confirm Ashburnham's building permit fees, driveway rules or septic inspection rules; call the Land Use Department before you commit16.
