Does Hadley, MA have zoning, and what are the lot sizes and setbacks?
Yes. The Town of Hadley adopts and administers its own Zoning Bylaw, and no building, structure or land may be used except for the uses its table of uses allows in the district where the property sits1. The districts named in the town's dimensional table include Residential, Agricultural-Residential, Limited Business and Local Business, Business, Aquifer Protection, Industrial and Floodplain5.
In the Residential district, a dwelling lot needs at least 22,500 square feet and 150 feet of frontage6. In Agricultural-Residential, the minimum is 30,000 square feet with 175 feet of frontage7. Principal buildings in both districts need a 50-foot front yard, a 15-foot side yard and a 40-foot rear yard813. Building coverage, accessory buildings included, tops out at 30 percent of the lot in Residential14 and 20 percent in Agricultural-Residential15. Height is capped at 35 feet and 2.5 stories in both1617.
New residential construction is not permitted in the floodplain district18. Overlay districts and special permit sections can add further requirements.
Can you live in an RV or tiny home in Hadley?
We could not confirm whether Hadley allows living in a recreational vehicle, a tiny home or a manufactured home on private land. The Zoning Bylaw's use table and general regulations decide it district by district, so ask the Town of Hadley Building Department before you buy or park anything19.
One state rule helps with a small second home: Massachusetts zoning bylaws cannot prohibit a single accessory dwelling unit in a single-family residential zoning district, though reasonable setback, height and state septic code requirements still apply11. Hadley's own accessory-dwelling article is the place to check the details. Zoning also cannot set a minimum interior floor area for a single-family home, although the state building code still applies12.
Do you need a building permit in Hadley, and who issues it?
Yes. Building a new house in Hadley takes a number of different permits, and the Town of Hadley Building Department is where the process starts2. The Massachusetts state building code is the code for all buildings in every city and town, and the local inspector enforces it20. Hadley's fee schedule and full permit list were not confirmed, so request them from the Building Department19.
The town's own page tells applicants to consult the building inspector first and to bring a plot plan drawn to scale showing the house, any accessory structures and the driveway layout321. We found no separate driveway-permit rule, so ask whether a curb cut needs its own approval.
Owner-builders can build their own home without registering as a home-improvement contractor, but that exemption does not remove the permit and inspection requirements10.
How do septic permits work in Hadley?
Septic systems in Massachusetts fall under Title 5, the state environmental code, which the local Approving Authority enforces with oversight from MassDEP4. We could not confirm which Hadley office is the Approving Authority, so ask the Town of Hadley Board of Health22.
No one may construct, upgrade, modify or expand a system without a Disposal System Construction Permit from the Approving Authority, and a site evaluation comes first9. Work and the Certificate of Compliance must be completed within three years of final approval9. For new construction on a septic system, the Certificate of Compliance must be issued before you apply for a Certificate of Occupancy23.
If the lot is connected to sewer, contact the Department of Public Works to determine the sewer fee before applying for any new construction24. Hadley's well permit rules were not confirmed; Massachusetts lets towns require a local site permit from well drillers25.
Building a home in Hadley: the steps, in order
- Ask the Building Department whether the lot is legal under the zoning minimums and which district it sits in319.
- Check the district's lot, setback, coverage and height rules above, and avoid the floodplain district for a new house18.
- If the lot is not on sewer, ask the Board of Health about the site evaluation and Title 5 permit922.
- If the lot is on sewer, contact the Department of Public Works for the sewer fee before applying24.
- Prepare a scaled plot plan showing the house, accessory structures and driveway, and apply for the building permits21.
- For a septic-served house, obtain the Title 5 Certificate of Compliance before applying for a Certificate of Occupancy23.
What stays with Hampshire County, and what should you check before you buy in Hadley?
Rules for unincorporated land do not apply here: Hadley's zoning and building permits come from the town, not from the county1. For the county overview, see the Hampshire County page.
Before buying, confirm the zoning district and whether any part of the lot lies in the floodplain district18. Ask the Planning Board and Building Department about the five zoning bylaw amendments from the May 2026 annual town meeting that were still pending Attorney General approval on the pages we reviewed1. Hampshire County's effective property tax rate is about 1.5 percent26, and the typical home value is about $460,86827.
