Does Trafalgar, Indiana have zoning, and what does it mean for lot size, setbacks and homes?
Yes. Trafalgar's Chapter 152 states that land in the town is classified and zoned into districts shown on the zoning maps1. The code lists residential districts R-1 through R-4, agricultural districts A and AC, and industrial, commercial and mixed-use districts; the official zone map is on file with the building commissioner11. Rules differ by district, so find your parcel's district first.
In R-1 Residential, the minimum lot is 6,500 square feet and 60 feet wide12, the minimum primary building is 1,000 square feet excluding garage, carports and porches7, and height tops out at 35 feet13.
In the A Agricultural District, lots must be 200 feet wide and at least 2 acres, or larger if the county health department requires more for a septic drain field9. The main floor must be at least 1,000 square feet, or 900 square feet for two-story homes8. Front setbacks run from 25 to 50 feet depending on road class, with 20 feet at the rear and 10 feet at the sides14. Maximum height is 50 feet15. Those minimum floor areas rule out most tiny homes in these two districts; we could not confirm a tiny-home or RV-occupancy rule, so ask the town planning and zoning office16.
Do you need a building permit in Trafalgar, and who issues it?
Yes. Inside Trafalgar, a permit is required before beginning construction, alteration or repair of any building or structure whose construction cost exceeds $5002. The application needs a plat or sketch showing lot boundaries plus plans and specifications, and fees are payable to the town2. The town's Planning and Zoning page offers separate residential and commercial building permit forms and a variance request packet16.
The town, not Johnson County, handles building permits inside town limits. The county's building department serves only unincorporated Johnson County, so a Trafalgar address is sent to the town office first16. We could not confirm which building code the town adopts, how inspections or certificates of occupancy work, or the fee schedule; ask the town office before you design.
How do septic permits work in Trafalgar?
Indiana requires a written construction permit signed by the health officer for any residence not connected to a sanitary sewer4. The rule is administered by local boards of health, so the Johnson County Health Department issues these permits, not the town317. The local health department must issue or deny a complete application within 30 days4.
In Trafalgar's R-1 and A districts, attachment to public water and sanitary sewer is mandatory for development as those facilities become available56. Where they are not available in the A district, the town's septic and well standards apply6. Ask the town whether sewer reaches your lot before you pay for a soil evaluation. Statewide, drywells and cesspools are not allowed18.
Can you put a mobile home, accessory apartment or RV on a lot in Trafalgar?
Mobile homes are a special exception, not a permitted use, in Trafalgar's A Agricultural District, and only for mobile homes required by farmers10. Accessory apartments are also a special exception in the A district19. Both go through the Board of Zoning Appeals. We could not confirm any rule on living in an RV or on temporary camping inside the town; ask the town Planning and Zoning office before parking one on a lot. Indiana's campground rule does not cover individually deeded lots, so it does not answer the question20.
Building a home in Trafalgar: the steps, in order
- Confirm your parcel's zoning district with the town Planning and Zoning office16.
- Ask whether public sewer and water reach the lot; if not, call the Johnson County Health Department about a septic permit17.
- Check lot size and setbacks for your district, for example 2 acres and 200 feet of width in the A district9.
- Apply for the town building permit with a plat or sketch and plans; permits are required above $500 in construction cost2.
- If the project needs a state construction design release, the state review takes 10 business days for an initial determination21.
- A driveway onto a state highway needs an INDOT permit22.
What stays with Johnson County, and what to check before you buy in Trafalgar
Land outside the town limits falls under the county. For unincorporated Johnson County, see the Johnson County page. Septic and wells stay with the county health department; Indiana says several local health departments require a well permit, so ask Johnson County whether yours does23. Floodway construction needs prior DNR approval on streams draining more than 1 square mile24.
Countywide, only about 1% of soils are rated not limited for a conventional septic drain field25. That is a strict rating, so expect a site evaluation and possibly an engineered system. Johnson County's median property tax bill is $1,875 a year26.
Watch-outs
- We could not confirm Trafalgar's building code, inspection steps, certificate of occupancy rules, fee schedule or floodplain rules; call the town Planning and Zoning office at the number listed before you commit16.
- Mobile homes and accessory apartments are special exceptions in the A district and need Board of Zoning Appeals approval1019.
- Subdivision is strictly prohibited in the Agricultural Conservation (AC) district, so check whether a parcel is AC before planning a split27.
