Zoning, building permits and septic rules in Danville, Illinois

Danville, Illinois requires a building permit for new construction and for smaller jobs such as fences, decks and sheds, and the city issues those permits through its Community Development office12. Danville adopts its own zoning code, so lot size and setbacks depend on the district3. Septic permits for lots without public sewer come from the Vermilion County Health Department4.

Does Danville, Illinois have zoning?

Yes. Danville enforces its own zoning code inside city limits, and the code lists these districts: AG, RR, R-1, R-2, R-3, R-4, MHP, P-1, B-1, B-2, B-3, B-4, I-1 and I-235. Your lot's district decides what you can build, so confirm it with the city's Planning / Zoning division before you buy10.

District numbers differ a lot. In R-1 single-family, the minimum lot is 8,000 sq ft and 70 ft wide, with 25 ft front and rear yards, 8 ft side yards, 25% maximum lot coverage and a 35 ft height limit11121314. In RR rural residential, the minimum lot is 3 acres and 150 ft wide, side yards are 15 ft and lot coverage tops out at 5%151617. The AG district needs 15 acres and 300 ft of width15. A single-family dwelling needs at least 864 sq ft of usable floor area8.

RV living, camping and tiny homes: we could not confirm what Danville allows, so ask the zoning office before you plan on any of them.

Do you need a building permit in Danville, and who issues it?

Yes. Danville requires a building permit for new construction, alterations, additions, demolition and moving of structures inside city limits1. The city's list of permitted work also reaches fences, patios and decks, sheds, swimming pools deeper than 24 inches and replacement windows1. The city's Community Development office, through its Building Safety staff, issues the permits and accepts building permit applications only through its Citizen Serve online portal2.

Danville has adopted the 2021 International Building Code with its own amendments6. The State of Illinois does not issue building permits for privately funded construction; that falls to the local government18. Illinois also set a statewide building-code baseline starting in 202519.

We could not confirm Danville's permit fees, its owner-builder rules or its certificate-of-occupancy process, so call Building Safety at 217-431-2321 for those2.

How do septic permits work inside Danville?

Most Danville lots connect to city sewer, but a lot that uses a private septic system needs the county's approval. Danville's zoning code makes private water and sewage systems subject to the zoning administrator's approval after the lot conforms to county health department regulations7. The Vermilion County Health Department issues permits for new and renovated private sewage disposal systems4. Illinois requires plan approval before any new private sewage system is built20.

The applicant must have the soil analyzed by a soil classifier to learn whether it can handle a subsurface discharging system4. USDA rates none of Vermilion County's soils as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system21.

No private sewage system may serve a building within 300 feet of the high water level of Lake Vermilion22. We could not confirm which Danville districts allow private systems at all, or whether a well is allowed on a city lot, so ask the zoning office and the health department.

Can you live in an RV, tiny home or manufactured home in Danville?

We could not confirm Danville's rules for living in an RV, camping on private land, or building a tiny home or accessory dwelling; ask the Planning / Zoning division before you commit10. A tiny home would still have to meet the 864 sq ft minimum for a single-family dwelling if it counts as one, but we could not confirm that it does8.

Manufactured homes are allowed with limits. In the R-2, R-3 and R-4 districts, a manufactured housing unit is permitted only after a manufactured housing design review9. Mobile home parks need a tract of at least 10 acres, and each mobile home must be skirted9. Statewide, Illinois treats a manufactured home as a dwelling23; Danville's district rules decide where one can go.

Building a home in Danville: the steps, in order

  1. Look up your lot's zoning district and confirm lot size, setbacks and height with Planning / Zoning510.
  2. If the lot has no city sewer, start the septic process with the Vermilion County Health Department, beginning with a soil analysis4.
  3. Prepare plans for review; the city publishes plan requirements for one- and two-family dwellings on its permits page2.
  4. Apply for the building permit through the Citizen Serve portal2.
  5. Schedule every inspection yourself; the city may charge $100 per offense if an inspection is not scheduled2.
  6. Ask Building Safety how the certificate of occupancy works before you move in; we could not confirm that process2.

What stays with Vermilion County, and what should you check before you buy in Danville?

Septic permits and soil evaluation stay with the Vermilion County Health Department, even for lots inside Danville74. Land outside city limits follows county and state rules instead; see the Vermilion County page for unincorporated land.

Before buying, check the lot's zoning district, whether public sewer reaches it, and flood exposure. We could not confirm Danville's flood hazard rules or its sewer and water connection requirements, so ask the city Building Safety office2. A driveway onto a state highway needs a state permit from IDOT24.

Costs are county-level figures: Vermilion County's effective property tax rate is 1.8% and the median property tax bill is $1,666 a year2526.

Watch-outs

  • Danville's zoning rules differ sharply by district, from 8,000 sq ft lots in R-1 to 15 acres in AG, so confirm the district before you buy1115.
  • The county's rules for unincorporated land do not apply inside Danville, and the city's rules do not apply outside it3.
  • We could not confirm Danville's permit fees, owner-builder rules, certificate-of-occupancy process, flood rules or RV and tiny-home rules; call the city's Building Safety office at 217-431-23212.

Rules another office applies inside Danville

Danville does not set these itself; the county, a health district or the state does, and they apply to every address inside its limits.

  • Who permits septicMixed (with conditions)

Lots inside Danville city limits that use private (individual) water and sewage systems instead of public utilities.

    • The zoning code makes lot approval for private water and sewage systems subject to the zoning administrator after conformance with county health department regulations (section 150.060(g)). The county health department is therefore the rule-maker for the private system itself.
    • The city code also controls sewer use and bars privies and septic tanks except as the code provides (chapter 51, section 51.02(C), not verified verbatim).
    • Section 150.060(g) also bars a building served by a private sanitary sewer within 300 feet of the high water level of Lake Vermilion.
    • The agency is not named on the page; it is recorded here as the county health department (Vermilion County) per the text.
“in any district where private water and sanitary sewage systems are used instead of public utilities, the minimum lot area, width and depth shall be subject to approval of the zoning administrator after conformance with county health department regulations.”
