Does Niantic, Illinois have zoning?

Yes. The Village of Niantic has its own zoning ordinance, Chapter 245, and no building may be erected, enlarged or moved except in conformity with the height, yard, area and parking rules for its district18. The ordinance names R-1 and R-2 residence districts, B-1 and B-2 commercial districts and an M-1 industrial district4. We could not find an official zoning map, so ask the village which district a specific lot is in.

This applies only inside village limits. Land outside the village in unincorporated Macon County is under the county's zoning instead; see the Macon County page.

What are the lot size, setback and height rules in Niantic?

In the R-1 district, a lot used for a dwelling needs at least 7,500 square feet per family and 60 feet of width where public water and sewer serve it5. In R-2 the minimums are 6,000 square feet and 40 feet6. A lot without public water or sewer falls under a separate area rule that we could not review, so ask the village before buying such a lot.

For R-1 dwellings the yards are 35 feet in front, 10 feet at the side and 40 feet at the rear9. For R-2 dwellings they are 30 feet in front, 8 feet at the side and 35 feet at the rear10. Buildings in any R district may not exceed 2 1/2 stories or 35 feet7. In other districts the limit is three stories or 45 feet, and the M-1 industrial district can reach 75 feet with extra setbacks11.

Can you live in an RV or tiny home in Niantic?

Living in a trailer, camper or RV inside Niantic is allowed only as a special use in a trailer camp or tourist camp, and a trailer is not a dwelling under Chapter 2452. Such a camp needs referral to the board of appeals and a public hearing before authorization12. A trailer camp needs at least 2,000 square feet of lot area per trailer and no trailer closer than 25 feet to a side or rear lot line2. In short, parking an RV on a village lot and living in it is not an option the ordinance provides.

We found no tiny-home rule in Niantic, so contact the village before planning one.

Do you need a building permit in Niantic, and who issues it?

We could not confirm Niantic's building permit rules, the fees, or the inspection steps. We did not verify the village's permit threshold, so ask the Niantic village office before you start work. Illinois does not itself issue building permits for privately funded construction; any permit requirement is set by the local government13.

The Macon County Planning & Zoning Department issues building permits only for land outside incorporated cities, villages and towns14, so it is not the office for a lot inside Niantic.

How do septic permits work in Niantic?

In Macon County, building a private sewage disposal system requires a permit from the County Health Department3. The Environmental Health Division reviews plans, issues septic permits and inspects installation15. The permit is valid for six months if construction has not started16.

Whether a lot inside Niantic must connect to public sewer instead, we could not confirm. Ask the village before assuming you can install a septic system. Wells need a separate permit from the County Health Department17.

What stays with Macon County, and what should you check before buying in Niantic?

Septic and well permits go through the Macon County Health Department, even for addresses inside the village317. Land outside village limits is covered by the county's building and zoning rules; see the Macon County page.

Before buying, ask the village which zoning district the lot is in, whether public water and sewer serve it, and what building permit rules apply. Driveway access onto a state highway needs an IDOT permit18. Macon County's typical home value is about $127,75719 and its effective property tax rate is 2.1%20.

Watch-outs

  • We could not confirm Niantic's building permit, inspection, fee or sewer-connection rules, and Illinois leaves permit requirements to local government, so ask the village office before you buy or build13.
  • The village code we reviewed includes legislation through 07-15-2021, so later zoning amendments may exist1.
  • Macon County's building permit office does not serve lots inside village limits14.
