Geneva, Illinois (Kane County) requires building permits for work under its residential code, issued by the city's Building Division12. The city writes and enforces its own zoning3, and living in a recreational vehicle on any lot inside the city is prohibited4. Septic permits are a separate question: Kane County Health Department issues them countywide5.

Do you need a building permit in Geneva, Illinois?
Yes, for building work under the residential code. Geneva has adopted the 2021 International Residential Code, with local revisions, for detached one- and two-family dwellings and townhouses of not more than six units6. The city's permit rule keeps most of the model code's list of work exempt from permits, but it deletes several of the exemptions that appear under "Building" in that list1. Because the city narrowed the exemptions, assume that sheds, fences, decks and similar projects may need a permit and ask the Building Division before you start.
Illinois does not issue building permits for privately funded construction; any permit requirement is set by the local government12. For a lot inside Geneva, that government is the City of Geneva, not Kane County1.
Who issues building permits in Geneva, and how do you reach them?
The City of Geneva Building Division issues building permits for property inside the city. Call 630 262-0280 or email [email protected] for general permit application questions2. The city's own permit handouts say the Building Division works from 109 James Street2.
One exception matters: properties in the Mill Creek area are not under the city's jurisdiction, and the city sends those owners to the Kane County Building Division instead2. If your parcel has a Geneva mailing address but sits outside city limits, confirm which jurisdiction covers it before you apply. Kane County's building permit rules apply only to unincorporated land13. We could not confirm the city's permit fees or application steps; the Building Division can give both.
Does Geneva have zoning, and what does it mean for RVs, lot size and setbacks?
Geneva administers its own zoning under Title 11 of the city code, through a director of community development, a planning and zoning commission and special use procedures3. Kane County's zoning ordinance covers only unincorporated land, and incorporated municipalities may administer their own zoning14.
Rules differ by district. In the Rural Single-Family Residential (RR) district, principal uses need at least 40,000 square feet of lot area and 150 feet of frontage8. Setbacks there are 40 feet at the street, 20 feet at the side and 60 feet at the rear15. Buildings and impervious surfaces together may cover no more than 30% of an RR lot9, and buildings may not exceed 35 feet10.
In the R5 district, a single-family detached house needs 10,000 square feet and 75 feet of frontage16. R5 setbacks are 20 feet at the street, 8 feet at the side and 25 feet at the rear17, with up to 65% lot coverage18 and the same 35-foot height cap11.
How do septic permits work inside Geneva?
Kane County Health Department runs the private sewage program: a county septic permit is required for a new system, a repair, an upgrade or added capacity19. Call 630-444-3040 to request a septic inspection or permit20. Every application for a new system or a renovation of the septic field needs a soil evaluation20.
Where public sewer is reachable, Kane County requires a connection unless reaching it takes more than a 4-inch pipe or creates an undue hardship7. Whether the city adds its own septic or sewer-connection rules inside city limits is unconfirmed; ask the Building Division. Kane County's well permits are issued by the health officer21.
Can you live in an RV or tiny home in Geneva?
Not in an RV. Geneva's code states that no recreational vehicle may be used for living, sleeping or housekeeping purposes on any zoning lot within the city4. A resident may park or store one RV on an improved surface in a side or rear yard of a residential lot, and street-yard parking is limited to 24 hours for loading and unloading4. That rule applies to a vacant lot you own while you build, too.
We could not confirm Geneva's rules for tiny homes or manufactured homes. Ask the Building Division, and check the district's permitted-use table in Title 11 before you buy3.
Building a home in Geneva: the steps, in order
- Confirm the lot is inside Geneva city limits and not in the Mill Creek area, which the city does not cover2.
- Look up the lot's zoning district in Title 11 and check lot area, frontage, setbacks, coverage and the 35-foot height limit for that district310.
- Ask the Building Division at 630 262-0280 for the permit application and fee schedule2.
- Confirm whether public sewer reaches the lot; if it does not, call Kane County Health Department at 630-444-3040 about a soil evaluation and septic permit207.
- If the lot lies in a mapped flood hazard area, expect construction documents to include the documentation required by the city's flood plain ordinance22.
- Build to the city's residential code and schedule inspections through the Building Division6.
What stays with Kane County, and what to check before you buy in Geneva?
Septic permits and wells go through Kane County Health, whether or not the lot is in the city521. The county's own building permit rules apply to unincorporated Kane County, not to land inside Geneva13. For land outside Geneva, see the Kane County page.
Also check floodplain status (the city's flood plain ordinance applies in flood hazard areas22) and driveway access onto a state highway, which needs an IDOT permit23. Kane County's effective property tax rate is 2.4%24, with a median property tax bill of $7,230 a year25.
Watch-outs
- Several of the exemptions that the model residential code lists for building work were deleted in Geneva, so small projects such as sheds and decks may need building permits1.
- Living in an RV is prohibited on every lot inside Geneva, including a lot you own while building4.
- Mill Creek properties are not under the City of Geneva's jurisdiction, so confirm your parcel's jurisdiction before applying for a building permit2.
- We could not confirm Geneva's building permit fees, owner-builder rules, inspection steps or tiny-home rules; call the Building Division at 630 262-02802.
