Does Oak Lawn, IL have zoning, and what does it mean for lots and setbacks?

The Village of Oak Lawn applies its own Title 4 zoning regulations to all land inside village limits, with uses and dimensions set district by district1. The village code publishes residential, commercial, office, manufacturing, public lands and parking districts8.

In the R-1 single-family residence district, interior lots must be at least 6,875 square feet and 55 feet wide at the setback line, and corner lots at least 7,500 square feet and 60 feet wide, with exceptions for smaller lots the code defines6. R-1 front yards run at least 25 feet unless the average-setback exception applies9. Rear yards must be at least 30 feet or 20 percent of lot depth, whichever is smaller9.

A dwelling and its accessory buildings may cover 35 percent of an R-1 lot, or 40 percent on a corner lot10. Buildings in R-1 may not exceed 2.5 stories or 30 feet7.

Do you need a building permit in Oak Lawn, and who issues it?

Inside Oak Lawn, building permits come from the village's Building Division, in the lower level of Village Hall2. Cook County's Department of Building and Zoning handles unincorporated Cook County only, so the county's permit counter is the wrong office for an Oak Lawn address11.

The village requires a permit before anyone builds or alters concrete, asphalt or brick-paver surfaces on an R-1 lot5. That covers sidewalks, driveways and patios12. The flatwork permit fee is $30 and the inspection fee is $40, both paid at application13. Applications need a plat of survey14, and the village must get 24 hours' notice before concrete forms are placed so inspectors can see them before the pour15.

We could not confirm the village's fees or inspection steps for a new house or addition. Call the Building Division at (708) 499-7800 or email [email protected]2.

Who do you contact about zoning in Oak Lawn?

Zoning questions and variation petitions go to Oak Lawn's Community Development department at (708) 499-780016. The Zoning and Planning Commission meets on the first and third Mondays of each month at 7:30 p.m. in the Village Hall auditorium16.

The village code also has a separate title for subdivision regulations, so dividing a lot is regulated inside Oak Lawn17. We did not confirm the substance of those subdivision rules.

How do septic permits work inside Oak Lawn?

Cook County's Department of Public Health reviews and approves private sewage disposal systems throughout Cook County, except in four named municipalities with their own septic ordinances: Barrington Hills, Inverness, Palos Park and South Barrington4. Oak Lawn is not on that list. Buying or selling a home with a well or septic system typically triggers an evaluation4.

We could not confirm whether the village requires new homes to connect to public sewer and water, or what the village's own sanitation rules say about private systems. Ask the Building Division and the health department's Environmental Health office at 708-836-8600 before you plan anything other than a sewer connection4. Conventional septic fields also rate poorly in Cook County soils: only 0.9% rate as not limited, so expect a site evaluation18.

Can you live in an RV or tiny home, or add a second dwelling, in Oak Lawn?

We could not confirm how the Village of Oak Lawn treats RV occupancy, tiny homes, manufactured homes or accessory dwelling units. The pages we reviewed show no occupancy rule for recreational vehicles. They show only a limit on parking large trucks in the single-family district, and the accessory-building rules did not say whether an accessory building may serve as a dwelling. Ask Community Development at (708) 499-7800 before buying or placing anything other than a conventionally built single-family home16.

Building a home in Oak Lawn: the steps, in order

  1. Confirm the lot's zoning district and its lot, yard, coverage and height limits with Community Development16.
  2. If you need a variation, such as a setback exception, petition the Zoning and Planning Commission or the Appeals and Review Board16.
  3. Get building permits from the Building Division at [email protected] or (708) 499-78002.
  4. Get a village permit for any driveway, patio or sidewalk before you pour it, and give 24 hours' notice for the form inspection15.
  5. Confirm sewer or septic arrangements; any private sewage system goes through the Cook County Department of Public Health4.

What stays with Cook County, and what to check before you buy in Oak Lawn

Septic and well reviews stay with the Cook County Department of Public Health4. For land outside village limits, the county's own rules apply; see the Cook County page.

The village's code ties foundation grades to its flood control and protection chapter, which we could not review, so ask the Building Division about floodplain mapping for a specific address. Cook County's typical home value is $343,350 and its effective property tax rate is 2%1920. Cook County's typical home insurance premium is $1,643 a year21. Oak Lawn is a dense suburb, not rural land.

Watch-outs

  • Cook County's permit and zoning offices do not serve incorporated Oak Lawn; the county says inquiries for municipalities go to the local authority2.
  • We could not confirm Oak Lawn's rules for RVs, tiny homes, accessory dwellings, short-term rentals or minimum house size; call Community Development at (708) 499-780016.
  • Lot and setback figures here are for the R-1 single-family district only; other districts differ6.
