Does Oglethorpe, Georgia have zoning?

Yes. Oglethorpe's code divides the city into seven zoning districts: A-1 agricultural, R-1 single-family residential, R-2 multifamily residential, C-1 general commercial, C-2 highway commercial, I-1 light industrial and I-2 heavy industrial5. The zoning map is kept in the office of the city clerk5.

For mobile homes and trailers, the rule depends on the district. Oglethorpe's R-1 single-family district excludes trailers and mobile homes7, and trailer parks are a permitted use in the C-2 highway commercial district7. We could not confirm Oglethorpe's rules on RV living, tiny homes, accessory dwellings, setbacks or minimum home size; ask the Macon County Building Department before you buy.

These are the city's rules. Macon County's separate zoning ordinance covers unincorporated Macon County, not land inside Oglethorpe10.

Do you need a building permit in Oglethorpe, and who issues it?

Yes. Oglethorpe's code requires a building permit for erecting, moving, adding to or structurally altering a building inside the city, and issues it only in conformity with the city zoning chapter1. A permit becomes invalid if no substantial construction progress is made within six months of issuance11.

The Macon County Building Department issues construction permits for the City of Oglethorpe at the county courthouse on Sumter Street2. Call 478-472-7023 to ask about the process or make an appointment2. We could not confirm which building code the city has adopted, its inspection rules or its permit fees, so ask the same office what to expect.

Georgia does not require a license to build your own home, but that exemption does not waive local permits, inspections or zoning9.

How do septic permits work inside Oglethorpe?

Oglethorpe generally expects homes to use public sewer. A house abutting a street with a public sewer must connect within 90 days of official notice if the sewer is within 300 feet of the property line8. Private septic tanks are allowed only where public sewer is not available12.

Where septic is allowed, the city superintendent issues a city permit and inspects, and the county health department must also approve the system3. The city will not issue a permit for a subsurface absorption system on a lot under 20,000 square feet6. The city must inspect within 72 hours of notice, and you must give that notice before the underground parts are covered13.

Septic tank permits and inspections in Macon County are controlled by the Health Department, and a copy of the septic permit is needed to get a building permit14. Call the Macon County Health Department at 478-472-812115.

Building a home in Oglethorpe: the steps, in order

  1. Confirm the lot's zoning district with the city clerk, who keeps the zoning map5.
  2. Ask whether public sewer reaches the lot. If it is within 300 feet of the property line, plan to connect8.
  3. If there is no sewer, contact the Macon County Health Department for a septic evaluation and permit14.
  4. Apply for the building permit at the Macon County Building Department, which issues construction permits for the City of Oglethorpe2.
  5. Build to the approved plans; changes need county approval16.
  6. Request each required inspection, including the footing inspection before pouring17.

What stays with Macon County, and what should you check before buying in Oglethorpe?

Septic approval and the health department's role stay with Macon County3. For land outside city limits, see the Macon County page; the county's own zoning and permit rules apply only to unincorporated land10.

Before buying, check flood status. Oglethorpe requires new residential construction in mapped special flood hazard areas to have the lowest floor elevated to or above base flood elevation18. A substantial improvement means a cost of at least 50 percent of the structure's market value18. For a driveway onto a state highway, Georgia requires a permit from the GDOT district office19.

Macon County's effective property tax rate is 1.2 percent20.

Watch-outs

  • Oglethorpe's code requires a building permit, but we could not confirm the city's adopted building code, permit fees or inspection rules; call the Macon County Building Department at 478-472-70232.
  • The city's septic rules are stricter than a bare health-department permit: lots under 20,000 square feet cannot get a subsurface absorption permit6.
  • We could not confirm Oglethorpe's rules on private wells, RV living, tiny homes, setbacks or driveway permits; ask the Building Department before you commit to a lot2.
