Does Milner, Georgia have zoning, and what does it mean for RVs and tiny homes?

Yes. The City of Milner adopts its own zoning chapter, with A-R, R-1, R-2, R-3 and P-R districts, and in the A-R district any use the code does not list as permitted is specifically prohibited1.

That matters for RVs. In the A-R district the code lists only the parking of unoccupied travel trailers and motor coaches, so living in an RV there is not a listed use4. Milner's rules for other districts were not reviewed, so confirm with City Hall before planning to camp on a lot.

Tiny homes face a size wall: Milner sets minimum heated floor areas by district, from 1,400 square feet in A-R5 to 1,600 in R-38. A small dwelling under those minimums would need an exception from the city. A manufactured or industrialized home in A-R must also have at least 1,400 heated square feet12.

What are Milner's minimum house sizes, lot sizes and setbacks?

Milner's numbers depend on the district, so check your parcel's zoning first.

  • A-R: minimum dwelling 1,400 heated square feet5; minimum lot 130,680 square feet in sewered areas, with older lots of record under one acre still buildable9; setbacks of 35 feet front, 20 feet side and 40 feet rear13; building coverage up to 40 percent14; height up to 35 feet15.
  • R-1: minimum house 2,000 heated square feet6 on a lot of at least 43,560 square feet10.
  • R-2: minimum house 1,800 heated square feet7 on a lot of at least 29,055 square feet16.
  • R-3: minimum house 1,600 heated square feet8 on a lot of at least 20,000 square feet17.

In A-R, a guest house must sit in the rear yard and cannot be rental property18.

Do you need a building permit in Milner, and who issues it?

We could not confirm who issues building permits inside Milner city limits. The city's code authorizes building codes, but the adopting ordinance and permit process were not found, so call Milner City Hall before you break ground.

Do not assume the county counter handles it. Lamar County's Planning and Community Development office states that it issues building permits and inspections for the unincorporated areas of Lamar County3, not for land inside city limits.

Georgia's mandatory state construction codes apply to any structure built in the state, whether or not a local government enforces them19. Owner-builders need no state contractor license for their own home, but that does not waive local permits, inspections or zoning11. Inside a floodplain area, Milner requires the lowest floor to be at least 1 foot above base flood elevation20.

How do septic permits work in Milner?

Septic is a health-department matter, not a city one. Lamar County's septic and well permits go through District 4 Public Health, and the Lamar County Environmental Health Office is the local contact2122.

Georgia requires a construction permit before a septic system is built, repaired or replaced, and the County Board of Health must find the site suitable first23. The system cannot be backfilled or used until the Board of Health gives a final inspection and written approval24.

Whether a Milner lot can use septic at all is a separate question. Where a public sewer is available within 200 feet of the property line, Georgia requires connection to it25. We could not confirm whether Milner's own code adds a sewer-connection mandate, so ask City Hall which sewer service reaches your lot.

Private wells need a location permit from District 426.

Building a home in Milner: the steps, in order

  1. Find your parcel's zoning district (A-R, R-1, R-2, R-3 or P-R) with Milner City Hall; the district sets house size, lot size and setbacks1.
  2. Ask City Hall who issues building permits in the city, since we could not confirm this.
  3. Contact the Lamar County Environmental Health Office to ask whether sewer or septic serves the lot22.
  4. Check whether the lot is in a flood hazard area, where the lowest floor must sit at least 1 foot above base flood elevation20.
  5. Design to the district's minimum floor area and setbacks5.
  6. Get permits and inspections, including the Board of Health's final inspection if you install a septic system24.

What stays with Lamar County, and what to check before you buy in Milner

Septic and well permits stay with the Lamar County Environmental Health Office whether the lot is inside the city or not226. For land outside Milner city limits, the county's own rules apply instead; see the Lamar County page.

In unincorporated Lamar County, new lots within 2 miles of Milner's geographic center must be at least 1 acre, and lots farther out need at least 5 acres27. That is a useful contrast if you are choosing between a lot in town and one just outside it.

Before you buy, check the parcel's zoning district, flood status, sewer availability and driveway access with City Hall. Lamar County's effective property tax rate is about 0.9 percent28; this is a county figure, not a Milner-only one.

Watch-outs

  • We could not confirm who issues building permits or inspections inside Milner city limits; ask Milner City Hall before you buy or build; the county's permit office serves only unincorporated land3.
  • Milner's zoning rules for RV occupancy and tiny homes outside the A-R district were not reviewed, so ask City Hall about your specific district4.
  • Lamar County's building and zoning office covers only unincorporated land, so do not rely on it for a lot inside Milner3.
  • Septic and well permits come from the Lamar County Environmental Health Office even inside city limits, and a nearby public sewer may require connection25.
