Zoning, building permits and septic rules in Flowery Branch, Georgia

Flowery Branch, Georgia, in Hall County, administers its own Zoning Ordinance through a Zoning Administrator1, and the city's Planning & Community Development department oversees building permits and inspections2. Septic is different: Hall County Environmental Health sets the on-site sewage lot-size minimums inside the city3. Minimum heated floor area for a new home runs from 1,000 to 2,500 square feet depending on the zoning district4.

Does Flowery Branch, Georgia have zoning, and what does it mean for RVs, tiny homes and lot size?

Yes. Flowery Branch administers its own Zoning Ordinance with an Official Zoning Map and a Zoning Administrator1. The residential and agricultural districts are A, R-1, R-2, MHP, SF-TH and RMU; the older R-3 and PUD districts remain on the map but cannot be expanded or newly applied7.

Lot size depends on the district. A detached single-family lot needs at least 130,680 square feet in A, 20,000 in R-1, 15,000 in R-2, 10,000 in MHP and 6,700 in SF-TH8. Front setbacks for principal buildings are 80 feet in A, 35 in R-1 and 25 in R-2 and MHP9. Maximum building coverage is 25 percent in A and R-1 and 35 percent in R-210.

Minimum heated floor area is 2,500 square feet in A, 2,200 in R-1 and 2,000 in R-24. Those floors rule out most tiny homes in the conventional residential districts, and we located no tiny-home provision in the city's code4.

Do you need a building permit in Flowery Branch, and who issues it?

The city's Planning & Community Development department oversees building permits, plan review and building inspections inside Flowery Branch2. Applications go through the city's online self-service portal listed on that page2; call the department at 770-967-63782.

The one building-permit rule we verified in the city code covers relocated homes: moving a residence into or out of the city requires a building permit, and the Zoning Administrator inspects the structure1112. We could not confirm the city's general residential permit rules, adopted building code, fee schedule or owner-builder handling, so ask Community Development before you plan work. Georgia does not require a license to build your own home, but that does not waive local permits6.

Separately, Hall County's building inspections office issues permits only for unincorporated land, so it is not the right counter for a lot inside city limits13.

How do septic permits work inside Flowery Branch?

Septic stays with Hall County, not the city. Flowery Branch's zoning tables say that where an on-site sewage system is used, the minimum lot size requirements of the Hall County Environmental Health Department apply and may exceed the city's minimums3. Hall County Environmental Health is a section of the Georgia Department of Public Health14.

Its application requirements say a valid, issued septic system permit is required before a building permit for new construction, and that a well permit is applied for at the same time when public water is unavailable15. Those requirements are written for the county permit process, and we could not confirm how they interact with the city's permit steps, so call Environmental Health at 770-531-3973 before you buy a lot that needs septic15. Whether a given lot has city sewer and water available is also unconfirmed; ask the city's public utilities department.

Hall County's soil survey rates 69 percent of its soils as not limited for a conventional septic drain field, which is a county-wide figure and not a rating of any one lot16.

Can you live in an RV or manufactured home in Flowery Branch?

RVs may be parked or stored anywhere on residential premises except within a front yard for more than two weeks, and not on any vacant residential lot5. Parking or storage rules are not an answer to living in an RV: the sections we reviewed do not address residential occupancy, so ask Community Development before planning to camp on a lot5. Camping on public streets, sidewalks and public rights-of-way is unlawful, and private land is not addressed there17.

Manufactured homes are zoning-restricted. Class A manufactured homes are conditional in the A district, permitted in MHP and prohibited in R-1, R-2, SF-TH and RMU18. New MHP zoning is allowed only next to an existing manufactured home park or where the land was designated MHP at annexation18.

Can you add an accessory dwelling in Flowery Branch?

Accessory apartments depend on the district. A detached accessory apartment is prohibited in A, MHP and SF-TH and conditional in R-1, R-2 and RMU19. An attached accessory apartment is conditional only in R-2 and RMU and prohibited elsewhere19. Confirm your parcel's district with the Zoning Administrator before designing a guest house or in-law suite1.

Building a home in Flowery Branch: the steps, in order

  1. Ask Community Development which zoning district the parcel is in, then check lot size, setbacks and minimum floor area for that district7.
  2. Call Hall County Environmental Health at 770-531-3973 if the lot will use a septic system, since the county sets septic lot minimums inside the city153.
  3. Check the floodplain: new development in the future-conditions floodplain must meet Article 32, and residential lowest floors must sit 3 feet above base flood elevation or 1 foot above the future-conditions flood elevation, whichever is higher20.
  4. Apply for the building permit through the city's online portal or Community Development at 770-967-63782.
  5. Schedule building inspections with the city department as work proceeds2.

What stays with Hall County, and what to check before you buy

Septic and well permits stay with Hall County Environmental Health15. Land outside Flowery Branch city limits falls under Hall County's own rules instead, including its Unified Development Code zoning and county building permits; see the Hall County page for those answers21.

Before buying, confirm the zoning district, septic suitability, floodplain status and whether city water and sewer reach the lot. Hall County's effective property tax rate is 0.8 percent, with a median bill of $2,382 a year2223.

Watch-outs

  • Minimum heated floor areas of 1,000 to 2,500 square feet by district make small homes and tiny homes hard to place in most Flowery Branch districts4.
  • The city's general residential building permit rules, fee schedule and adopted building code were not confirmed; ask Planning & Community Development at 770-967-63782.
  • Rules for the county's unincorporated land do not apply inside Flowery Branch, and city rules do not apply outside it1.
