The Town of Tallulah Falls, Georgia requires a building permit for buildings and structures inside town limits1, and the town has its own zoning2. Septic permits for new construction come from the county health department, not the town3. Land outside town limits falls under Habersham County's rules instead; see the Habersham County page.

Does Tallulah Falls, GA have zoning, and what does it mean for RVs, tiny homes and lot size?
The Town of Tallulah Falls has its own zoning, with agricultural, R-1 single-family residential, business and highway business districts referenced in town documents28. We did not reach the full district map, so confirm your parcel's district with Town Hall before you buy.
In the agricultural (A) district, single-family homes including modular and manufactured homes, but not mobile homes, need a lot of at least 1 acre5. Height is capped at 35 feet, with front setbacks of 60 feet from public highways and 35 feet from other streets, and 15 feet for both rear and side setbacks9. Camping on your own land in the A district is a conditional use that needs council approval and is limited to 7 consecutive days and 4 times a calendar year, with 14 days between periods4. That is camping, not living in an RV. We could not confirm town rules for long-term RV living or tiny homes, so ask Town Hall.
Do you need a building permit in Tallulah Falls, and who issues it?
Yes. Town code says no building, structure or sign may be erected, moved, extended, enlarged or structurally altered without a permit, and the town issues it1. Accessory buildings of 200 sq ft or less that are not permanently affixed to another building are exempt1. Construction must conform to ICC construction standards10, and a land disturbing activity permit is also required1.
After construction, a certificate of occupancy from the town's administrative officer is required before you occupy or use a new building11. Georgia lets owners build their own home without a contractor license, but that does not waive local permits, inspections or zoning6. The town's form offers a homeowner's affidavit for owner-occupied construction7. Contact Town Hall at (706) 754-604012. We could not find a published town fee schedule or inspection rules.
How do septic permits work inside Tallulah Falls?
Septic permits for addresses in Tallulah Falls come from the county, not the town. The town requires applicants to bring a septic permit from the county department of public health for all new construction permits, for changes to the number of bedrooms, and for changes of use of multi-family or commercial buildings3. In Habersham County, that is Habersham County Environmental Health13.
Georgia requires a County Board of Health construction permit before any on-site sewage system is installed14, and a final inspection and written approval before the system is backfilled or used15. Where a public or community sewer is within 200 feet of the property line, connection is required16. We could not confirm whether the town requires sewer connection; the town lists a water tap fee but we found no connection rule, so ask Town Hall12.
Building a home in Tallulah Falls: the steps, in order
- Ask Town Hall which zoning district your parcel is in and whether your plan fits it12.
- Get a septic permit from Habersham County Environmental Health313.
- Apply for the town building permit, plus the land disturbing activity permit1.
- Follow any Department of Natural Resources water setbacks and FEMA floodplain setbacks17.
- Build to ICC standards10.
- Get the certificate of occupancy before you move in11.
What stays with Habersham County, and what should you check before you buy?
The county's rules apply to unincorporated land, not inside town limits. For land outside Tallulah Falls, see the Habersham County page. Septic permits and wells stay with the county health department1813. A private well must be installed by a licensed water-well contractor, who notifies the county health department before drilling18.
Before you buy, confirm the parcel is inside town limits, its zoning district, and flood or state-water setbacks17. Habersham County's soils are a mixed picture for septic: about 32.5% rate as not limited for a conventional drain field, so many lots need a site evaluation19. The county's effective property tax rate is 0.6%20.
Watch-outs
- Short-term vacation rentals of 30 days or less are prohibited in Tallulah Falls unless the zoning district specifically permits them, and the town allows them only in the business and highway business districts218.
- Permits expire if work does not begin within 12 months of issuance, and a land disturbing permit expires if work has not begun within 120 days22.
- We could not confirm the town's rules on RV living, tiny homes, accessory dwellings, minimum home size or permit fees; ask Town Hall at (706) 754-604012.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
