Zoning, building permits and septic rules in Sugar Hill, Georgia

Sugar Hill, Georgia, inside Gwinnett County, runs its own zoning ordinance for land inside city limits1. The city's Building Services office takes permit forms and inspection requests2. Septic systems answer to the Gwinnett County Board of Health, not city hall3. Land outside city limits follows Gwinnett County's rules instead.

Does Sugar Hill, Georgia have zoning, and what does it mean for lot size and homes?

Yes. The City of Sugar Hill has its own zoning ordinance, which divides land inside city limits into zoning districts1. Districts include AF (Agricultural-Forest), several RS single-family residential districts, MH, and commercial and industrial districts4. Land inside city limits that the zoning map does not show is classified Agricultural and Forest under the city's proposed update4.

The district decides the numbers. In the AF district the minimum lot area is 40,000 square feet and the minimum lot width is 100 feet5. In the RS-200 district the minimum lot area is 20,000 square feet6. Both districts list a minimum dwelling size of 2,000 square feet for a single story and 2,400 square feet for two stories or more910. The smaller RS districts have smaller lots, so find the parcel's district before you rely on any figure.

Accessory dwellings are allowed with conditions: the main home must be owner-occupied, and the unit needs at least 400 square feet of heated living space7. We could not confirm which districts allow them, so ask Sugar Hill Planning & Development11.

Do you need a building permit in Sugar Hill, and who issues it?

Sugar Hill has its own Building Services office at 5039 West Broad Street, and the city publishes permit forms and takes inspection requests there2. Inside city limits, the city office is the one to contact, not Gwinnett County's Planning and Development department. Gwinnett County's building permits cover unincorporated Gwinnett County only12.

We could not confirm the city's exemptions, fees or owner-builder rules, so call Building Services before assuming any project is exempt. Georgia does not require a contractor license to build your own home, but that does not waive local permits or inspections13. Georgia's mandatory state building codes apply to construction whether or not a city enforces them locally14.

Inspection requests must go to the city's inspections email address2.

How do septic permits work inside Sugar Hill?

Septic is a county health matter, even inside the city. Sugar Hill's zoning ordinance says a single-family home on a septic tank cannot sit on a lot smaller than the Gwinnett County Board of Health requires3. The city's district minimum lot size applies as well3.

Septic permits come from Gwinnett Environmental Health, part of GNR Health15. Gwinnett Environmental Health requires a Level 3 soil report before it permits new septic systems, repairs and additions that modify an existing system16. Georgia also requires a septic construction permit, valid for no more than 12 months17.

If a public or community sewer is within 200 feet of the property line or in the abutting right-of-way, Georgia requires connection18. We could not confirm where city sewer reaches in Sugar Hill, so ask the city before you plan a septic field.

Can you live in an RV or tiny home in Sugar Hill?

We could not confirm Sugar Hill's rules on living in an RV, temporary camping or tiny homes; the city zoning ordinance is where those rules would sit, so ask Planning & Development11. Do not assume Gwinnett County's rules apply, because the county's UDO covers unincorporated areas only19.

Georgia's state guidance says a tiny home built as a site-built or modular dwelling is subject to the same building codes as any other home, and the local government must approve its siting8.

Building a home in Sugar Hill: the steps, in order

  1. Find the parcel's zoning district with Sugar Hill Planning & Development, and check lot size, dwelling size and setbacks for that district411.
  2. If the lot will use septic, contact Gwinnett Environmental Health first, because a Level 3 soil report is required before permitting1615.
  3. Ask Sugar Hill Building Services which permit forms apply to your project2.
  4. Request inspections through the city's inspections email as work proceeds2.
  5. Only a local government can issue a certificate of occupancy, so confirm with the city who issues yours20.

What stays with Gwinnett County, and what to check before you buy

Septic permits and inspections stay with Gwinnett Environmental Health3. Land outside Sugar Hill city limits follows Gwinnett County's rules, where the county's building permits and zoning apply to unincorporated land only12.

Gwinnett County's typical home value is about $411,19021 and its median property tax bill is $3,381 per year22. Driveways onto a state highway need a state permit from the Georgia DOT23. For wells, a Georgia contractor must contact the local county health department in advance24.

Watch-outs

  • The city re-adopted its zoning map in 2025 and a newer version of the ordinance exists, so confirm a parcel's current district and standards with Sugar Hill Planning & Development before you buy1.
  • We could not confirm Sugar Hill's building permit exemptions, fees or building code details, so ask Building Services directly2.
  • Whether a parcel can use septic at all may depend on city sewer availability, which we could not confirm; Georgia requires sewer connection when a public system is close enough18.
