Ellijay, Georgia (in Gilmer County) has its own zoning ordinance with nine districts, and the city's Code Enforcement Department handles building permits and inspections inside city limits12. Septic permits come from Gilmer County Environmental Health, not the city3. Land outside city limits falls under Gilmer County Planning and Zoning instead4.

Does Ellijay, Georgia have zoning?
Yes. Ellijay adopted its own zoning ordinance, and no principal building, structure or land use is allowed inside city limits except in the districts and for the purposes its use table lists1. The districts are R-1, R-2, R-3, MHP, O/RC, G-C, CBD, I-1 and I-2, and some uses are allowed only with a conditional use permit from the zoning board of appeals10.
For a home, that means the district decides what you can put on a lot. Every dwelling in every district must have at least 600 square feet of floor area for the first occupant plus 100 square feet for each additional occupant, and the city's dwelling-type table sets higher minimums7. Lot-size, setback and height tables for each Ellijay district are something we could not confirm, so ask the City of Ellijay Code Enforcement Department for your parcel's district before you make an offer2.
Tiny homes are not addressed in the city rules we reviewed. Georgia treats a site-built or modular tiny home as an ordinary dwelling that the local government must approve for siting11.
Do you need a building permit in Ellijay, and who issues it?
Inside Ellijay city limits, the City of Ellijay Code Enforcement Department is the office to call for building permits and inspections2. The city's own code confirms a building permit is required to locate a manufactured home in Ellijay5. We could not confirm the city's general residential permit rules or fee schedule, so ask the department directly for both.
Georgia's mandatory state building codes apply to all construction whether or not a local government enforces them12. Building your own home does not require a state contractor license, but that exemption does not waive local permits, inspections or zoning8.
The county is a different office: Gilmer County Planning and Zoning issues building permits for land outside city limits, so a parcel with an Ellijay mailing address may still be in the county. See the Gilmer County page for those rules4.
How do septic permits work inside Ellijay?
Septic is not a city function. Ellijay's code directs applicants to the Gilmer County Health Department for the sanitary permit for on-site sewage disposal3. For a manufactured home, that permit is required before the city issues its mobile home permit13.
Georgia law requires a county health department construction permit before physical development of a lot where an on-site sewage system will be used14. The office to call is Gilmer County Environmental Health15.
If public sewer is within 200 feet of the property line or in the right-of-way abutting it, Georgia requires connection to it16. We could not confirm Ellijay's own sewer-connection rules; the Ellijay-Gilmer County Water & Sewerage Authority handles service in its area17.
Can you put a manufactured home, RV or tiny home in Ellijay?
Manufactured homes are allowed under conditions. Before the city building inspector issues a mobile home permit, the owner needs a location decal from the Gilmer County tax commissioner, an approved space or park, a Gilmer County Health Department sanitary permit and an E911 address18. The home must carry a HUD label, and single-family Type II and III dwellings are conditional uses in some districts6.
We could not confirm any Ellijay rule on living in an RV on private land. What the city code does say is that overnight camping in city parks is restricted9. If your lot is in a flood hazard area, RVs there must be on site fewer than 180 consecutive days, be highway ready, or meet new-construction standards19.
Building a home in Ellijay: the steps, in order
- Confirm the parcel is inside city limits, not just Ellijay-addressed; if it is outside, use Gilmer County's rules4.
- Ask the City of Ellijay Code Enforcement Department which zoning district applies and whether your use needs a conditional use permit210.
- Check the flood map: building in a special flood hazard area has extra elevation rules19.
- Call Gilmer County Environmental Health for a site evaluation and the sanitary permit153.
- Apply for the building permit with the city's Code Enforcement Department and schedule inspections2.
- For a manufactured home, collect the county decal, approved space, septic permit and E911 address first18.
What stays with Gilmer County, and what to check before you buy
Septic and well questions stay with the county and state health offices rather than the city3. Georgia says certain county health departments require a well construction permit, so ask Gilmer County Environmental Health before drilling20.
Soils matter. Only about 13% of Gilmer County's soils are rated not limited for a conventional septic drain field, so expect a site evaluation and possibly an engineered system21. The county's effective property tax rate is about 0.4%22.
A driveway onto a state highway needs a permit from the Georgia DOT district office23. We could not confirm a city driveway permit rule.
Watch-outs
- East Ellijay is a separate city; confirm which city's limits your parcel is in before you contact an office1.
- We could not confirm Ellijay's general residential building permit steps, fee schedule, lot-size or setback tables; ask the City of Ellijay Code Enforcement Department2.
- Georgia's mandatory state building codes apply even where a permit office is not enforcing them12.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
