Does Pine Lake, GA have zoning, and what does it mean for lots and setbacks?

Yes. Pine Lake, Georgia adopted its own zoning ordinance, published as Appendix A of the city code, and no land or structure inside the city may be used or built except in conformity with its district's regulations1. DeKalb County's zoning ordinance covers only unincorporated DeKalb County, so it does not govern a lot inside Pine Lake8.

In the R-1 Single Family Residential District, a lot needs at least 6,000 square feet, 60 feet of continuous street frontage and 100 feet of depth6. Setbacks are 20 feet in front, 10 feet on the sides for a single-story house (15 feet for two stories) and 10 feet in the rear9. Lot coverage, counted as all impervious surfaces, tops out at 35 percent10.

R-1 sets no minimum floor area for a principal dwelling, but it does cap size: 2,600 square feet on lots up to 60 feet wide or 6,000 square feet, and up to 3,200 square feet on larger lots7. Small lot, low coverage cap, big setbacks: the rules favor modest homes.

Do you need a building permit in Pine Lake, and who issues it?

Pine Lake City Hall runs the process for building permits inside city limits. The city's building code is based on the DeKalb County building code, which rests on the International Building Code, with a small number of Pine Lake additions2. Zoning compliance review is done by the city's zoning official, and plan review by a contracted Building Code Compliance Consultant2.

Accessory buildings need their own building permit, and one is not issued before the permit for the principal dwelling, though the two may be issued together11. An accessory building over 200 square feet also needs a separate certificate of occupancy, issued after the one for the house12.

A homeowner working without a licensed contractor files a Homeowner Affidavit with the permit application2. The DeKalb County permit division handles county-run projects and says that a project inside an incorporated city may have a different permitting authority13.

How do septic permits work for a lot in Pine Lake?

Septic permits are a county health function, not a Pine Lake City Hall one. DeKalb Public Health Environmental Health must permit a new septic system, a new drain line or a repair before a contractor starts work3. The contractor files a Construction Permit and Site Approval application and an engineered site plan checklist, by email to [email protected] or in person at 445 Winn Way, Suite 320, Decatur314.

Georgia rules also require a final inspection and written approval from the County Board of Health before a system is backfilled or used15. A permit is valid for no more than 12 months16.

Whether a specific Pine Lake address is on public sewer or needs a septic system is something we could not confirm; ask City Hall and Environmental Health before you plan around either. Where a public sewer is available within 200 feet of the property line, Georgia requires connection17.

Can you live in an RV or tiny home in Pine Lake, GA?

Not in an RV or trailer. Pine Lake's code prohibits trailers, mobile homes, mobile living units, semi-permanent living units and temporary living quarters within city limits4. Manufactured homes are also barred as accessory buildings4. Because these terms cover living quarters on wheels, confirm with City Hall before parking any camper on a lot.

Tiny houses are allowed only in a planned development: an R-1 tract of at least 2 acres, approved by the mayor and council, where single-family detached lots can be as small as 4,000 square feet5. Tiny homes on wheels are otherwise prohibited5.

An accessory dwelling is a more practical route. One is allowed per lot, either inside the principal dwelling or in an accessory building, with floor area no greater than the principal dwelling and one extra off-street parking space18. Accessory buildings top out at 24 feet or the height of the house, whichever is less19.

Building a home in Pine Lake: the steps, in order

  1. Send City Hall the Construction Pre-Planning Review form; the City Administrator contacts you to explain which steps apply2.
  2. Get zoning compliance review from the city's zoning official2.
  3. Apply for a building permit, with the Homeowner Affidavit if you are not using a licensed contractor, and pay the fees2.
  4. Have the plans reviewed by the city's code consultant, then receive the building permit and the trade permits for electrical, plumbing and HVAC2.
  5. If the lot will use septic, get the septic permit from DeKalb Public Health before work begins3.
  6. Pass inspections through the project and the final inspection, which leads to a Certificate of Occupancy or Completion2.

Georgia does not require a license to build your own home, but the exemption does not waive local codes, permits or inspections20.

What stays with DeKalb County, and what should you check before you buy in Pine Lake?

Septic permits come from the county health department, as above21. For land outside Pine Lake's limits, DeKalb County's own permit and zoning rules apply; see the DeKalb County page.

Check the flood map first. Inside Pine Lake, new principal buildings are not allowed in the future-conditions floodplain unless the city's floodplain sections are met, and the lowest floor must be at least 3 feet above base flood elevation or 1 foot above the future-conditions flood elevation, whichever is higher22. An RV stays legal there only if it is on site under 180 consecutive days and road-ready22.

Subdivision is also tight: no lot may be reduced in size, altered in shape or re-platted unless the result meets the district's lot rules23. DeKalb County's effective property tax rate is 0.9%24.

Watch-outs

  • Pine Lake's building inspection process, permit fees and owner-builder rules beyond the Homeowner Affidavit are set by City Hall; call before you budget, since we could not confirm the current fee amounts2.
  • Septic is separate from city permits: Pine Lake City Hall does not issue septic permits, and DeKalb Public Health must approve a system before work begins3.
  • Trailers, mobile homes and temporary living quarters are prohibited in city limits, so do not plan to live in a camper on a Pine Lake lot4.
