Zoning, building permits and septic rules in Oldsmar, Florida

The City of Oldsmar, Florida, in Pinellas County, adopts and enforces its own zoning through its Land Development Code1. Does Oldsmar, FL have zoning, and what does it mean for lot size and setbacks?

Yes. Oldsmar adopts its own zoning through the city's Land Development Code, with residential districts E-1, E-2, R-1 and R-2 plus others such as the Town Center111. Rules differ by district.

In R-1, lots need at least 8,700 square feet, 75 feet of width and 100 feet of depth8, with setbacks of 25 feet front, 7.5 feet side and 10 feet rear12. In R-2, the minimum lot is 6,000 square feet13 and the side setback is 6 feet14. E-2 lots start at 16,500 square feet15, and E-1 estate lots at 40,000 square feet16.

Buildings in R-1 top out at 35 feet17, and lot coverage is capped at 50 percent, up to 65 percent with a pool18. These are city rules for land inside Oldsmar, not for unincorporated Pinellas County.

What is the minimum house size in Oldsmar?

Minimum floor area depends on the district. R-1 and R-2 require at least 1,250 square feet45. E-2 requires 1,800 square feet6, and E-1 requires 2,000 square feet7. Tiny homes under those sizes are therefore not an option in these districts, and we could not confirm a separate tiny-home rule; ask the Planning Division.

Do you need a building permit in Oldsmar, and who issues it?

Two offices are involved. Under an interlocal agreement, all Florida Building Code permits for Oldsmar are issued by Pinellas County2. Before that, the city's Building Division handles zoning and land use approval, flood review, public works and fire approvals, then issues a pre-permit approval letter2.

Properties in the community redevelopment area or along the Tampa Road corridor also need architectural approval from the city2. Florida's statewide building code applies in the city19.

We could not confirm Oldsmar-specific owner-builder rules or fees. Pinellas County says owner-builders may start the application but must appear in person for affidavit verification20; confirm with the county that this applies to city projects. Pinellas County Building and Development Review Services is at 440 Court Street, Clearwater21.

How do septic permits work inside Oldsmar?

Septic permitting and inspections in Pinellas County are handled by the Florida Department of Health in Pinellas County, not by the state's environmental agency322. Florida requires a permit to install, repair, modify or abandon an onsite septic system23.

Whether a given Oldsmar lot must connect to city sewer instead is not something we could confirm; ask the City of Oldsmar Building Division before assuming a septic system is allowed. Across Pinellas County, USDA rates almost none of the soil as suitable for a conventional drain field, so expect an engineered system if sewer is not available24.

Can you build an accessory dwelling or live in an RV in Oldsmar?

In the Town Center Residential district, one accessory dwelling per lot is allowed, a detached unit may not exceed 800 square feet, and the owner must live on the property9. We did not confirm accessory dwelling rules in other districts.

For RVs, the only city rule we confirmed covers overnight camping in city parks, which is limited to designated areas or with permission from the department director25. Living in an RV on a private lot in Oldsmar is unconfirmed; ask the Planning Division.

Building a home in Oldsmar: the steps, in order

  1. Confirm the lot's zoning district with the Planning Division and check lot size, setbacks and minimum home size above1.
  2. Ask the City of Oldsmar Building Division to start the staff review for zoning, flood, public works and fire approvals2.
  3. Get architectural approval if the lot is in the community redevelopment area or on the Tampa Road corridor2.
  4. Receive the city's pre-permit approval letter, then apply to Pinellas County for the Florida Building Code permit2.
  5. If the lot has no sewer, apply to the Florida Department of Health in Pinellas County for a septic permit3.
  6. Manufactured homes placed in flood hazard areas need an elevation certification of the lowest floor10.

What stays with Pinellas County, and what to check before you buy in Oldsmar

Septic permits, and the issuing of building code permits, sit with the county even for Oldsmar addresses32. The county's own zoning applies only to unincorporated Pinellas County; the county's page limits its zoning resources to unincorporated land26. For land outside city limits, see the Pinellas County page.

Pinellas County's typical home insurance premium runs about $4,764 a year27, and its effective property tax rate is 0.7%28. Check the flood zone first, since flood zones add review steps29.

Watch-outs

  • Do not assume the city issues the building permit: Pinellas County issues Florida Building Code permits for Oldsmar after the city's approval2.
  • We could not confirm Oldsmar's rules for tiny homes, RV living on private land, permit fees or owner-builders; call the Building Division at 813-749-11242.
  • Oldsmar's website notes the 2026 Florida Building Code takes effect December 31, 20262.

  24. Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
