Does Clearwater, FL have zoning, and what does it mean for lots, setbacks and ADUs?

Clearwater applies its own zoning inside city limits through its Community Development Code1. The rules differ by district, so check the district for your parcel before you plan anything.

In the Low Density Residential (LDR) district, detached dwellings under the flexible standard need 10,000-20,000 sq ft of lot area7, with a front setback of 25 ft, side setbacks of 5-10 ft and rear setbacks of 10-20 ft9, and a 30 ft height limit10. In the Medium Density Residential (MDR) district, detached dwellings can sit on 3,000-5,000 sq ft11.

Accessory dwelling units are allowed in the LDR, LMDR and MDR districts, one per parcel with conforming density, capped at 750 sq ft or 50% of the main home, whichever is less, and the owner must live in either the main home or the ADU6. We could not confirm a tiny-home provision or a minimum dwelling size in Clearwater's code; ask the city's permitting office before you buy2.

Do you need a building permit in Clearwater, and who issues it?

The City of Clearwater's permitting office takes applications for new construction, repairs or replacement of building components, fences, fire systems and tree removal inside the city2. Clearwater lies within Pinellas County, but the county's building department serves unincorporated land, so city addresses are handled by the city instead. Applications are filed online, and the same office handles inspections2.

We could not confirm Clearwater's owner-builder rules or certificate-of-occupancy process from the city's code; call the permitting office before you start. Florida's statewide building code applies to construction in Pinellas County12.

Water and wastewater impact fees are payable when the building permit issues, and the fee is tripled if work starts without paying it8.

How do septic permits work inside Clearwater, FL?

Septic permits are separate from building permits. Florida requires a permit to install, replace, repair or modify an onsite sewage system3, and the Florida Department of Health in Pinellas County handles septic permitting and inspections for Pinellas County413.

We could not confirm whether a given Clearwater address is served by city sewer or would need a septic system, or how the city's utility-connection rules apply. Ask the Florida Department of Health in Pinellas County and the city's permitting office before you assume a septic system is an option. Florida soils rate poorly for conventional drain fields: only 0% of Pinellas County soils rate as not limited for septic14, so expect a site evaluation and often an engineered system where septic is allowed at all.

Can you live in an RV, camper or manufactured home in Clearwater?

Living in a camper or house trailer on private land inside Clearwater is barred outside approved RV parks5. Camping on public beaches, the Courtney Campbell Recreation Area and parks is allowed only in areas authorized by a special event permit5.

Manufactured homes in coastal high hazard areas (Zone V) inside Clearwater may be newly installed only in existing manufactured home parks and existing manufactured home subdivisions15. Manufactured homes installed or replaced in flood hazard areas are inspected by the building official16, and the lowest-floor elevation must be certified17. We could not confirm the district rules for manufactured homes elsewhere in the city.
