The Village of Palmetto Bay, Florida has its own zoning code, and its own Building & Permitting Department handles building permits12. Septic systems must meet state Health Department and Miami-Dade DERM requirements3. An RV may be parked but not slept in4. Land outside village limits follows Miami-Dade County's rules instead5.

Does Palmetto Bay, Florida have zoning, and what does it mean for lot size and setbacks?
Yes. The Village of Palmetto Bay adopted its own zoning code, and its districts include AG, R-1, E-M, E-S, R-2, B-1 and others16. Rules differ by district, so find your parcel's district on the Village's zoning map before you plan anything10.
In the E-M Estate Modified district, a lot needs at least 15,000 net square feet and 120 feet of frontage7. In the E-S Estate Suburban district, the minimum is 25,000 square feet and 125 feet of frontage8.
Principal buildings in E-M need setbacks of 25 feet front, 25 feet rear and 15 feet on the interior side11. In E-S the front setback grows to 35 feet12. Both districts cap lot coverage at 0.32 of the lot, accessory buildings included1314, and both limit height to 35 feet and 2 stories1516.
Minimum home size also depends on the district: 1,500 square feet in E-M and 2,000 square feet in E-S1718.
Do you need a building permit in Palmetto Bay, and who issues it?
Inside the village, the Village of Palmetto Bay Building & Permitting Department handles building permits. The Village states that anyone who intends to construct, enlarge, alter, repair, move or demolish a building must first obtain the required building permit2. The Village's page does not list exceptions, so call 305-259-1250 or email [email protected] before assuming a small project is exempt2.
Contractors must register with the Village before applying for a permit2. The Village also reduced building permit fees in 2025 for certain home-improvement projects on homesteaded properties, such as driveways, pools and fences2; ask the department for the fee on your particular project.
Miami-Dade County's building permit office serves only unincorporated land, and incorporated municipalities administer permits within their own limits19. A Palmetto Bay address is not sent to the county permit counter.
How do septic permits work inside Palmetto Bay?
The Village does not issue septic permits. Palmetto Bay's zoning code requires any septic system to comply with state Health Department and Miami-Dade DERM requirements3. Countywide, the Florida Department of Health in Miami-Dade County permits and inspects septic tanks2021, and DERM reviews and approves new and total replacement systems22.
A conventional Type 1 septic system is not allowed for new and total replacement systems serving development in Miami-Dade County, so plan for an advanced treatment system22. Soils point the same way: USDA rates 0% of Miami-Dade County soils as not limited for a conventional drain field, so expect a site evaluation23.
If your lot sits in the county water and sewer service area with a sewer lateral, you may be required to connect to sewer instead24. We could not confirm the Village's own septic or sewer-connection rules, so ask the Building & Permitting Department.
Can you live in an RV or tiny home in Palmetto Bay?
Not in an RV. On single-family or duplex sites, Palmetto Bay allows one RV parked per premises, with limits on length, placement and registration, and no hookups other than periodic maintenance9. Sleeping quarters in RVs and boats are prohibited4. Tents under 400 square feet need a building permit and are limited to special events of up to 3 consecutive days, two times per year, per residence4.
A second dwelling is possible in a narrow form. In the E-M district, servants' quarters or guest houses not over one story are allowed when incidental to the principal residence, E-S allows all E-M uses, and deed restrictions may prohibit them25.
We could not confirm any Village rule on tiny homes or manufactured homes. Ask the Planning & Zoning Department before you buy10.
Building a home in Palmetto Bay: the steps, in order
- Look up your parcel's zoning district on the Village zoning map, then check lot size, setbacks and minimum home size for that district106.
- Check the Village's flood rules; development in flood hazard areas follows the Village's floodplain regulations26.
- If you will not connect to sewer, start the septic process with the Florida Department of Health in Miami-Dade County and DERM321.
- Register your contractor with the Village, or ask the Building & Permitting Department about owner-builder rules, which we could not confirm for the village2.
- Apply for the building permit through the Village's Building & Permitting Department2.
- Schedule inspections and get final approvals from the Village; we could not confirm the Village's certificate of occupancy rules, so ask the department2.
What stays with Miami-Dade County, and what to check before you buy
Septic permitting and inspection stay with the county health department and DERM, as above20. Wells need Florida Department of Health approval where public water is unavailable27. For land outside village limits, the county's own rules apply; see the Miami-Dade County page for unincorporated land.
Before you buy, price the carrying costs. Miami-Dade County's typical home value is $522,60128, its effective property tax rate is 0.8%29, and the typical home insurance premium is about $7,089 a year30. These are county figures, not Palmetto Bay figures.
Confirm the flood zone, since the Village regulates development in flood hazard areas26.
Watch-outs
- Search results for "Miami-Dade building permits" lead to the county's unincorporated-area office, which does not issue building permits inside Palmetto Bay19.
- A conventional Type 1 septic system is not allowed for new and total replacement systems in Miami-Dade County, so budget for an advanced system22.
- Sleeping in an RV or boat on a residential lot is prohibited in Palmetto Bay4.
- We could not confirm Palmetto Bay's rules on owner-builders, tiny homes, wells, driveways or short-term rentals; call the Building & Permitting Department at 305-259-12502.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
