Does Bal Harbour have zoning, and what does it mean for RVs, tiny homes, lot size and setbacks?

Yes. The Village of Bal Harbour has its own Zoning Ordinance covering all land inside the village1. Rules differ by district, so check which one a lot sits in.

In the R-1 Single Family Residential District, lots must hold at least 15,000 square feet and be 70 feet wide at the street (50 feet on a cul-de-sac)5. R-1 homes need at least 2,500 square feet of floor area, not counting garages, porte-cocheres, carports and open terraces6. Because of that floor-area minimum, a tiny home is not a realistic fit in the R-1 district6; we found no separate tiny-home rule.

In the R-2 Single Family Residential District, lots must hold at least 10,000 square feet and be 60 feet wide (50 feet on a cul-de-sac)8. R-2 setbacks are 30 feet in front, 15 feet at the rear and 10 feet at the side, with more room required as buildings rise above 18 feet9.

Parking or keeping a camper, motor home or house trailer used for habitation in a residential district for more than four hours is deemed a nuisance, so living in an RV on a residential lot in Bal Harbour is effectively off the table4. Sleeping outdoors on public property or rights-of-way is separately restricted10.

Do you need a building permit in Bal Harbour, and who issues it?

The Village of Bal Harbour Building Department handles building work inside the village, stating that it administers and supervises the Florida Building Code, Florida Statutes and local ordinances2. Miami-Dade County's building permit requirement is written for unincorporated areas, and the county says incorporated municipalities administer permits within their city limits11. Inside Bal Harbour, then, the village is the office to call, not the county permit center.

We could not confirm the village's permit thresholds, fee schedule or owner-builder rules, so ask the Building Department before assuming a project is exempt. Development in a flood hazard area inside the village falls under the village's flood damage prevention chapter, which is administered with the Florida Building Code12. New manufactured homes cannot be installed in any special flood hazard area7.

How do septic permits work inside Bal Harbour?

Septic permits are a health and environmental matter, not a village building-department matter. In Miami-Dade County, the Florida Department of Health county office performs septic permitting and inspection3, and county DERM reviews and approves new and total replacement systems3. Conventional Type 1 septic systems are not allowed for new and total replacement systems serving development in Miami-Dade County13.

We did not confirm whether a given Bal Harbour address is on village sewer, so ask the Village Public Works department whether a lot can connect before planning any septic system. Where a public sewer is available, state law can require an existing system to connect14. Wells are a separate Florida Department of Health approval15.

Building a home in Bal Harbour: the steps, in order

  1. Confirm the lot's district (R-1 or R-2) with the Village Building Department and check the lot size, width and home size minimums5.
  2. Check whether the lot lies in a flood hazard area, which brings the village's flood damage prevention rules into the review12.
  3. Apply for building permits with the Village Building Department, not Miami-Dade County2.
  4. If the lot is not on sewer, contact the Florida Department of Health in Miami-Dade County about septic permitting16.
  5. Plan inspections with the village; the county's inspection rules describe unincorporated work only17.

What stays with Miami-Dade County, and what to check before you buy in Bal Harbour

Septic permitting and inspection, well approval and the county's utility connection rules stay with county and state offices315. For land outside the village, see the Miami-Dade County page.

Before buying, confirm the zoning district, the minimum lot and home sizes, and whether the lot is in a flood hazard area. Lots that existed before April 2026 and fall short of the minimum lot area are legal nonconforming and may still be developed5. Splitting an R-1 lot cannot create a lot under 15,000 square feet18. Vacation rentals in R-1 are allowed only under a separate village section we did not review19.

County-level figures: Miami-Dade County's typical home value is $522,60120, and its effective property tax rate is 0.8%21. Conventional drain fields rate poorly across the county's soils, so expect an engineered system22.

Watch-outs

  • Do not use Miami-Dade County's unincorporated-area building permit process for a Bal Harbour address; the village Building Department issues building permits inside village limits23.
  • We could not confirm the village's building permit thresholds, fees or owner-builder rules; ask the Village Building Department2.
  • Staying in a camper or motor home on residential property for more than four hours is deemed a nuisance4.
  • New septic systems in Miami-Dade County cannot be conventional Type 1 systems13.
