Do you need a building permit in Flagler Beach, Florida?
Yes. A building permit is required in Flagler Beach for projects to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, and the city lists cosmetic work such as carpeting, tile, cabinet replacement and residential painting as exceptions2. Florida's statewide owner-builder exemption lets an owner act as their own contractor on a one- or two-family home they will live in, but it does not remove the permit requirement, and the work must still meet the building code and zoning8. We could not confirm the city's own owner-builder procedure, so ask the city's permit staff before you plan to pull the permit yourself.
These answers are for land inside city limits. For unincorporated land outside the city, Flagler County's Central Permitting office handles building permits; see the Flagler County page9.
Who issues building permits in Flagler Beach, and how do you reach them?
The City of Flagler Beach runs its own building department, not the county. The Building Plan Reviews & Inspections Division performs plan reviews, issues building permits, and performs building inspections10. The Planning, Building & Engineering offices are at 800 S. Daytona Avenue, and the main city number is 386-517-200010. Callers can press 3 for the building department and then press 6 to schedule an inspection2.
The city's Engineering Division handles site plan review for utilities, stormwater, grading and filling, flood plain management, driveways and rights-of-way10. We could not confirm the city's building permit fee amounts or which edition of the Florida Building Code it enforces, so ask the Building Department for a current fee schedule before you budget. Florida sets the building code statewide11.
Does Flagler Beach have zoning, and what does it mean for RVs, tiny homes and home size?
Yes. Flagler Beach zones land inside city limits in Appendix A, Land Development Regulations, Article II Zoning, and no building or land may be used for any purpose other than what the district allows1. The city's planning staff review development proposals and changes of zoning10.
Minimum home size depends on the district: single-family dwellings default to at least 900 square feet, Single-Family Residential-2 needs 1,100, Single-Family Residential-3 needs 1,350 and Residential-4 needs 1,600 square feet of enclosed floor space5. In Planned Unit Developments the maximum building height is 35 feet6. We could not confirm minimum lot sizes, setbacks, lot coverage or accessory dwelling rules for the city's other districts, so ask the Planning & Architectural Reviews Division which district a parcel falls in before you buy. We also could not confirm a tiny-home rule inside the city.
Rule of thumb: the zoning district decides what you can build on a Flagler Beach lot.
Can you live in an RV on your land in Flagler Beach?
Only with a permit. Parking an RV for residential purposes anywhere in Flagler Beach requires a permit from city hall, issued only where adequate water, wastewater and solid waste facilities serve the vehicle, and zoning ordinances take precedence where they prohibit such parking4. No permit covers more than one 24-hour period except for duly qualified mobile home campgrounds4. In flood hazard areas an RV must be on site fewer than 180 consecutive days or be fully licensed and highway-ready; otherwise it must meet manufactured-home requirements4.
In practice, a lot without city-served water and wastewater is a poor candidate for RV living inside Flagler Beach. Florida's statewide RV rules for licensed parks do not answer whether you can live in an RV on your own lot12.
How do septic permits work in Flagler Beach?
Septic permits in Flagler County come from the Florida Department of Health in Flagler County, which continues to do the permitting and inspection for septic tanks even though the statewide onsite sewage program now sits within the Florida Department of Environmental Protection3. A permit is required to install, replace, repair, modify or abandon a septic system, and a site evaluation is part of the process13. For a single-family home, proof of the septic application can accompany the building permit application13.
Soils are a reason to plan early: USDA rates 0% of Flagler County soils as not limited for a conventional drain field, so expect a site evaluation and often an engineered or mound system14. We could not confirm whether a given Flagler Beach lot must connect to city sewer. Florida law requires a working septic system to connect within 365 days after written notice that a public sewer is available15, so ask the city whether sewer reaches the address before you plan a septic system. Call the health department at 386-437-735816.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
