Zoning, building permits and septic rules in Weston, Florida

Weston, Florida administers its own zoning under Chapter 124 of the city code1, and the city's Building Code Services office is the place to ask about building permits2. Septic permits in Broward County come from the Florida Department of Health in Broward County, not the city3. We could not confirm Weston's rules on RVs, tiny homes or owner-builders, so call the city before you buy.

Does Weston, Florida have zoning, and what does it mean for lot size and setbacks?

Yes. Weston administers its own zoning chapter, Chapter 124 of the city code, which sets districts, dimensional standards, accessory uses and planned development districts for land inside city limits1. The numbers depend on the district, so check yours first.

In the R1 single-family district, the minimum lot is 4,000 square feet with 25 feet of frontage, and a dwelling must be at least 1,200 square feet45. R1 setbacks are 20 feet front, 10 feet rear and 5 feet side10. In the RE estate district, the minimum lot is 10,000 square feet with 45 feet of frontage11, and setbacks are 25 feet front, 15 feet rear and 10 feet side12.

In the AE district, a single-family lot needs 35,000 square feet of net buildable area and 125 feet of street frontage13, and the home must be at least 1,000 square feet6. Buildings and structures together may cover no more than 25% of the plot14.

What else limits what you can build on a Weston lot?

Single-family lots in Weston may not exceed 60% impervious area7. Principal buildings in R1 and RE districts top out at 35 feet1516, and accessory structures in residential districts may not exceed 12 feet17.

Weston allows enclosed accessory uses such as mother-in-law quarters, but they may occupy no more than 25% of the space of the main permitted use18. That is an accessory-use allowance, not a permit for a separate rental cottage. Florida law lets a city allow separate accessory dwelling units in single-family zones, and requires an affordable-rent affidavit with the building permit application if it does19. We did not find a Weston ordinance allowing stand-alone units, so ask Planning & Zoning at9.

Do you need a building permit in Weston, and who issues it?

Weston has its own Building Code Services office, inside the Administrative Services Center at 17250 Royal Palm Boulevard, and its Planning & Zoning division can be reached at 954-385-050029. The city's permitting page directs applicants to the City of Weston's ePermit portal9.

Broward County's own Building Code Division regulates construction in unincorporated Broward County and in the cities it contracts with20. We could not confirm from Weston's code whether Weston is among those contract cities or issues all building permits itself, so treat the city's office as your first call. Florida's statewide Florida Building Code applies in every jurisdiction21.

Florida law sets review clocks for completed applications: an existing single-family home with work under $15,000 has a 5-business-day review window22.

How do septic permits work inside Weston?

Septic permits in Broward County are issued by the Florida Department of Health in Broward County, which Florida DEP lists among the counties where the local health department does the permitting3. A permit is required before you construct, repair, modify, abandon or operate a septic system23. The application needs a form, a site plan, a building floor plan and the fee, plus a site evaluation of the property24.

Conventional drain fields rate poorly across Broward County: none of its soils earn USDA's "not limited" rating25. Expect a site evaluation and possibly an engineered system if you are not on sewer.

We could not confirm which parts of Weston are on city sewer. Part of the city, the Isles at Weston planned development, is served by city water and sewer26. Ask the health department on27 whether your address needs a septic permit at all.

Can you live in an RV or tiny home in Weston?

We could not confirm Weston's rules on long-term RV living, temporary camping or tiny homes, so do not assume either is allowed. Florida's statewide RV rules cover permitted recreational vehicle parks and camps, not living in an RV on your own lot28. Ask Weston Planning & Zoning at9 before you buy.

If you want a manufactured home, Florida law requires one built off site to be allowed as of right in any district where single-family detached homes are allowed, though it must still meet building, installation and utility requirements29.

Building a home in Weston: the steps, in order

  1. Confirm your lot's zoning district with Weston Planning & Zoning, then check lot size, frontage, setbacks and lot coverage against Chapter 12419.
  2. Ask the city's Building Code Services office which permits your project needs and apply through the city's ePermit portal2.
  3. If the lot is not on city sewer, apply to the Florida Department of Health in Broward County for a septic permit and site evaluation24. A well within Broward County that is 12 inches or smaller also needs a permit from that office8.
  4. Build to the Florida Building Code and pass the required inspections30.
  5. Get the certificate of occupancy before you move in31.

What stays with Broward County, and what to check before you buy in Weston?

Broward County zoning applies only to the Broward Municipal Services District, so county zoning does not govern land inside Weston32. For land outside the city, see the Broward County page.

Septic and well permits for every Broward address come from the county health department38. Broward County's population density is about 1,632 people per square mile and the county's typical home value is about $424,2613334. Its effective property tax rate is 0.9% and the median bill is $3,610 a year3536. Typical home insurance runs about $6,148 a year37, so price that in too.

Watch-outs

  • We could not confirm Weston's building permit rules, inspection process, fees or owner-builder policy from the city code, so confirm them with2 before you rely on them.
  • Weston's minimum lot sizes depend on the district: 4,000 square feet in R1, 10,000 in RE and 35,000 square feet of net buildable area in AE41113.
  • Nonresidential farm buildings on bona fide agricultural land are exempt from the Florida Building Code and local fees under state law, but never a building meant as a dwelling38.
  • Florida law bars local governments from prohibiting vacation rentals or regulating their duration, except for rules adopted on or before June 1, 201139. We did not confirm any Weston rule, so ask9.

Answers from the rulebook for Weston

Weston’s own rules

  • Local zoningPresent

Land inside Weston city limits; the city administers its own zoning chapter (Chapter 124 Zoning)

    • Chapter 124 Zoning sets the city's zoning districts, dimensional standards, accessory uses and planned development districts for land inside city limits.
    • Chapter 124 history shows amendment by ord. 2026-01, passed 1-20-2026; no separate effective date was stated, so effective_at is left null.
“chapter 124: zoning general provisions zoning districts residential industrial, office, commercial (ioc) special districts”
  • Zoning districtsPublished

Zoning districts of Weston city, published in Chapter 124 Zoning

    • Residential districts (R1, R2, R3, R4, RE, RZ) are set out in the residential district section and the 124.47(a) dimension table; industrial, office, commercial (IOC) districts, special districts and PDDs appear in the same chapter.
    • The district-by-district text of the residential section was not opened in full; only the 124.47 table and the TOC were verified.
“chapter 124: zoning general provisions zoning districts residential industrial, office, commercial (ioc) special districts”
  • Minimum dwelling sizeDistrict specific (with conditions)

Single-family dwellings in the R1 single-family zoning district inside Weston city limits

    • The 124.47 table column is headed minimum s.f. and is read here as the minimum dwelling floor area; the table does not define the column further.
    • Platted lots recorded before January 21, 2003 are deemed to meet the minimum lot size of the applicable district (124.47(b)); that clause does not waive this floor-area column.

minimum dwelling floor area: >= 1200 sq ft

  • Minimum lot sizeDistrict specific (with conditions)

Single-family lots in the AE district (agricultural/estate district as described in 124.47(a)(1)(c)) inside Weston city limits

    • The nonresidential dimension table in 124.47(a) lists AE at a 2-acre minimum lot size; that table conflicts with the 35,000 sq ft single-family rule in 124.47(a)(1)(c)1.a. The single-family clause is recorded here; the conflict is flagged for follow-up.

net buildable area for single-family dwelling: >= 35000 sq ft (plot specifically delineated on a recorded or final-approved plat as a single lot may be used if at least 10,000 sq ft and 100 ft frontage) · minimum street frontage: >= 125 ft

    • Mechanical equipment (air conditioning, irrigation, pool equipment) may project no more than 60 inches from the building wall into a required yard; generators may encroach no more than 50% into a required rear or side yard and are prohibited within five feet of the adjacent front plane of the house (124.47(c)(1)).
    • Accessory structures in single-family lots: see 124.36(h); side and rear accessory setbacks may be reduced to 5 feet on the rear half of a non-corner lot (124.36(h)(1)).

  • Building heightDistrict specific (with conditions)

Principal buildings in the R1 single-family zoning district inside Weston city limits

    • Enclosed accessory uses may occupy no more than 25% of the space occupied by the main permitted use and must share the main structure's roof profile, materials, color and architectural style (124.36(f)).
    • This is an accessory-use allowance, not a separate dwelling-unit permit; a stand-alone second dwelling is not addressed in the sections opened.

accessory enclosed area as share of main use: <= 25 percent

“124.36(f) enclosed accessory uses, such as but not limited to cabanas, mother-in-law quarters, patios, storage sheds, and recreational structures may occupy no more than a total of 25% of the space occupied by the main permitted use”
  • Mandatory utility hookupWater and sewer (with conditions)

Parcels inside the Isles at Weston planned development district only; the city provides water and sewer service to the project
