Does West Melbourne, Florida have zoning, and what does it mean for lot size and setbacks?

Yes. West Melbourne adopts its own zoning in Chapter 98 of the city code, which sets residential districts including R-1AAA, R-1AA, R-1A, R-A, TR-2, TRC-1 and RV-P1. Brevard County's zoning map covers only unincorporated Brevard County, so it does not decide what you can build inside the city13. The numbers change by district, so find your parcel's district first with the Planning & Economic Development Department14.

R-A (residential agricultural): one-acre minimum lot and 150 feet of width6; front setback 50 feet and interior side 20 feet15; lots may be covered up to 25 percent16; height capped at 35 feet17.

R-1AAA: 12,000 square feet and 100 feet of width18; front setback 25 feet and interior side 10 feet19; buildings may cover 40 percent20.

R-1AA: 10,000 square feet and 85 feet of width21; front 25 feet and interior side 10 feet22.

R-1A: 7,500 square feet and 75 feet of width5; front 25 feet and interior side 7.5 feet23.

How big does a house have to be in West Melbourne?

Minimum living area depends on the district. West Melbourne requires 900 square feet in R-A7, 900 square feet in R-1A8, 1,250 square feet in R-1AA24 and 1,500 square feet in R-1AAA9. A single-family mobile home in the TR-2 district needs at least 500 square feet of floor area11. Tiny homes under those figures are not addressed in the city rules we found, so ask the Planning & Economic Development Department before assuming one fits a given district14.

Do you need a building permit in West Melbourne, and who issues it?

Inside West Melbourne city limits, building permit applications go to the city's Building Department, which reviews plans against city ordinances and the Florida Building Code2. Brevard County's building permit office serves only unincorporated Brevard County, so the county counter is the wrong stop for a city address25. Florida's statewide building code applies in the city without local adoption26.

Payment is due after plans examination, with no upfront fees at submission2. The Building Department also runs inspections and supports owner-builder permits, such as re-roofs2. Florida's owner-builder rule lets an owner act as their own contractor on a one- or two-family home they will live in and not sell or lease27; West Melbourne's own owner-builder procedure for new homes is one we could not confirm, so ask the Building Department. Call 321-837-7776 or email [email protected]2.

How do septic permits work inside West Melbourne?

Septic permits for every address in Brevard County, including addresses inside West Melbourne, are handled by the Florida Department of Health in Brevard County3. Applications and inspection requests go by email to [email protected]28.

The city adds its own limit: West Melbourne permits on-site systems only on an interim or temporary basis, until sewer capacity is available to connect to the city system4. Florida law adds that an owner with a working septic system must connect within 365 days after written notice that sewer is available29. Soils matter too: in Brevard County, 0% of soils rate as not limited for a conventional drain field, so expect a site evaluation and often an engineered system30. In practice, a lot with no sewer line may be hard to build on, so confirm sewer availability with the city before buying.

Can you live in an RV or tiny home in West Melbourne?

West Melbourne's code addresses RV living only in its RV-P planned development district, where sites need at least 1,750 square feet and density tops out at eight sites per gross acre10. The city rules we found do not say whether you may live in an RV on a single-family lot10. Brevard County bars residential use of an RV under its code enforcement rules, but that FAQ does not speak to city regulations31. Ask the Planning & Economic Development Department at 321-837-7778 before parking an RV to live in14.

For tiny homes, we could not confirm a West Melbourne rule. Brevard County's tiny-house-on-wheels permit applies to unincorporated land32.

Building a home in West Melbourne: the steps, in order

  1. Confirm the parcel's zoning district and its lot, setback and minimum home size rules with the Planning & Economic Development Department14.
  2. Ask the city whether sewer is available at the lot; if not, any septic system is temporary4.
  3. If you will use septic, apply to the Florida Department of Health in Brevard County3; a well needs a permit through the same office or the St. Johns River Water Management District33.
  4. Submit plans to the West Melbourne Building Department; fees are due after plan review2.
  5. Schedule inspections through the Building Department, which also issues the certificate of occupancy under Florida's building code process34.

What stays with Brevard County, and what to check before you buy in West Melbourne

Septic and well permits stay with the Florida Department of Health in Brevard County333. For land outside the city, use the Brevard County page, because the county's building and zoning rules cover only unincorporated land13.

Before buying, check three things. First, sewer availability, since on-site systems are temporary only4. Second, flood-area elevation rules, which the city's mobile home standards reference in Chapter 7111. Third, taxes and insurance: Brevard County's effective property tax rate is 0.7%12, the median property tax bill is $2,139 a year35, and a typical home insurance premium is $3,277 a year36.

Watch-outs

  • Parcels next to a Melbourne-Tillman water canal may need a separate access permit for fences and pools, according to the city's Building Department2.
  • We could not confirm West Melbourne's rules for accessory dwelling units, short-term rentals, driveways, or agricultural buildings; ask the Planning & Economic Development Department before relying on them14.
  • Brevard County's rules for RVs, tiny homes and permit fees apply to unincorporated land only, so do not apply them to a West Melbourne address25.
