Does Melbourne Beach have zoning, and what does it mean for RVs, lot size and setbacks?

Yes. The Town of Melbourne Beach administers its own zoning ordinance, Chapter 7A of its Land Development Code1. Zoning here is the town's call, not Brevard County's, whose zoning map covers only unincorporated land11. The town publishes its districts, from 1-RS through 9-I6.

In the 1-RS single-family district, the minimum lot area is 12,000 square feet7, the front setback is 25 feet from the lot line12, the principal structure may cover 30% of the lot13, and buildings top out at 28 feet9. A single-family home in 1-RS needs at least 1,800 square feet of living area, excluding garages and porches8. Other districts differ, so confirm your parcel's district with the Zoning Official14.

Do you need a building permit in Melbourne Beach, and who issues it?

Inside town limits, the Town's Building Official handles building permits, along with flood control, coastal construction and coastal setback rules2. Florida law requires a permit from the appropriate enforcing agency before building, altering or demolishing a building15, and the town has adopted the Florida Building Code and Florida Residential Building Code by reference5. Brevard County's building permit office serves unincorporated land, not addresses inside the town16.

The fee schedule is set by the Town Commission by resolution rather than printed in the code10, so ask the Building Department for current fees. We could not confirm whether the town has its own owner-builder process; Florida law lets an owner act as their own contractor on a one- or two-family home for their own use, but the owner must personally appear and sign the permit application17.

How do septic permits work inside Melbourne Beach?

The town does not issue septic permits. Its code requires that building permit applications needing sanitary facilities carry approval from the county health department or the county utilities department for sanitary connections3. The Florida Department of Health in Brevard County handles septic permitting and inspection18. Florida requires a site evaluation and a construction permit where no septic system exists19.

Soils matter here: the USDA rates 0% of Brevard County's soils as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system20. We could not confirm whether a given lot in Melbourne Beach must connect to public sewer; ask the Town Building Department and the county health department before you buy21.

Can you live in an RV on your land in Melbourne Beach?

Not on a vacant lot. The town's code states that no trailer, boat, recreational vehicle or camper, regardless of size, may be used as a place to live, temporarily or permanently, on any vacant lot4. On residential lots, any trailer, boat or RV longer than 45 feet may not be parked, stored or placed except for active loading and delivery22. We could not confirm the town's rules on tiny homes, manufactured homes or accessory dwellings, so ask the Zoning Official before planning one14.

Brevard County's tiny-house-on-wheels permit applies only to unincorporated Brevard County, not to land inside the town23.

Building a home in Melbourne Beach: the steps, in order

  1. Confirm the parcel's zoning district and dimensional limits with the Zoning Official14.
  2. Check flood zone requirements: in non-coastal-A flood hazard areas the lowest floor must be at least 1.5 feet above base flood elevation24.
  3. If the lot is oceanfront, check the coastal setback line under chapter 5A12.
  4. Get septic or sanitary-connection approval from the county health department3.
  5. Apply to the Town Building Department for the building permit2.
  6. Buildings over two stories or 28 feet in height are inspected by the structural engineer25.

What stays with Brevard County, and what to check before you buy

Septic and wells stay with the county health department26, and land outside town limits falls under Brevard County's rules; see the Brevard County page for unincorporated land. Brevard County's effective property tax rate is 0.7%27. Lots platted before September 26, 1972 follow grandfathering rules in the town code7. A lot must also be adjacent to a public street or have access to one28.

Watch-outs

  • Brevard County's building and zoning pages cover unincorporated land only; inside Melbourne Beach, use the town's own offices2.
  • Oceanfront lots are subject to the coastal setback line under chapter 5A12.
  • We could not confirm the town's rules on certificates of occupancy, accessory dwellings, tiny homes or vacation rentals; call Town Hall before you buy14.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
