Brevard County, Florida

Zoning, building permits and septic rules in Indian Harbour Beach, Florida

Indian Harbour Beach, Florida zones its own land and runs its own Building Department, so a home inside city limits is permitted by the city, not by Brevard County12. Septic permits for onsite systems anywhere in Brevard County come from the Florida Department of Health in Brevard County3. Owners who act as their own contractors must apply in person2.

Does Indian Harbour Beach have zoning, and what does it mean for lot size and setbacks?

Yes. Indian Harbour Beach, Florida applies its own zoning code inside city limits, and the code names the R-1AAA, R-1AA, R-1A, R-2, R-3, PUD, P-1, P-2, C-P, B-1 and M-1 districts4. The R-1AAA district is meant for low-density, single-family homes1.

Minimums depend on the district. R-1AAA requires lots of at least 12,000 sq ft5 and homes of at least 2,000 sq ft6. R-1AA requires 8,500 sq ft lots8 and 1,550 sq ft homes9. R-1A requires 7,500 sq ft lots10 and 1,250 sq ft for a one- or two-bedroom home11. All three districts cap height at 35 ft12.

In R-1AA the rear setback is 25 ft, or 35 ft when the lot abuts a waterway or canal, and interior side setbacks are 10 ft13. R-1A uses the same rear setbacks with 7.5 ft interior sides14. In single-family districts, no more than 35 percent of a required front or rear yard may be paved or otherwise impervious15.

Do you need a building permit in Indian Harbour Beach, and who issues it?

Inside city limits, the City of Indian Harbour Beach Building Department issues building permits, not Brevard County. The department's Building Official enforces building codes, conducts inspections and issues permits and certificates of occupancy2. Construction statewide follows the Florida Building Code16.

Brevard County's own building permits cover only unincorporated areas of the county17, so a property inside the city should not be sent to the county permit counter in Viera. We could not confirm the city's exact permit thresholds or fee amounts; the Building Department publishes a permit fee chart and residential permit checklists on its page, and its phone number is below.

Owners who act as their own contractors must appear in person to submit the permit application2. Call the Building Department to learn which forms to bring and to book the appointment.

How do septic permits work in Indian Harbour Beach?

Septic permits are a Florida Department of Health matter, not a city one. The Florida Department of Health in Brevard County handles septic permitting and inspection across Brevard County3. To apply or to schedule an inspection, email the department using the address listed below18. We could not confirm whether a given Indian Harbour Beach lot is on public sewer or needs a septic system; ask the Building Department, which will also want septic approval documents if the home uses one.

If a septic system is the plan, expect more than a simple drain field. Conventional drain fields rate poorly across Brevard County's soils, so a site evaluation and often an engineered or mound system are likely19. Operating permits apply to aerobic treatment units and commercial systems20. Wells under six inches in diameter are generally permitted through the same health department21.

Can you live in an RV or tiny home in Indian Harbour Beach?

Probably not on a residential lot as a home. The city's code allows a recreational vehicle, trailer or watercraft on a residential lot only to the rear of the front principal building line, and the vehicle must carry current registration7. The same rule bars them from public and private rights-of-way in residential districts7. Temporary construction mobile structures are allowed for up to 10 days after completion7.

That code section addresses parking and storage; we could not confirm whether sleeping in an RV is allowed or banned. Ask the Building Department before planning to live in one during construction.

Tiny homes: the residential districts we reviewed list single-family dwellings that meet a minimum living area, and we found no tiny-home provision. Brevard County's tiny-house-on-wheels permit applies only in unincorporated Brevard County22, so it does not govern a lot inside the city.

Can you build a second dwelling or guest house in Indian Harbour Beach?

In the residential districts we reviewed, the code lists single-family dwellings and customary accessory structures, with no separate accessory dwelling23. The commercial B-1 General Commercial district, and similarly C-P, allows one dwelling unit inside or on the top floor of a principal structure when the owner or proprietor lives there23. That commercial dwelling needs a parcel of at least 1 acre, at least 600 sq ft of floor area and two additional parking spaces23.

For a guest house or in-law suite on a residential lot, ask the Building Department how the zoning code treats it before you buy.

Building a home in Indian Harbour Beach: the steps, in order

  1. Confirm the lot's zoning district, then check its minimum lot size, home size, setbacks and height in the city code4.
  2. Ask the Building Department whether the lot is served by public sewer; if it needs a septic system, apply to the Florida Department of Health in Brevard County3.
  3. Prepare the building permit application and the city's checklists; an owner-builder must appear in person2.
  4. Submit to the Building Department, which reviews plans and issues the permit2.
  5. Schedule inspections with the Building Official during construction2.
  6. Finish with the certificate of occupancy, which the Building Official issues2.

What stays with Brevard County, and what to check before you buy

Septic and well permits stay with the Florida Department of Health in Brevard County, even for addresses inside the city321. For land outside city limits, the county's rules differ; see the Brevard County page.

County-level numbers give context: Brevard County's effective property tax rate is 0.7 percent24, and the typical home insurance premium is about $3,277 a year25. Before buying, ask the Building Department about flood zones, since the city links a FEMA flood map from its page, and confirm the lot's zoning district and any waterway setback.

Watch-outs

  • We could not confirm the city's building permit thresholds, fee amounts or whether a given lot is on public sewer; call the City of Indian Harbour Beach Building Department at 321.773.31812.
  • Brevard County's building, zoning and tiny-house rules apply only to unincorporated land, not inside city limits17.
  • The city's RV rule covers parking and storage; we could not confirm whether living in an RV is allowed7.
