Does Hawthorne, Florida have zoning, and what does it mean for lot size and setbacks?

Hawthorne has zoning of its own for land inside city limits1. The A agricultural district is meant for areas of mainly agricultural and residential uses1, and the A category contains a single zone district, A7.

In the A district, a single-family dwelling, mobile home or group living facility needs a minimum lot area of 5 acres and a minimum lot width of 175 feet3. Structures must sit at least 30 feet from the front lot line and 25 feet from each side and rear line4. Buildings may cover no more than 20 percent of the lot8, and no structure may exceed 35 feet, with exceptions listed in section 4.2 of the code5. A 35-foot natural buffer also applies along wetlands and perennial streams, lakes and ponds, and structures are prohibited in it except permitted docks, walkways and piers4.

We read only the A district. Hawthorne's residential and commercial districts have different standards that we could not confirm, so look up the zoning of the exact parcel with City Hall before you buy7.

Do you need a building permit in Hawthorne, and who issues it?

We could not confirm who issues building permits inside Hawthorne city limits. Ask Hawthorne City Hall whether the city or the Alachua County Building Division handles them for your parcel.

For unincorporated Alachua County, building permits are required for most construction, enlargement, alteration or movement of a building and for electrical, gas, mechanical and plumbing work9. Alachua County's Building Division fee schedule covers permits in the unincorporated areas and in several municipalities10, but we have not confirmed that Hawthorne is one of them.

Whatever office issues the permit, the Florida Building Code is the statewide base code11. A driveway or curb break inside Hawthorne needs a city permit before construction6.

How do septic permits work inside Hawthorne?

Septic permits for Alachua County, including addresses inside Hawthorne, are handled by the Alachua County Health Department, which takes applications for new installations, repairs and modifications212. The Florida Department of Environmental Protection enforces the state's septic laws and rules13.

Expect a site evaluation. Only about 15 percent of Alachua County soils rate as not limited for a conventional drain field, so many lots need an engineered system14.

We could not confirm whether Hawthorne requires connection to city sewer or water inside city limits. Ask City Hall before you assume a septic system will be allowed.

Can you live in an RV or tiny home in Hawthorne?

We could not confirm a rule on living in an RV or tiny home on a private lot inside Hawthorne. The A district allows RV parks only by special exception, and we found no rule on RV living on an individual lot1. Ask Hawthorne City Hall's zoning staff before you place one.

The rules the Alachua County ULDC sets for RVs and tiny homes apply to unincorporated land, not to the city15.

Building a home in Hawthorne: the steps, in order

  1. Ask Hawthorne City Hall which zoning district your parcel is in and who issues building permits for it7.
  2. Check that the lot meets the district's minimum size; in the A district that is 5 acres and 175 feet of width3.
  3. Contact the Alachua County Health Department for a septic site evaluation and permit212.
  4. Check the flood map: in a regulatory floodway the city allows no development unless an encroachment analysis shows no increase in base flood elevation16.
  5. Get the city driveway permit before you build the driveway or curb break6.
  6. Apply for the building permit with the office the city names, and schedule the inspections it requires.

What stays with Alachua County, and what to check before you buy

The county's zoning code governs new development in unincorporated Alachua County, not land inside Hawthorne17. For land outside city limits, see the Alachua County page.

Septic permits come from the county health department2. Wells in the St. Johns River Water Management District portion of the county need a permit if they are at least 6 inches across, and smaller wells need a completion report and county registration18; the Suwannee River district requires a permit for any well19. Which district covers a Hawthorne parcel is something we could not confirm.

Alachua County's effective property tax rate is about 1 percent20.

Watch-outs

  • The Alachua County Building Division issues permits in the unincorporated areas and several municipalities10, but we could not confirm whether it or Hawthorne issues building permits inside city limits, so ask Hawthorne City Hall before you pay for plans.
  • Only the A agricultural district was reviewed, and the 5-acre lot minimum there does not carry over to Hawthorne's other districts3.
  • Development in a regulatory floodway inside Hawthorne is blocked unless an encroachment analysis shows no increase in base flood elevation16.

Unanswered questions are usually a sign that Hawthorne publishes no rule on the point, not that none exists. Alachua County’s page lists the county offices to call.
