Rio Grande County, Colorado

Zoning, building permits and septic rules in Monte Vista, Colorado

Monte Vista, Colorado issues its own building permits: city staff in the Planning & Community Development Department process them, and Rio Grande County no longer handles them for city properties1. The city also sets its own zoning under Chapter 12 of its municipal code2. Septic permits are a separate track; in Rio Grande County they come from the county building department3.

Do you need a building permit in Monte Vista, Colorado?

Yes. Building permits for the City of Monte Vista are processed by city staff in the Planning & Community Development Department, and Rio Grande County no longer handles building permits for Monte Vista properties1. The county building department's permit system covers unincorporated land only12.

The city's process has a few gates in a fixed order. A contractor license from the City Clerk's office is required for contractors and subcontractors before a building permit issues, and an approved site permit must come first1. Half of the permit fee is due at application1. Staff confirm the application is complete within 10 business days and send written notice of the decision within 16 working days of a complete application1. The city lists the 2018 International codes (building, residential, mechanical, energy, fire, property maintenance and existing building) among its adopted codes1.

Who issues building permits in Monte Vista, and how do you reach them?

The City of Monte Vista Planning & Community Development Department issues building permits and site permits for city properties; it is at 95 W 1st Ave, Monte Vista, CO 81144, and the phone is 719-852-82881. Do not go to the Rio Grande County counter for a building permit inside the city1.

Plumbing, gas and electrical permits and inspections in Rio Grande County are performed by the State of Colorado13. Whether that arrangement also covers work inside city limits we could not confirm; ask the city department before you hire trades.

Does Monte Vista have zoning, and what does it mean for RVs, tiny homes and lot size?

Monte Vista has its own zoning, codified in Chapter 12 of the municipal code with districts including RU, RE, RL, RM, RH and MSW2. The rules differ by district, so check which one a parcel is in before you buy.

In the RL (Residential Low-Density) district, a one-unit dwelling needs a lot of at least 7,000 square feet (8,000 for a corner lot), a 25-foot front setback, 5-foot interior side setbacks, and at least 900 square feet of floor area; lot coverage tops out at 30% and height at 35 feet141591617. In the RU (Rural) district the lot minimum is 5 acres with a 150-foot width, the front setback is 30 feet, interior side setbacks are 20 feet, and a home needs at least 1,200 square feet181910. RU allows 20% lot coverage and 45-foot buildings2021.

Manufactured homes are a permitted use in RU, Mfg-H and MSW, and Class A homes can be approved by special review in RL and RM7. A detached accessory dwelling unit on a permanent foundation is a special review use8. Tiny-home rules inside the city we could not confirm; Colorado's Division of Housing approves tiny homes for long-term living subject to local zoning22, so ask the city planning department.

Can you live in an RV in Monte Vista?

Only briefly outside a campground. A camping unit or recreational vehicle may not be occupied for more than 30 days in any one year while parked or stored in the city, except in a mobile home park or campground authorized under Article 5 of Chapter 126. A unit counts as stored if it has not moved for seven consecutive days, and one parked in a required front setback must sit on a constructed driveway6.

That means living in an RV on a vacant city lot while you build is not an option beyond the 30-day cap6. Outside city limits, Rio Grande County has its own camping permit process through its Land Use Department23.

How do septic permits and sewer work in Monte Vista?

Inside the city, sewer comes first. Property used for human occupancy that abuts a street or alley with a city collection line must connect to the sewer within 90 days of official notice, when the line is within 400 feet of the property line; the city manager can waive this with Rio Grande County health department approval5.

Where no sewer is available, Colorado requires a permit for any on-site wastewater system before it is built, and a building permit cannot issue for a structure without sewer service until the local public health agency issues the septic permit24. In Rio Grande County those permits are issued by the Rio Grande County Building Department3. Whether that applies to a lot inside city limits we could not confirm; ask the city department first.

Building a home in Monte Vista: the steps, in order

  1. Confirm the lot's zoning district under Chapter 12 and check lot size, setbacks and minimum floor area2.
  2. Ask the city whether the lot has sewer within 400 feet; if not, contact the Rio Grande County Building Department about a septic permit53.
  3. Make sure every contractor and subcontractor holds a City of Monte Vista contractor license from the City Clerk's office1.
  4. Get an approved site permit from the Planning & Community Development Department1.
  5. Submit the building permit application with plans, a site plan and the first 50% of the fee1.
  6. Post the permit on site once issued and keep approved plans there for inspections1.

What stays with Rio Grande County, and what to check before you buy

The county's building rules apply to unincorporated land, not city lots, and the county's zoning and land-use rules are separate from the city's12. For land outside city limits, see the Rio Grande County page. Septic permits, state well permits and floodplain development standards apply regardless of the city's zoning1125.

County-level context: Rio Grande County's effective property tax rate is 0.4%26, and the county gets about 14.4 inches of precipitation a year27. A driveway onto a state highway needs a state access permit28.

Watch-outs

  • A building permit request sent to the county for a city address will be redirected, since Rio Grande County no longer handles building permits for Monte Vista properties1.
  • Fees are set by City Council resolution, so ask the city for the current fee schedule before budgeting1.
