San Diego County, California

Zoning, building permits and land rules in National City, California

National City, California adopts its own zoning code (Title 18) and has its own Building Division at 1243 National City Blvd, so city limits are not the county's planning counter.12 Residential lots here start at 2,500 square feet, and RVs cannot be hooked up to utilities outside a permitted park.34 We could not confirm septic rules inside the city; ask San Diego County's environmental health office.5

Does National City, California have zoning, and what does it mean for lots and setbacks?

Yes. National City, California has zoning: Title 18 is the city's own land use code, and it covers all land inside city limits.1 The city publishes allowable uses by zoning district.1

The residential districts are RS-1 to RS-4 and RM-1 to RM-3, and the rules differ by district.10 In RS-1, the minimum lot is 10,000 square feet; RS-2, RS-3 and the RM districts need 5,000 square feet; RS-4 needs 2,500 square feet.3 Front setbacks for a primary structure are 20 feet in RS-1 and RS-2, with rear setbacks of 25 feet and interior side setbacks of 5 feet in those two districts.7 Height tops out at 35 feet in RS-1 through RS-4.11 Lot coverage is 75 percent in most residential districts, and RS-4 has no maximum.12

The residential table lists no agricultural or rural district, so this is a city-lot market, not acreage.3 Commercial and industrial zones were not reviewed; ask National City Planning at (619) 336-4310.13

Do you need a building permit in National City, and who issues it?

The National City Building Division, at 1243 National City Blvd, is the city's building office, and it takes calls at (619) 336-4210.2 Inside city limits, this is the office to call, not San Diego County's Planning & Development Services, whose building permits cover unincorporated land only.14

We could not confirm the city's general building permit rule or the code edition it enforces, so call the Building Division before you start.2 California law says a building or structure may not be erected, altered, moved or demolished without a permit.15 Moving a building is covered by the city's code: National City will not issue a building moving permit for a manufactured home more than 10 years past its manufacture date.6

Owner-builders: California's owner-builder exemption relieves an owner from contractor licensing, and does not by itself exempt the work from permits or inspections.9

How do septic permits work in National City?

We could not confirm septic rules inside National City limits. California requires a permit for every new or replacement septic system, issued by the local jurisdiction or the regional water board.16 San Diego County's onsite wastewater program covers unincorporated areas and municipalities that delegated authority to the County.17

Whether a National City address falls under that delegation is unconfirmed, so ask the County's DEHQ Land and Water Quality Division at (858) 565-5173 before planning any septic system or well.5 California well permits come from local environmental health agencies or water districts.18

Can you live in an RV or tiny home in National City?

Not in the way rural buyers hope. National City makes it unlawful to occupy an RV more than ten consecutive minutes between 2:00 a.m. and 6:00 a.m. except in a permitted mobile home park or campground.4 Hooking an RV to gas, water, sewer, telephone or cable service is unlawful outside a lawfully permitted mobile home park or campground.4 Stored RVs must be owned by and registered to an occupant of a legal dwelling on the parcel.4

By contrast, accessory dwelling units are allowed on lots in residential zones: at least 150 square feet, up to 1,200 square feet if detached, with 4-foot side and rear setbacks and a 15-foot front setback.8 The city reviews ADU applications ministerially within 60 days of a complete application.8 We found no tiny-home provision in the city code sections reviewed; ask the Building Division.2

Building a home in National City: the steps, in order

  1. Confirm your parcel's zoning district and its lot size, setbacks and height limits with National City Planning at (619) 336-4310.1310
  2. Ask the Building Division at (619) 336-4210 which permits and plan review your project needs; the Division is open Monday to Thursday and closed Fridays.2
  3. If you will build yourself, remember the owner-builder exemption covers contractor licensing only.9
  4. Ask San Diego County's DEHQ whether any septic or well permit applies at your address.5
  5. If a driveway touches a state highway, a Caltrans encroachment permit is required.19
