Do you need a building permit in San Clemente, California?
Building work inside San Clemente goes through the city: Building Services provides plan checking, permitting and inspection services for new construction, additions, renovations, alterations and remodels.1 California law says no building or structure may be erected, enlarged, altered, repaired, moved or demolished until a permit has first been obtained.8
Orange County's rule that a building permit is required applies to unincorporated areas, so a San Clemente address is handled by the city instead.9
Who issues building permits in San Clemente, and how do you reach them?
The City of San Clemente's Building Services office is at 910 Calle Negocio and takes calls at 949-361-6100.1 Planning permits have their own line at 949-361-6197.10
Do not start at the OC Development Services counter in Santa Ana: its building and planning offices serve unincorporated Orange County, not city addresses.9
Does San Clemente have zoning, and what does it mean for lot size and setbacks?
San Clemente has its own zoning: Title 17 of the city code contains residential zoning standards and special residential overlays.2 Rules differ by district. In the RL-1 overlay, the minimum lot area is 7,200 square feet, the minimum lot width is 70 feet, and the interior-side yard setback is 6 feet; other standards follow the underlying RL zone.511
For a specific parcel, ask City Planning which district and overlay apply.10 State SB 9 projects in single-family zones are limited to side and rear setbacks of no more than four feet.12
How do septic permits and wells work in San Clemente?
We could not confirm who issues septic permits inside San Clemente city limits. California requires a permit for every new or replacement septic system, issued by the local jurisdiction or the Regional Water Board.6 Ask City Building Services first.1
Well permits are a county health matter in most Orange County cities: the Orange County Health Officer enforces the well ordinance in unincorporated areas and twenty-nine of thirty-four cities, so confirm with Environmental Health whether San Clemente is one of them.13 Only about 9.4% of county soils rate without severe limits for a conventional drain field.14
Can you live in an RV, tiny home or accessory dwelling in San Clemente?
We could not confirm San Clemente's rule on living in an RV on a private lot. California says RVs are not intended as permanent dwellings.15 The city does make camping unlawful on city-owned land, in private open space where its code prohibits camping, and in designated fire-risk areas.7
State law requires accessory dwelling unit applications to be approved ministerially, without discretionary review or a hearing.16 Ask City Planning about city ADU standards.10
Building a home in San Clemente: the steps, in order
- Confirm the zoning district, overlay and setbacks with City Planning.10
- Settle sewer or septic and any well with the right agency before you design.13
- Apply for the building permit through City Building Services; homeowners doing their own work use the owner-builder verification form.1
- Pass inspections, then get final approval.1
What should you check before you buy land in San Clemente?
Owner-builders assume full responsibility for all phases of the project, must pull all building permits, and must pass codes and inspections.17 Local use zone and setback requirements remain with the city.17
Orange County's effective property tax rate is 0.7%.18
Watch-outs
- Orange County's unincorporated-area rules, including its ban on living in a parked RV, do not automatically apply inside San Clemente; ask City Planning what the city allows.10
- We could not confirm septic rules, tiny-home rules, minimum dwelling size or short-term rental rules inside San Clemente city limits.1

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
