Zoning, building permits and septic rules in Soledad, California

The City of Soledad, in Monterey County, California, adopts its own zoning code for land inside city limits1. The city's code sets R-1 lot size, setback and height standards and allows accessory dwelling units23. We could not confirm from the city code which office issues building permits or handles septic inside Soledad, so confirm both with the city before you buy.

Does Soledad have zoning, and what does it mean for lots, setbacks and height?

Yes. The City of Soledad applies its own municipal code zoning chapters to land inside city limits1. Monterey County's zoning applies only to unincorporated land, so the county's rules do not govern a parcel inside Soledad7.

Dimensional rules differ by district. In the R-1 single-family district, each lot needs a minimum net area of 6,000 square feet2. Lot coverage by buildings may not exceed 40 percent of the lot8. A main building may be at most two stories and 30 feet tall, and accessory buildings are limited to one story and 14 feet4. R-1 lots need a front yard of at least 20 feet, a side yard of at least 5 feet and a rear yard of at least 10 feet, with exceptions for lot depth, corner lots and open space9. Every R-1 lot needs vehicle access from a dedicated and improved street or recognized alley to its required off-street parking10.

Do you need a building permit in Soledad, and who issues it?

We could not confirm from Soledad's adopted code which office issues building permits inside city limits, so ask the City of Soledad's building and planning counters at City Hall before you start work. Monterey County's Housing & Community Development office issues construction permits for unincorporated land only, and sending a city address there is the wrong first call11.

Whichever office issues the permit, California's 2025 Building Standards Code applies to buildings with a permit application date on or after January 1, 202612. Inside Soledad, development in a flood hazard area needs a floodplain development permit and is subject to inspection6.

How do septic permits work inside Soledad?

We could not confirm who regulates septic systems inside Soledad city limits. Monterey County's septic chapter applies in unincorporated Monterey County and reaches a city only by written agreement between the county and that city13. Ask the city whether the lot connects to city sewer, and ask the Monterey County Environmental Health Bureau whether any septic or well rule applies to the address14.

County soil data suggests caution on any lot that is not sewered: only a small share of Monterey County's soils rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system15.

Can you live in an RV or tiny home in Soledad?

We could not confirm Soledad's general rule on living in an RV or a tiny home on a residential lot, so ask the city's planning counter before you buy. The city code does address RVs in flood hazard areas: they must be placed for less than 180 consecutive days or be fully licensed and ready for highway use5.

California's statewide guidance says RVs are not intended as permanent dwellings and generally may be occupied only in mobilehome or special occupancy parks unless a local ordinance allows otherwise16. Accessory dwelling units are the clearer route to a second home: Soledad allows them in districts zoned for single-family or multifamily use3.

Can you add an accessory dwelling unit in Soledad?

Yes, in districts that allow single-family or multifamily homes. A detached ADU may have up to 1,200 square feet of living area, and the city approves ADUs ministerially within 60 days of a completed application3. A junior ADU requires owner occupancy and a deed restriction, and the ADU cannot receive a certificate of occupancy before the primary residence does3.

What stays with Monterey County, and what should you check before you buy?

Land outside Soledad city limits falls under Monterey County's rules, which differ from the city's; see the Monterey County page for the unincorporated-area answers. Confirm the parcel is inside city limits before relying on anything above.

Check the flood map: inside the city, subdivisions and manufactured homes in flood hazard areas face added review and installation rules1718. Owner-builders should know that California's contractor-license exemption does not waive building permits, inspections, zoning or septic approvals19. Monterey County's effective property tax rate is about 0.7%20.

Watch-outs

  • Soledad's own building-permit, inspection and septic authority is unconfirmed, so ask the Monterey County Environmental Health Bureau about septic and the City of Soledad at City Hall about building permits before you pay for plans14.
  • Monterey County's zoning, septic and RV rules cover unincorporated land only; do not rely on county rules for a lot inside Soledad7.
  • The R-1 numbers above apply only to R-1 lots; other Soledad districts have their own standards2.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible. Unanswered questions are usually a sign that Soledad publishes no rule on the point, not that none exists. Monterey County’s page lists the county offices to call.
