Does Oakland, California have zoning, and what does it mean for lot size and setbacks?

Oakland has its own zoning, administered by the City of Oakland's Planning & Building Department, whose zoning hotline is (510) 238-39112. Alameda County's zoning covers only unincorporated communities, so the county's zoning districts do not apply inside Oakland city limits8.

Standards vary by zone. In the RD Detached Unit Residential Zone, the Planning Code sets a minimum lot area of 2,000 sq ft and a minimum mean lot width of 20 ft9. For RD lots of 3,000 sq ft or more, the minimum front setback is 15 ft (5 ft where the street-to-setback gradient exceeds 20%), the interior and street side setbacks are 4 ft, and the rear setback is 10 ft10. Primary buildings on RD lots with a footprint slope of 20% or less may have walls up to 30 ft, pitched roofs up to 35 ft, and accessory structures up to 15 ft11.

Those figures cover only the RD zone. We did not confirm standards for Oakland's other residential zones, lot coverage or minimum dwelling size, so ask the zoning hotline for your parcel's district.

Do you need a building permit in Oakland, and who issues it?

Oakland's Planning & Building Department issues building permits for projects inside city limits, through the one-stop permit center at 250 Frank H. Ogawa Plaza; the building counter's phone number is (510) 238-38911. Alameda County's permit requirements for unincorporated land do not govern a lot inside Oakland.

We did not confirm the text of Oakland's building code adoption, inspection or certificate-of-occupancy rules, so ask the building counter what your project needs. California law adds one point for owner-builders: the owner who signs a building permit application assumes responsibility for the project, must pull all building permits, and must pass codes and building inspections7. The state owner-builder exemption covers contractor licensing, not permits12.

How do septic permits work inside Oakland?

The Alameda County Department of Environmental Health regulates septic systems, formally called onsite wastewater treatment systems, throughout the county's unincorporated areas and also administers those rules in various cities3. Alameda County's own program records all cities except Berkeley as having designated the County Health Officer as their health officer13.

We could not confirm Oakland-specific septic rules, or whether a given city lot is already served by a sewer connection, so call the Department of Environmental Health at (510) 618-3452 before you plan any onsite system14. Septic permits for new, replacement and major-repair systems are required under the county program15. County soil data rate only 4.1% of Alameda County soils as not limited for a conventional drain field, so expect a site evaluation if sewer is unavailable16.

Can you live in an RV or tiny home in Oakland?

California's default rule is that recreational vehicles are not intended as permanent dwellings and generally may be occupied only in mobilehome parks or special occupancy parks, unless a local ordinance allows otherwise5. We did not confirm an Oakland ordinance on RV living or temporary camping. The city's planning and building site lists an "RV pilot program for vacant properties", so ask the zoning hotline at (510) 238-3911 whether it applies to your parcel2.

A tiny home may be occupied in California if it is approved as a recognized type, such as a manufactured home, a California Residential Code home, factory-built housing, an RV, a park trailer or a camping cabin, and sits where that type is allowed6. A tiny home that fits none of those classifications is a noncomplying structure whose occupancy is illegal6. Oakland's own rules for where each type may go were not confirmed.

Building a home in Oakland: the steps, in order

  1. Call the zoning hotline at (510) 238-3911 to confirm your parcel's zoning district, setbacks and height limit2.
  2. Ask the building counter at (510) 238-3891 which building permits your project needs, and apply through the one-stop permit center1.
  3. If the lot has no sewer connection, contact the Alameda County Department of Environmental Health at (510) 618-3452 about septic permits14.
  4. If you plan a well, apply to the Alameda County Public Works Agency Well Standards Program at 510-670-663317. The county fee is $660 per well, and applications generally go in at least 10 work days before drilling starts4.
  5. If you act as your own builder, sign the owner-builder declaration and expect inspections on your project7.

Watch-outs

  • Alameda County's building and zoning rules apply only to unincorporated land, so county permit pages can send you to the wrong office for a lot inside Oakland8.
  • The lot-size, setback and height figures above come from the RD zone only; confirm your parcel's district with the zoning hotline at (510) 238-39112.
  • We could not confirm Oakland's septic, floodplain, driveway access or short-term rental rules; call the permit center at (510) 238-38911.

Unanswered questions are usually a sign that Oakland publishes no rule on the point, not that none exists. Alameda County’s page lists the county offices to call.
