Building permits, zoning and septic rules in Orange Beach, Alabama

Building in Orange Beach, Alabama (Baldwin County) requires a Certificate of Zoning Compliance and/or a permit from the city before any structure is erected, moved, altered or enlarged1. The city's Community Development Department takes those applications2. Septic permits for homes off public sewer come from the Baldwin County Health Department, not the city3. Do you need a building permit in Orange Beach, Alabama?

Yes. Orange Beach requires a Certificate of Zoning Compliance and/or a permit before any building or structure is erected, moved, altered, added to or enlarged inside city limits, though the Board of Adjustment can issue a written order creating an exception1. Anyone planning excavation, new construction, structural alteration or a change in use applies first to the city's Department of Community Development2.

Before a finished building can be used, the Building Official must issue a Certificate of Occupancy10. Alabama lets an owner who acts as their own contractor on a one-family or two-family home for their own use claim a licensing exemption11, but Orange Beach's own owner-builder rules are unconfirmed, so ask Community Development before assuming a city permit can be skipped or simplified.

Who issues building permits in Orange Beach, and how do you reach them?

The Orange Beach Building Department accepts applications, reviews plans, issues building permits and inspects work inside the city12. Call 251-981-2610 or apply through the city's online permit portal12. Zoning questions go to the Planning & Zoning Department13.

The Baldwin County Building Department is a different office: its permit jurisdiction covers unincorporated Baldwin County and the Towns of Elberta, Magnolia Springs and Perdido Beach14. A buyer inside Orange Beach city limits does not apply there.

Does Orange Beach have zoning, and what does it mean for lot size and homes?

Orange Beach administers its own Zoning Ordinance, and its Planning & Zoning Department handles rezonings, variances, site plans and subdivisions13. Rules differ by district, so check the parcel's district first.

In the RS-1 Single-Family Residential District, a single-family lot needs at least 9,000 square feet and 75 feet of width8, and buildings top out at 40 feet outside the overlay provisions15. Single-family homes on lots narrower than 75 feet must have at least 875 square feet of gross living area7. Subdivisions and land development go through the city's Planning and Zoning Department and its Subdivision Regulations16. The city's rules on accessory dwellings and tiny homes as a distinct use could not be confirmed; ask Planning & Zoning.

How do septic permits work in Orange Beach?

Alabama law requires a permit from the local health department before installing a new onsite sewage system or repairing one, and that rule applies to addresses inside Orange Beach city limits3. In Orange Beach that office is the Baldwin County Health Department's environmental office, which handles septic requests17. If soil testing shows restrictions, a registered engineer must design the system3, and the installer must call for an inspection before covering it5.

The soils are a real constraint: only about 9% of Baldwin County soils rate as not limited for a conventional drain field18, so expect a site evaluation and possibly an engineered system. Whether a new home must connect to public water or sewer when available could not be confirmed; the Orange Beach Water Authority and the city's sewer availability request are the places to ask.

Can you live in an RV, camper or tiny home in Orange Beach?

Mostly no, outside a licensed park. Sleeping in a camper, trailer or other vehicle within the city or its police jurisdiction between 10:00 p.m. and 6:00 a.m. is unlawful except in licensed or approved mobile home parks, trailer parks or campsites, with a narrow exception for self-contained units during a permitted special event4. Sleeping in a tent or in the open is also prohibited outside approved campgrounds, apart from youth campouts on a residential lot with an occupied home for no more than 2 consecutive days6.

Mobile-home and RV parks need a Certificate of Zoning Compliance and Certificate of Occupancy; a park must be at least 3 acres19. Tiny-home occupancy is not addressed as a separate use in the sources we found, so ask Planning & Zoning.

Building a home in Orange Beach: the steps, in order

  1. Confirm the parcel's zoning district with the Planning & Zoning Department13.
  2. Get a septic site evaluation from the Baldwin County Health Department if the lot is not on public sewer3.
  3. Arrange the driveway permit: ALDOT for state highways, the Baldwin County Highway Department for county roads, or the Orange Beach Streets Department for city streets, because no building permit issues without it20.
  4. Apply for the building permit through the city's permit portal12.
  5. Have the septic system inspected before it is covered5.
  6. Obtain the Certificate of Occupancy before moving in10.

What stays with Baldwin County, and what to check before you buy in Orange Beach

Septic permits come from the Baldwin County Health Department rather than the city17. Land outside city limits falls under Baldwin County, where the county's own building and zoning rules apply14.

Check flood status first: in A, AE and AH flood zones with base flood elevation data, the lowest floor must sit at least 2 feet above base flood elevation9. Baldwin County's typical home insurance premium is about $2,281 a year21, and its effective property tax rate is 0.3%22. Driveways within 150 feet of a major signalized intersection need Planning Commission approval20.

Watch-outs
