Do you need a building permit in the Town of Lyndon, Wisconsin?

Yes. The Town of Lyndon requires building permits before construction, enlargement or alteration begins, and applicable building, electrical, plumbing and zoning rules must be satisfied.9 The Town has adopted Wisconsin's Uniform Dwelling Code for one- and two-family dwellings.10

Start with the Town of Lyndon Zoning Administrator and Building Inspector at 608-448-8026; the Town's forms page provides building and zoning applications and tells applicants to make that contact first.11 A fire-number sign application and receipt are prerequisites to issuance of a building permit.1

The applicant must contact the Building Inspector directly when each required inspection is ready.12 A building, alteration or addition covered by a Town building permit cannot be occupied until inspection and issuance of either a temporary occupancy permit or a certificate of completion and occupancy.13

Does the Town of Lyndon have zoning, and what does it mean for RVs and tiny homes?

The Town of Lyndon divides the entire town into standard zoning districts, and an overlay district can add requirements to the underlying district.14 The parcel's zoning district matters before choosing a house plan or placing an RV.15

Under the residential-property exception, an RV or other camping unit must be on property with an occupied permanent residence, owned by the real-estate owner, limited to one camping unit per residence and occupied for no more than 30 days per calendar year; guest camping units are limited to 10 days per calendar year.6 The ordinance separately allows camping units in campgrounds, as a contractor's project office, for unoccupied sale display or in enclosed storage.16 Tent camping is excluded from the ordinance's definition of a camping unit, but we could not confirm a complete Town rule for camping in a tent on private land; ask the Town zoning office before relying on that exclusion.17

The Town materials do not identify a separate tiny-home category. In both the Rural Residential and Single-Family Residential districts, the table sets minimum dwelling core dimensions at 980 square feet, so a small dwelling proposal needs a district-specific review before purchase or construction.78 Manufactured homes are treated like stick-built homes and remain subject to the applicable zoning, foundation, building-permit and occupancy requirements.18

What lot size and setbacks apply in the Town of Lyndon?

The answer depends on the zoning district. In the Rural Residential district, a residential lot requires 5 acres per dwelling unit and principal and accessory buildings generally have 100-foot front, side and rear setbacks, subject to the ordinance's adjustments and any greater county or state highway setback.1920

In the Single-Family Residential district, the listed principal-building setbacks are 100 feet in front and 50 feet at the side and rear; accessory-building setbacks are 100 feet in front and 25 feet at the side and rear, with special rules for certain older small lots and other adjustments.21 Confirm the parcel's mapped district and overlay status with the Town zoning office before using these dimensions for a site plan.22

In both districts the principal-building height limit is 35 feet and the accessory-building limit is 25 feet, subject to the ordinance's height exceptions.2324 In the Rural Residential district, principal buildings may cover at most 5 percent of the lot, accessory buildings 10 percent and all buildings together 20 percent.25

How do septic permits work inside the Town of Lyndon?

Juneau County's private onsite wastewater ordinance applies in areas not served by an approved public sewer.5 Every private sewage system requires a separate complete application signed by a licensed plumber and a sanitary permit.4 Juneau County's delegated plan-review authority covers at-grade and mound systems with design flows up to 1,000 gallons per day; other system types may require Wisconsin Department of Safety and Professional Services review.3

The county requires sanitary permits for new systems, replacements or modifications, repairs, reconnections and non-plumbing systems.26 A private sewage system must be installed, inspected and approved by Juneau County before the permit card is removed.27

A non-plumbing sanitation system may be permitted only where the structure has no indoor plumbing and is not used as a full-time residence.28 If approved public sewer becomes available, the private system must be disconnected and the property connected to sewer within one year, with availability determined by the local sewer service entity.29

Building a home in the Town of Lyndon: what are the steps?

First, confirm the parcel's Town zoning district, overlays and dimensional standards, then obtain the zoning approval needed for the proposed use.222 Second, if the home will use a private onsite wastewater system, obtain the sanitary permit before the new-dwelling building permit can move forward.430

Third, obtain the fire-number sign application and receipt, then file the Town building-permit materials and fee before work begins.131 Fourth, obtain the correct access permit: the Town issues permits for Town-road access, Juneau County permits County Highway access and Wisconsin DOT permits State Highway access.32 A residential parcel may have no more than one access drive onto adjacent highways.33

Finally, call the Building Inspector directly for required inspections and do not occupy a permitted building until the required temporary occupancy permit or certificate has been issued.1213

What stays with Juneau County when you build in the Town of Lyndon?

Juneau County remains the local sanitary-permit authority for private septic systems, even though the Town handles its own building permits and local zoning.512 County shoreland zoning also applies within 1,000 feet of a lake or flowage, within 300 feet of a navigable river or stream and in floodplains, and construction in those areas requires a county permit before work starts.34 Under the county shoreland ordinance, buildings generally must sit at least 75 feet from the ordinary highwater mark of navigable waters.35

Development in areas regulated by the Juneau County Floodplain Zoning Ordinance requires a land-use permit before development, repair, modification, an addition or a change in building use begins.36 Contact the Juneau County Sanitation & Zoning Department at 608-847-9391 for county septic, shoreland and floodplain questions.26

Watch-outs

  • An RV on residential property is not a year-round housing substitute under the Town's exception: occupancy is capped at 30 days per calendar year.37
  • A Town building permit does not replace the Juneau County sanitary permit required for a private septic system.94
  • We could not confirm a distinct Town rule for tiny homes or accessory dwelling units; ask the Town zoning office to classify the proposed structure and use before buying land.2
  • Shoreland and floodplain parcels can require Juneau County approval in addition to Town zoning and building permits.3436
  • The Town publishes a short-term rental license application, but we could not confirm its operating conditions; ask the Town zoning office before buying land to rent out.38
