Nueces County, Texas

Building permits, zoning and septic rules in Aransas Pass, Texas

Aransas Pass, Texas requires building permits for construction, remodeling and enlargements inside city limits.1 Aransas Pass sets residential zoning dimensions by district; Nueces County’s unincorporated-land answers do not describe city lots.23 Septic systems generally need separate approval, and San Patricio County acts for the city in its San Patricio County portion under an agreement covering 2026–2027.45

Do you need a building permit in Aransas Pass, TX?

Aransas Pass requires a building permit when building, remodeling or enlarging a building, and for other property improvements.1 The city lists cabinets, carpeting, painting, trim work and wallpapering as work that does not require a building permit; replacing fixtures on existing wiring or plumbing is also listed as exempt.1

An Aransas Pass building permit is not valid or issued until staff approves the application and plans and the applicant pays the permit fees.11 We could not confirm a general city owner-builder exemption; ask the Building Department about the proposed work before treating self-built construction as exempt.12

Who issues building permits in Aransas Pass, and how do you apply?

The Aransas Pass Building Department processes remodeling and new-construction applications, reviews plans and conducts construction inspections.12 Contact the department at 361-758-3111 Option 3 or visit 601 N Avenue A Aransas Pass TX 78336.12 Aransas Pass uses the OpenGov permit portal for digital building permits.11

Aransas Pass requires green placards at the job and inspection requests at least 24 hours in advance, by 4:00 p.m.1211 Applications submitted after 4:30 p.m. wait until the next business day for processing.11 The city’s published certificate-of-occupancy requirement concerns new businesses and listed changes to existing businesses; that commercial rule should not be read as a residential occupancy procedure.13

Does Aransas Pass have zoning, lot minimums and setbacks?

Aransas Pass regulates residential lots and homes by zoning district, so ask the city Planning Department to identify the district before choosing a house plan.236 In R-10, a one-family dwelling generally needs a 10,000-square-foot lot and 1,000 square feet of heated and air-conditioned living space.27 In R-16, the corresponding minimums are a 16,000-square-foot lot and 1,600 square feet of heated and air-conditioned living space.38 Qualifying older lots of record have lot-area exceptions, and the dwelling-size provisions include stated nonconforming-dwelling exceptions.2378

R-16 requires a 35-foot front yard and a 25-foot rear yard; the side yard is 10% of lot width, at least 10 feet, with no required side yard exceeding 15 feet and special corner-lot and building-line rules.14 R-10 and R-16 each cap lot coverage at 30%.1516 Those dimensions belong to the named districts, not every Aransas Pass parcel.142

How do septic permits work inside Aransas Pass?

Almost all septic systems serving Aransas Pass property need a septic permit before construction, installation, repair, extension or alteration; local authorized agents may impose stricter requirements.4 In the San Patricio County portion of Aransas Pass, San Patricio County personnel enforce OSSF rules for the city under the agreement effective during 2026–2027.5 Contact San Patricio County Environmental Health at (361)-587-3500 for that portion of the city.17 For an address elsewhere in Aransas Pass, ask the city and TCEQ’s OSSF Program to confirm the correct local agent before submitting a septic application.618

Texas’s 10-acre septic permitting exemption requires a qualifying single-family tract, a licensed site evaluation, compliance with construction standards, all system parts at least 100 feet from property lines, on-site disposal, no nuisance or groundwater pollution, and no other dwelling on the tract; local requirements still matter.19 Off-grid sanitation through an OSSF does not bypass septic approval, and OSSFs may handle only domestic sewage.20

Can you live in an RV or tiny home in Aransas Pass?

We could not confirm permission to occupy an RV on a private Aransas Pass lot; ask the city Planning Department for the allowed use at the specific address before buying an RV for permanent or construction-period housing.6 We also could not confirm a separate Aransas Pass tiny-home occupancy rule or a general accessory-dwelling rule; ask Planning about the proposed dwelling and Building about the construction requirements.612

A small site-built home in R-10 or R-16 must be assessed against the district’s heated and air-conditioned living-area minimum, subject to the stated nonconforming-dwelling exceptions.78 Building-permit approval and septic approval are separate requirements; a wastewater arrangement does not answer whether the city allows the proposed residential use.146

Building a home in Aransas Pass: what are the steps?

  1. Ask Aransas Pass Planning to identify the parcel’s zoning district and review the proposed development before finalizing the layout.623
  2. Ask city Development Services about the Floodplain / Ground Development Permit and submit the required application before ground work.1021
  3. Confirm water and sewer service with the city; we could not confirm the city’s mandatory-connection rule or private-well permit requirements.6 If a septic system is proposed, establish the authorized agent and obtain the required septic approval separately.418
  4. Submit building plans and the building-permit application, then secure staff approval and pay the building-permit fees before starting permitted construction.111
  5. Obtain a city right-of-way permit for a new or replacement driveway approach; an approach onto a state highway or Farm to Market road also needs TxDOT approval before the city permit is issued.9
  6. Display the required green placard and arrange city inspections using the department’s advance-request procedure.11

For land outside city limits, use the Nueces County guide for the county’s separate answers; Aransas Pass building-permit requirements apply inside the city.1

Watch-outs

  • Aransas Pass requires the Floodplain / Ground Development Permit before ground work; building-permit approval alone does not cover that step.101
  • Aransas Pass right-of-way permits for driveway approaches last 30 calendar days; unfinished work requires a new permit and fee after expiration.9
  • Aransas Pass short-term rentals advertised for no longer than 30 consecutive days must register with the city starting February 2026 through OpenGov.22
  • We could not confirm city agricultural building or zoning exemptions; ask Aransas Pass Building and Planning before relying on agricultural use to avoid approval.126
