Does Lake Dallas have zoning, lot-size rules and setbacks?

Lake Dallas has municipal zoning, so the permitted use of land depends on the city district assigned to the parcel.2 Ask Lake Dallas Development Services for the parcel’s district before choosing a house layout or requesting a zoning change.7

In Lake Dallas’s R-1-6000 district, the minimum lot area is 6,000 square feet and the minimum front-yard setback is 25 feet.89 In R-1-7200, the corresponding requirements are 7,200 square feet and 25 feet.1011 In R-1-10000, the minimum lot area is 10,000 square feet and the front-yard setback is 35 feet.1213 Ask the city planning office for the remaining dimensional requirements for the specific district.7

Do you need a building permit in Lake Dallas, Texas?

Lake Dallas requires a city-issued permit before structural alterations, additions, remodels or work involving mechanical, plumbing or electrical elements.1 Starting covered work before the city issues the permit subjects the project to doubled permit fees.1 Lake Dallas has adopted the 2018 International Building Code and International Residential Code, along with other adopted construction codes and amendments.14

Lake Dallas’s homeowner provision exempts qualifying residents from contractor registration only: homeowners must reside and pay taxes at the property, perform the work themselves, obtain the work permit and attach proof of residency.5 Buying a property to build on does not by itself satisfy those residency conditions.5

Who issues Lake Dallas building permits, and how do you apply?

Lake Dallas Development Services receives, reviews and issues most city permits for residential and commercial properties.15 Contact the building-permit office at (940) 497-2226 Ext. 402 or [email protected]; paper applications may be brought to City Hall at 212 Main Street Lake Dallas, TX 75065.15

Lake Dallas applications need the required project information, including square footage and valuation; some applications can be issued over the counter, while projects needing plan review may take up to 10 business days.16 Building-permit fees depend on the permit type and nature of the work under the city’s Master Fee Schedule.15 Every Lake Dallas building permit requires a final inspection, with inspections performed by Bureau Veritas under contract with the city.17

How do septic permits and water wells work inside Lake Dallas?

Lake Dallas generally prohibits constructing or starting use of new private sewage facilities, including septic tanks, inside city limits; a limited exception addresses certain facilities existing when the ordinance took effect.3 Lake Dallas requires plumbing fixtures to discharge to public sewer when the lot or tract lies within 100 feet of a sanitary sewer main; fixtures without a public-sewer connection must use an approved disposal system.18

We could not confirm which agency issues septic permits for exceptions inside Lake Dallas; ask city Development Services to identify the permitting authority before relying on an existing private system.15 Texas’s general septic-permit framework does not remove Lake Dallas’s private-system restriction.193 A Lake Dallas water-well permit requires a lot of at least 30,000 square feet zoned residential or agricultural, plans by a state-licensed well driller and a $300 permit fee.6

Can you live in an RV or tiny home in Lake Dallas?

A camper unit or travel trailer cannot be occupied inside Lake Dallas without first securing a permit from the city secretary.4 Lake Dallas allows storage of campers and travel trailers only when they are not used for residential purposes and are not stored in a residential front yard or the side yard of a residential corner lot.4 The storage provision therefore does not authorize living in a parked trailer.4

Before buying an RV for occupancy, ask the city secretary about the occupancy-permit conditions.4 For a proposed tiny home, ask Lake Dallas Development Services to confirm the allowed use and development requirements for the particular parcel and district.27

Building a home in Lake Dallas: what are the steps, in order?

  1. Ask Lake Dallas Development Services to confirm the parcel’s zoning district and allowed residential use before finalizing plans.27
  2. Resolve wastewater service with the city before planning a private system: Lake Dallas generally prohibits new private sewage facilities and requires public-sewer connection under the stated proximity rule.318
  3. Submit the city building-permit application with the required project information, square footage and valuation; allow for plan review where needed.16
  4. Obtain the city building permit before beginning covered construction work.1
  5. Arrange the required building inspections, including the final inspection; electrical and gas inspections may also require meter release.17

What stays with Denton County, and what should you check before buying?

Denton County Public Health’s Environmental Health Division administers septic permitting and inspection in unincorporated Denton County; that stated service area does not establish septic-permit jurisdiction inside Lake Dallas.20 For land outside Lake Dallas city limits, consult the Denton County guide: development in unincorporated Denton County requires a county Development Permit.21

For a subdivision inside Lake Dallas, public water and sanitary sewer systems must be approved by LCMUA and meet the city’s design manual and LCMUA standards.22 Before buying a Lake Dallas parcel, ask city Development Services about floodplain requirements and the complete district-specific size, height and coverage limits; we could not confirm those requirements in full.7

Watch-outs

  • Lake Dallas’s homeowner contractor-registration exemption still requires a work permit and proof of residency.5
  • Lake Dallas’s camper and travel-trailer storage rules do not authorize residential occupancy; occupancy requires a city-secretary permit.4
  • Do not assume a Lake Dallas parcel can use new septic: city law generally prohibits new private sewage facilities, with a limited exception for certain existing facilities.3
