Building permits, zoning and sewer rules in Town of South Padre Island, Texas

Town of South Padre Island, Texas requires a building permit before covered construction, alterations and changes of occupancy.1 The town sets zoning rules and requires sewage-producing uses to connect to sanitary sewer, so a septic system is not a substitute for the required connection.23 RVs cannot be used as permanent living quarters or rental properties inside town limits.4

Do you need a building permit in Town of South Padre Island, TX?

Town of South Padre Island requires the owner or authorized agent to apply to the municipal building official and obtain a building permit before covered work begins.1 Covered work includes construction, enlargement, alteration, repair, moving or demolition of a building, changes of occupancy, and regulated electrical, gas, mechanical or plumbing work.1 The city application also states that separate permits are required for electrical, plumbing, heating, ventilating or air-conditioning work.8 Ask the Building Department which applications your project needs before arranging trades or starting site work.

Who handles building applications in Town of South Padre Island?

Send South Padre Island construction documents electronically to [email protected]; the municipal building application lists (956) 761-8104 and 4601 Padre Boulevard South Padre Island, TX 78597.8 Bring the parcel description and proposed use to the Building Department when asking about zoning compliance and the application package. The town’s permit rule directs applications to the building official, including applications for changes of occupancy.9 We could not confirm the current building permit fee schedule or complete inspection schedule; ask the Building Department for both before setting a construction budget and start date.

Does Town of South Padre Island have zoning, lot sizes and setbacks?

Town of South Padre Island has municipal zoning, including District A single-family regulations and District E low-density residential regulations.210 District A lots generally need 5,000 square feet, 50 feet of width and 100 feet of depth; Padre Beach Subdivision Section XII also has an original-plat restriction on replats.7 District E single-family lots generally need 5,000 square feet, with an exception for lots recorded as of November 7, 1979; attached townhouse lots need 2,500 square feet per dwelling unit.11 District A’s ordinary yards are 25 feet front, 5 feet on each side and 20 feet rear, with Gulf Boulevard, side-street and waterfront exceptions.12 District E also has frontage and rear-yard exceptions, so ask the Building Department to review the actual parcel rather than applying the ordinary yards universally.13

How do sewer and septic rules work inside Town of South Padre Island?

Town of South Padre Island requires residential, commercial and other sewage-producing uses to connect to Laguna Madre Water District’s sanitary sewer system or a sewer system provided by another state political subdivision.3 No structure may be erected inside town limits without the required sewer connection, and the subdivision rules prohibit septic tanks.35 New subdivision lots must have potable water service and individual sanitary sewer connections.14 Ask Laguna Madre Water District Customer Service to confirm the proposed service connection before buying. We could not confirm a municipal septic permit process; for an unusual existing system, ask Cameron County Environmental Health, whose program includes on-site sewage facilities, and the municipal Building Department to resolve jurisdiction.15

Can you live in an RV or tiny home in Town of South Padre Island?

Town of South Padre Island prohibits recreational vehicles as rental properties or permanent living quarters; a limited temporary storm-housing exception does not establish permission to live in an RV while building.4 We could not confirm a separate tiny-home, manufactured-home or accessory-dwelling occupancy rule; ask the Building Department about the proposed structure and zoning district before purchasing a unit. District A requires a dwelling area of at least 1,200 square feet on most lots and 2,000 square feet in Block 192; for multistory dwellings, the area requirement applies to the ground floor.6 District A also prohibits rentals shorter than 30 days, which matters if rental income is part of the purchase plan.16

Building a home in Town of South Padre Island: what comes first?

  1. Ask the Building Department to identify the parcel’s zoning district and review the proposed dwelling, lot dimensions and yards against that district’s rules.2712
  2. Confirm sanitary sewer service with Laguna Madre Water District before designing a wastewater alternative; sewage-producing uses must connect to sanitary sewer.3
  3. Complete any required replatting before building permit issuance; for work east of Gulf Boulevard, obtain Beach and Dune permit clearance first.8
  4. Submit construction documents electronically to the municipal Building Department and obtain the building permit before covered work.89
  5. Arrange the required form board survey approval before pouring the foundation and the under-construction elevation certificate afterward.8

For land outside town limits, use the Cameron County guide to identify the appropriate county offices. Ask the municipal Building Department to confirm inspection scheduling and occupancy approval before committing to a move-in date.

Watch-outs

  • A South Padre Island dune-protection permit does not replace the city building permit or compliance with the city’s flood-hazard ordinance.17
  • District A and District E buildings have a maximum height of 45 feet, measured from the street center line to the building’s highest point.1819
  • Texas has limited owner-performed trade-license exemptions, but South Padre Island still requires a building permit for covered work; ask the Building Department how owner-performed work will be handled.201
