Bastrop County, Texas

Building permits, zoning and septic rules in Elgin, Texas

Elgin, Texas requires city building permits for home construction, alterations and listed trade work inside city limits.1 Elgin also administers its own zoning, so rural Bastrop County rules are not a substitute for city approval.2 Elgin requires sewer connection when the property extends within 100 feet of a city sewer; otherwise the city requires a compliant septic system, with OSSF permitting administered by Bastrop County.345

Do you need a building permit in Elgin, Texas?

Elgin requires a city building permit to construct, enlarge, alter, repair, move or demolish a building, change occupancy, or perform the listed electrical, gas, mechanical and plumbing work inside city limits.1 The requirement reaches beyond new houses: Elgin lists roof replacement, foundation repair, solar panels, generators, water heaters, HVAC replacement and remodels among building-permit projects.1 Elgin has adopted the 2021 International Residential Code with local amendments for residential construction.11 We could not confirm an Elgin owner-builder exemption; ask the Building Division about the proposed work before treating self-construction as exempt.12

Who issues building permits in Elgin, and how do you apply?

The Elgin Building Division is the city contact for building-permit questions, at 512-281-0119 or [email protected].12 Elgin uses My Government Online for building-permit submissions and payments, construction-plan uploads, plan-review tracking and inspection requests.13 Select Elgin as the project jurisdiction in the online application.12 For zoning and platting questions, contact Elgin Planning & Development at the Fleming Center or [email protected].14 Elgin publishes a master fee schedule adopted annually by City Council; ask the Building Division which schedule applies before budgeting building-permit fees.15

Does Elgin have zoning, lot-size rules and setbacks?

Elgin administers zoning inside city limits, including rezoning, variances, specific uses and special exceptions.2 Elgin residential lot-area requirements differ by district: R-1 requires at least 9,000 square feet per main dwelling and accessory building, R-2 requires 7,500 square feet, and R-3 requires 6,000 square feet.789 These are lot-area requirements, not minimum house-floor-area requirements.789 Front yards generally require 25 feet in R-1 and R-2, versus 15 feet in R-3, subject to existing-building-line exceptions; rear yards require at least 10 feet.161718 Ask Planning & Development to identify the parcel district and check side yards, corner-lot rules and accessory buildings before placing a home on a site plan.14

How do sewer connections and septic permits work inside Elgin?

Elgin requires sewage connection to the city sewer when the lot, tract or parcel extends within 100 feet of a city sewer; the measurement concerns the property, rather than only the house location.3 When the property does not extend within 100 feet of a city sewer, Elgin requires a septic tank system constructed and maintained to state specifications.4 Bastrop County is the local OSSF authorized agent and requires septic installation or modification permits regardless of acreage, so do not assume the state acreage exemption applies.519 Contact Bastrop County Environmental & Sanitation to confirm jurisdiction for the address before submitting a septic application.20 The county Permit to Construct allows 1 year for installation, inspection and final approval.21

Can you live in an RV, tiny home or manufactured home in Elgin?

Elgin prohibits temporary or permanent occupancy of a parked or stored RV, motor home or travel trailer inside city limits except in a city-authorized trailer court.6 That restriction does not provide an RV living allowance while a house is under construction.6 Elgin also limits RV parking and storage by vehicle size, front-yard position and sidewalk clearance.6 We could not confirm a complete tiny-home occupancy rule or minimum dwelling-floor-area requirement; ask Planning & Development about the proposed home and district, and the Building Division about construction approval.1412 Elgin allows single-lot HUD-Code manufactured homes only on qualifying legal lots where placement was lawful immediately before the relevant ordinance, with no more than 1 manufactured home per qualifying lot.22

Building a home in Elgin: what steps come first?

  1. Ask Elgin Planning & Development to identify the zoning district and any platting or site-development application needed for the project.223
  2. Resolve sewer availability before designing wastewater disposal; Elgin requires city sewer connection when the property extends within 100 feet of a city sewer.3
  3. Submit building plans and the building-permit application through My Government Online, selecting Elgin.1312
  4. Schedule city building inspections for each construction phase before proceeding or covering work; correct failed inspections and obtain re-inspection before continuing.10

Before occupancy, ask the Building Division which certificate-of-occupancy approval applies; we could not confirm the complete requirement.12

What should you check before buying land in or near Elgin?

For land outside Elgin city limits, use the Bastrop County guide: Bastrop County does not issue building permits for unincorporated residential construction, although limited residential code and inspection requirements remain.24 Inside Elgin, city building permits and municipal zoning apply instead.12 Ask Elgin Planning & Development about floodplain controls and private-well approval for the specific parcel; we could not confirm the operative city floodplain permit or well-construction permit requirements.14 If rental income is part of the plan, Elgin requires a Specific Use Permit for the covered short-term residential rentals of fewer than 30 consecutive days, as well as Hotel Occupancy Tax reporting and payment.25

Watch-outs

  • Elgin RV storage permission does not authorize temporary or permanent RV occupancy outside a city-authorized trailer court.6
  • Bastrop County requires septic installation and modification permits regardless of acreage; do not rely on the statewide acreage exemption without county approval.19
  • Elgin building inspections must be scheduled before construction proceeds or work is covered.10
