Do you need a building permit in Sallisaw, Oklahoma?

Start a Sallisaw home-building or remodeling project with City Community Development, which provides building permitting, inspections, plan reviews and technical guidance for new construction and development.1 Sallisaw has adopted the building, existing-building and residential codes in the editions adopted by the Oklahoma Uniform Building Code Commission, with city changes.10 Ask Community Development which building and trade permits your proposed work requires, what drawings to submit and when inspections must be scheduled.1 We could not confirm the city’s current building-permit fee schedule or certificate-of-occupancy requirement; request both from Community Development before committing to a construction schedule.

Who issues building permits and handles zoning in Sallisaw?

Sallisaw Community Development is the city counter for building permitting, inspections and plan review, and provides support to the Sallisaw Planning Commission.1 Contractors and the public can request building permits by emailing [email protected] or calling 918-775-6241 ext. 216 or (918) 775-6241 ext. 201.1 Bring your intended use and parcel information to Community Development for zoning guidance as well as building-code guidance.1 For a proposed septic system, contact Oklahoma DEQ Environmental Complaints and Local Services separately: DEQ administers the onsite sewage program, including soil tests, designs and installation inspections.11

Does Sallisaw have zoning, minimum lot sizes and setbacks?

Sallisaw has city zoning, so the parcel’s district matters before you choose a house footprint or buy an agricultural tract.2 In Sallisaw’s R-1 district, a single-family dwelling needs at least 9,000 square feet of lot area and 70 feet of frontage, with a wedge-shaped-lot frontage exception.5 R-1 single-family yards require 25 feet in front, 25 feet total across the side yards, 15 feet for one side yard and 20 feet in the rear; corner-lot rules also apply.12 In A-1, residential uses require 3 acres and 200 feet of lot width.6 A-1 residential setbacks are 35 feet in front, 50 feet total for side yards, 25 feet for each side and 50 feet in the rear, with larger roadway and corner-lot requirements in specified situations.13 A-1 residential coverage is capped at 30 percent.14

How do septic permits and sewer connections work in Sallisaw?

Sallisaw’s sewer article requires qualifying occupied or used properties to connect at the owner’s expense within 90 days after official notice when a public sewer in the abutting street, alley or right-of-way is within 250 feet of the property line, subject to article exceptions.7 Sallisaw prohibits private sewage-disposal facilities except as provided in that article; septic is therefore a conditional alternative rather than a free choice.15 In R-1, the city’s building-development office must ensure a certified installer supplies documentation meeting the adopted private-sewage code and ODEQ requirements.4 DEQ must issue an Authorization to Construct before a new septic installation or modification, after reviewing the Report for On-Site Sewage.3 New or modified systems must receive DEQ inspection and approval or certified-installer self-inspection and approval before operation.16

Can you live in an RV or tiny home in Sallisaw?

We could not confirm a Sallisaw rule allowing full-time RV occupancy, a tiny home as a primary dwelling or temporary RV living while a house is built. Ask Community Development about the proposed dwelling type, its foundation or wheels, the parcel’s district and whether temporary occupancy is authorized before buying a unit. Sallisaw’s adopted building codes govern buildings and structures inside city limits, and city zoning imposes district requirements.102 A proposed small dwelling also needs a lawful sewage solution: Sallisaw’s sewer connection and conditional septic rules still apply.74 We could not confirm citywide accessory-dwelling authorization or a general agricultural exemption; ask the city about those uses separately.

Building a home in Sallisaw: what should you check first?

First, ask Sallisaw Community Development to confirm the parcel’s zoning district and review your intended use, site layout and construction plans.12 Next, resolve sewer availability with the city; pursue a septic design and DEQ Authorization to Construct only if the city’s conditions allow onsite sewage.743 Then request the city building and trade approvals applicable to your project and the inspection schedule.1 For a driveway connecting to a state highway, Oklahoma requires an approved Driveway Agreement before right-of-way work, and an agreement inside city limits needs city signature or written permission.17 Ask Community Development who administers floodplain review for your city parcel; Oklahoma’s floodplain regulations are enforced by participating local communities.18 For land outside city limits, use the Sequoyah County guide for the county’s separate building and zoning answers.1920

Watch-outs

  • Sallisaw’s gas-work owner exemption concerns city registration only and requires a bona fide owner-occupant to personally purchase all materials and perform all labor; do not treat it as a general building-permit exemption.8
  • Septic approval does not override Sallisaw’s qualifying public-sewer connection requirement.74
  • We could not confirm RV occupancy, tiny-home occupancy, building-permit fees or a certificate-of-occupancy requirement in Sallisaw; ask Community Development before buying or starting work.1
