Zoning, building permits and septic rules in Durant, Oklahoma

Durant, Oklahoma requires a building permit to construct or alter a building inside city limits, issued through the city's Community Development department1. Durant also adopts and enforces its own zoning ordinance2. Septic permits are not a city function: Oklahoma DEQ runs the on-site sewage program for Bryan County3.

Does Durant, Oklahoma have zoning, and what does it mean for lot size and setbacks?

Yes. The City of Durant has its own zoning ordinance, and inside city limits uses are governed by district and use tables in Chapter 156, with some uses needing planning and zoning commission review2. The city publishes agricultural, residential (R-1 through R-4), commercial, central business, industrial and other districts9.

Dimensions depend on the district. In R-1 single-family residential, the minimum lot is 8,400 sq ft and 70 ft wide at the front building line5, with building coverage capped at 30%10 and height capped at 35 ft11. In A-1 agriculture, the minimum lot is 5 acres and 150 ft wide6, with building coverage, accessory buildings included, capped at 30%12.

Setbacks are also set district by district in the city's district table; ask Community Development for the figures for a specific parcel13. We could not confirm Durant's rules on RVs, tiny homes or accessory dwellings, so call the same office before you plan one.

Do you need a building permit in Durant, and who issues it?

Yes. Inside Durant city limits, constructing or altering a building or structure without a permit from the city's community development department is unlawful1. Building permits are handled by the City of Durant Community Development office13, and the State Fire Marshal's authority-having-jurisdiction list shows Durant performing plan review, building permitting and inspections itself14.

Durant adopts the International Building Code, excluding its appendices, as the city building code4. A permit lapses if work does not start within 180 days of issuance, and written extensions are available1. A permit has no force until a fee receipt is attached15.

The fee is set by the city council by motion or resolution, and we did not find the current schedule, so ask the office for a quote8. The state adds its own permit fee of $4.00 per permit for work under state building codes16.

How do septic permits work for a home in Durant?

Septic is a state matter, not a city or county one. Oklahoma DEQ's Environmental Complaints and Local Services Division administers on-site sewage treatment for Bryan County317.

Before installing or modifying a system, an Authorization to Construct must be purchased and issued by DEQ7. Installations must be inspected and approved by DEQ, or installed, self-inspected and approved by a certified installer, and a certified installer's final inspection goes to DEQ within 15 days of completion18. DEQ's current Authorization to Construct fee is $500.19 for a DEQ-inspected system up to 1500 gpd and $357.28 for a self-inspected one19.

Whether a lot inside Durant must connect to city sewer instead of using a septic system, we could not confirm; ask Community Development before you buy13.

Building a home in Durant: the steps, in order

  1. Confirm the parcel's zoning district and dimensional limits with Community Development13.
  2. Ask the same office whether city sewer reaches the lot; if not, start a DEQ soil test and Authorization to Construct7.
  3. Apply for the building permit from the city's community development department1.
  4. Start work within 180 days or request a written extension1.
  5. Build to the adopted International Building Code4.
  6. Have the septic system inspected by DEQ or a certified installer before it is put into operation18.

What stays with Bryan County, and what to check before you buy in Durant

Land outside Durant city limits is a different answer. Unincorporated Bryan County has adopted no county zoning ordinance, so no county rule sets lot size, setbacks or height there20. Outside city limits a single-family home is not subject to a State Fire Marshal permit21; see the Bryan County page for the county's full answer.

Floodplain management is run by the Bryan County Floodplain Management Program22; whether that program or the city handles a flood-zone lot inside Durant, we could not confirm, so ask both. For water, the state does not require an intent-to-drill authorization for domestic wells serving a household or irrigating less than 3 acres23, but we could not confirm how that works inside city limits. A driveway onto a state highway needs an ODOT driveway agreement, and one inside city limits must be signed or permitted in writing by a city authority24.

Watch-outs

  • Durant's current building permit fee schedule was not located; the code leaves fees to the city council8.
  • Inspection requirements, certificates of occupancy, RV and tiny-home rules, and sewer connection requirements inside Durant are unconfirmed; call City of Durant Community Development at 580-931-660013.
  • County and state rules for unincorporated land do not apply inside Durant city limits; the county's own zoning answer applies only outside the city20.
