Do you need a building permit in Atlantic City, NJ?

Atlantic City construction governed by New Jersey’s Uniform Construction Code requires a construction permit before covered work begins, including new construction, additions, renovations, demolition and changes of use.1 Atlantic City maintains its own State Uniform Construction Code enforcing agency, and the city Construction Division issues building permits and conducts construction inspections.112

Ordinary maintenance as defined by the state code does not require a permit or notice; minor work requires a permit but may proceed after notice before issuance.1 Ask the Construction Division to classify your proposed work before starting.2

Who issues building permits in Atlantic City, and how do you apply?

For building permits inside Atlantic City, contact the city Construction Division at 609-347-5660.2 The Construction Division’s official page provides a plan-review application guide for the plan-submittal and release process.2 Ask the division for the application materials and fee calculation for your specific project.2

New Jersey municipal plan-review fees must approximate actual plan-review costs; ask the Construction Division for the fees applicable to your Atlantic City project.122 A construction permit cannot issue until required state, county and local prior approvals are in place, even when plan review can proceed before those approvals arrive.13

Does Atlantic City have zoning, lot-size rules and setbacks?

Atlantic City has its own land-use and zoning chapter, and its zoning map is kept in the Land Use Administrator’s office.314 Start with the city Planning & Development Office to identify the parcel’s district and applicable land-use requirements.15 Within the Tourism District, CRDA regulates land use and reviews land-use-change applications, which may require a hearing and board approval.4 Ask city planning to confirm which office must review your address before filing.154

We could not confirm Atlantic City’s district-specific minimum dwelling sizes, lot sizes, setbacks, lot coverage or height limits here; request the applicable district schedule from the Land Use Administrator before choosing a building footprint.14

How do septic permits work inside Atlantic City?

For an Atlantic City project proposing septic facilities, New Jersey requires certification from the board of health having jurisdiction before a building permit can issue or construction can begin.5 Septic tanks, drain fields and other covered sewerage facilities must be inspected and receive permission before being covered from view.16

Atlantic County’s Environmental Health Unit explicitly excludes Atlantic City from its service area and directs city inquiries to Atlantic City Environmental Health.6 Contact city Environmental Health to confirm whether septic is an option for the address and which office administers the required approvals; we could not confirm a city-specific septic application procedure.1718

Can you live in an RV or tiny home in Atlantic City?

Atlantic City allows a camper to be parked on private property, a parking lot or a garage, but prohibits using the parked camper for sleeping, changing clothes or eating.7 That restriction rules out sleeping in a camper on a private lot while building a home under the cited parking provision.7 The city code allows City Council to establish particular areas for occupied campers; that provision does not establish approval for an individual private lot.19

We could not confirm an Atlantic City tiny-home or accessory-dwelling occupancy rule; ask Planning & Development about the proposed dwelling use and the Construction Division about construction-code requirements before buying a unit.152

What are the steps to building a home in Atlantic City?

Begin with the parcel’s zoning district and the city or CRDA land-use review applicable to the address.14154 Resolve required prior approvals before the Construction Division issues the construction permit.132 During construction, work must stop at required inspection stages, including footing trenches, rough plumbing and electrical work, and framing before concealment.9 New buildings cannot be occupied until the construction official issues a certificate of occupancy.20

Owner-builders constructing a home for personal use have a builder-registration exception, but construction permits and inspections still apply.819 An owner-built new home also requires the state-prescribed affidavit before a certificate of occupancy can issue.21

What should you check before buying property in Atlantic City?

Atlantic City requires owners to connect buildings to public water mains at their own expense when the buildings front or lie on a street where the mains have been installed.10 If proposing a private well, New Jersey requires a DEP drilling permit and local health construction approvals; ask city Environmental Health to confirm the local office for the address.2217 Ask the city Floodplain Administrator for flood-hazard boundaries and available elevation information before designing the project.23

Atlantic City’s residential occupancy-permit rules also matter for purchases and rentals: a vacant-property sale does not require an occupancy permit, but a new occupancy does, and issuance requires a Code Enforcement inspection for Property Maintenance Code compliance.2425 For land outside Atlantic City, consult the Atlantic County guide for the separate local-authority picture.26

Watch-outs

  • A camper parked on Atlantic City private property cannot be used for sleeping, even if the owner is building a home.7
  • CRDA reviews land-use-change applications within the Tourism District; confirm the address’s reviewing authority before submitting to the city alone.4
  • Atlantic County Environmental Health excludes Atlantic City; ask city Environmental Health to confirm septic and private-well jurisdiction.622
  • Owner-built new-home affidavits require disclosure of the lack of applicable warranty coverage to purchasers within 10 years after the certificate of occupancy.21
