Do you need a building permit in Oshkosh, NE?

Oshkosh’s building-permit form requires project and applicant information, applicant certification and approval by the Zoning Administrator.1 The city publishes a $500 building-permit fee for a new business or residence and $35 for an accessory building.6 Oshkosh’s City Enforcement Officer inspects excavation, building and plumbing installations or repairs and approves work only when it complies with city ordinances and regulations.3

We could not confirm the city’s adopted building-code edition; ask City Hall which code and inspection schedule apply to your project.10 Nebraska’s own-property exemption concerns contractor registration and does not waive building permits, inspections or other approvals.11

Who handles building applications and zoning in Oshkosh?

Use the Oshkosh building-permit application, which asks for the owner, contractor, project dimensions, floor area, height, stories, estimated cost and legal description.1 Zoning Administrator approval appears on the application, while the City Enforcement Officer is responsible for the city’s building and plumbing inspections.13

Reach Oshkosh City Hall at 308-772-3686, at 305 West 1st, PO Box 166, Oshkosh Nebraska 69154, to ask how to submit the application and reach the responsible official.10 Septic questions have a separate state contact: Nebraska DWEE’s Onsite Wastewater Program at (402) 471-4285.12

Does Oshkosh have zoning, lot-size rules and setbacks?

Oshkosh has city zoning, with Agriculture, R-1 Residential, R-2 Residential, Highway Commercial, Commercial and Industrial districts.213 For an R-1 single-family dwelling, the minimum lot area is 6,500 square feet and minimum width is 50 feet.8 R-1 single-family yards are at least 25 feet front, 5 feet side, 10 feet street side and 5 feet rear, subject to front-yard adjustments where existing homes on the block require a larger yard.14

Oshkosh’s Agricultural District instead requires yards of 25 feet front, 10 feet side, 25 feet street side and 30 feet rear.15 Accessory dwellings there require conditional-use approval and are limited to people directly engaged in the on-site agricultural operation.16 Ask City Hall to confirm the parcel’s district before designing the building footprint.10

How do septic permits work inside Oshkosh?

Nebraska’s Onsite Wastewater Program administers statewide onsite wastewater requirements, and city requirements apply separately and in addition.4 Most Nebraska onsite systems are built under Authorization by Rule without a construction permit, but large systems, non-domestic waste and siting issues can require site-specific permitting.7 Constructed or changed onsite systems must be registered with the Department.17

A wastewater-generating dwelling must use a compliant onsite system or connect to public sewer or other wastewater works.18 We could not confirm Oshkosh’s local septic approval or inspection requirements; ask City Hall whether septic is acceptable for the address and DWEE which state approvals apply.1012 State law requires onsite inspection work to be carried out or supervised by a qualified certified professional, licensed professional engineer or registered environmental health specialist.19

Can you live in an RV or tiny home in Oshkosh?

We could not confirm a general rule allowing RV occupancy, temporary camping or tiny-home occupancy on a private lot in Oshkosh; ask City Hall about the proposed unit, address and length of stay before buying.10 Nebraska classifies tiny houses as manufactured homes, modular housing or recreational vehicles, but construction classification does not establish permission to occupy a particular lot.20

Oshkosh requires manufactured homes outside mobile-home parks to have at least 900 square feet of floor area; that standard is not a universal minimum for every dwelling type.9 Nebraska park model recreational vehicles are designed and marketed for temporary recreational, camping, travel or seasonal living and cannot be permanently affixed as permanent dwellings.20

What are the steps to building a home in Oshkosh?

  1. Ask City Hall to confirm the parcel’s city zoning district and the officials responsible for the building application and floodplain review.102
  2. Check the district’s lot and yard requirements before laying out the house; Oshkosh’s R-1 and Agricultural District standards differ.81415
  3. Resolve water and wastewater service with the city; Oshkosh prohibits new private domestic water supplies, and wastewater must go to an approved onsite system or sewer.518
  4. Complete the city building application and obtain Zoning Administrator approval; arrange required inspections with the City Enforcement Officer.13
  5. Obtain a floodplain development permit before development, construction or substantial improvement in Oshkosh’s floodplain-regulated area.21

For land outside Oshkosh’s municipal jurisdiction, consult the Garden County guide: the county’s zoning resolution covers unincorporated land, while Oshkosh’s ordinance also describes an area beyond its corporate boundary.222

Watch-outs

  • A geothermal well in Oshkosh requires City Council review and approval; the exception does not authorize a new private domestic water supply.5
  • Oshkosh’s floodplain development permit is required before development, construction or substantial improvement in the regulated area.21
  • We could not confirm an agricultural-building exemption from Oshkosh’s city requirements; ask City Hall before treating a barn or farm project as exempt.10
