Building permits, zoning and septic rules in Oxford, Mississippi

Oxford, Mississippi requires building or land-disturbance permits before new construction or breaking ground inside city limits.1 Oxford’s own land-development code controls zoning and land use; onsite wastewater goes through the Mississippi State Department of Health, not the city building counter.23 For land outside Oxford in Lafayette County, use the Lafayette County guide for the county’s different building-permit requirements.4

Do you need a building permit in Oxford, MS?

Oxford requires new-construction and/or land-disturbance permits before construction or breaking ground inside city limits.1 Oxford inspectors enforce the 2024 International Building Code, the 2024 International Residential Code and the 2023 National Electrical Code, with city changes to the residential code.5

Mississippi’s exemption for someone building or improving their own residence concerns residential-builder licensing; the exemption does not remove Oxford’s building-permit requirement.71 Ask the Oxford Building Department to identify the application and inspection requirements for your proposed work; the city reviews residential and commercial plans and performs inspections.89

Who issues Oxford building permits, and where do you apply?

The Oxford Building Department accepts building-permit applications and plans, issues building permits, performs inspections, and issues certificates of occupancy or completion.9 Reach the building counter at 662-232-2304, and use EnerGov to schedule inspections.9 Oxford’s Building Department coordinates site-plan requirements with the city Engineering and Planning departments.9

Oxford publishes a city building-permit fee schedule, and any applicable plan-checking fee is additional to the building-permit fee.10 The department page lists a Courthouse Square mailing address, while the fee schedule lists Molly Barr Road; call the building counter before an in-person visit.910

Does Oxford have zoning, lot-size rules and setbacks?

Oxford’s land-development code governs development, land use and subdivision inside city limits, and the city zoning map determines the district and overlays for a parcel.211 The Oxford Planning Department handles zoning and subdivision questions at 662-232-2305 or [email protected].12

For single-family detached lots in Oxford’s SR district, the front build-to line is 20–50 feet, subject to the code’s build-to provisions; minimum side and rear setbacks are 10 and 20 feet respectively.13 Oxford’s AG district instead has a 40-foot front requirement, with dwelling setbacks of 30 feet at the side and 40 feet at the rear; livestock structures have 100-foot side and rear setbacks.14 These district-specific dimensions make parcel zoning essential before placing a house or livestock building.1314

How do septic permits work inside Oxford?

For a proposed onsite wastewater system in Oxford, start with the Mississippi State Department of Health’s On-Site Wastewater program: submit a complete application, pay the fees, and obtain the soil/site evaluation and permit or recommendation.3 The wastewater call center is 1-855-220-0192.3 Mississippi requires written health-department approval of the sewage treatment and disposal plan before a public water utility connects service.15

Oxford’s annexation guidance says properly functioning onsite sewer treatment systems in annexed areas need no change for the foreseeable future; that statement concerns existing systems in the annexation context.16 For a new home, resolve sewage disposal and whether centralized sewer is available before relying on onsite treatment: state law requires connection when centralized wastewater treatment becomes available.15

Can you live in an RV or tiny home in Oxford?

We could not confirm Oxford’s private-lot RV occupancy, temporary-camping or distinct tiny-home occupancy rules; ask the Oxford Planning Department to evaluate the proposed use and parcel district before buying for that purpose.12 Oxford’s zoning code governs land use inside city limits.2

Oxford does have a conditional accessory-dwelling pathway in AG, RCN, ER, SR, NR and SMF districts, with the primary dwelling owner occupied.6 An accessory unit may not exceed 50% of the principal dwelling’s gross floor area or 1,000 square feet, whichever is less, and may contain no more than 2 bedrooms.6 The standard lot must exceed 10,000 square feet; lots of 5,000–10,000 square feet may be considered by special exception, and rentals or objections can also require special-exception review.6

Building a home in Oxford: what are the steps, in order?

Start with Oxford Planning: identify the parcel’s city zoning district and overlays, then check the intended use and any subdivision approval with the city.1117 Have Oxford Engineering review floodplain questions; in special flood-hazard areas with base-flood-elevation data, new residential construction and substantial improvements must put the lowest floor, including the basement, at least 1 foot above base flood elevation.1819

Next, establish the wastewater plan with MSDH if onsite treatment is proposed, and obtain the required sewage-plan approval for public water service.315 Submit plans to Oxford Building and obtain building or land-disturbance approval before breaking ground; schedule construction inspections through EnerGov.81 Before moving in, ask Oxford Building which final approval applies: the department issues certificates of occupancy or completion.9

What should you check before buying land in Oxford?

A new or altered driveway onto a Mississippi state highway requires an MDOT driveway permit, so state-highway access belongs in the purchase feasibility review.20 A Mississippi water well with surface casing of 6 inches or greater generally requires a groundwater-withdrawal permit, subject to exclusions; smaller wells serving a public water system may still face health-department regulation.21

For Oxford’s AG district, the 38-foot maximum building height excludes farm or silviculture structures, and some agricultural yard exceptions apply; those limited exceptions do not establish a general agricultural exemption from city building permits.22141 Ask Oxford Planning about the precise use and Oxford Building about construction approval before treating agricultural zoning as permission to build.129

Watch-outs

  • Oxford’s city zoning and building requirements apply inside city limits; a Lafayette County building-permit answer should not be used for an Oxford parcel.21
  • We could not confirm Oxford’s general manufactured-home land-use permission; state installation inspection before occupation does not resolve city zoning permission, so ask Oxford Planning about the parcel.2312
  • Oxford’s annexation statement about existing functioning onsite systems does not establish the sewage-connection rule for a new home; obtain the wastewater plan approval required by Mississippi law.1615
