Building permits, zoning and septic rules in Ocean Springs, Mississippi

Ocean Springs, Mississippi requires building permits before most construction projects begin, and the city requires construction inspections.12 Ocean Springs administers its own zoning; septic systems inside the city go through the Mississippi State Department of Health, rather than the city building office.34 For property in Jackson County, establish whether the address is inside city limits before choosing the building-permit office.1

Do you need a building permit in Ocean Springs, MS?

Ocean Springs requires a building permit before most construction begins, and the city expressly includes roof replacement and home construction in its inspection requirements.12 Call the Ocean Springs Building Department about the specific scope before starting work.1

Mississippi offers a residential-builder licensing exemption for qualifying construction of an owner’s own residence, but that exemption does not remove local building-permit or inspection requirements.10 We could not confirm a separate Ocean Springs owner-builder provision; ask the city Building Department what documentation an owner acting as contractor must submit.11

Who issues building permits in Ocean Springs?

The Ocean Springs Building Department handles construction permits, contractor licensing, inspections and floodplain management compliance.11 Reach the city building office at 228-875-6712; applications may be submitted by email or in person.11 The application contact is [email protected], and the published counter hours are Monday through Friday, 7:30am to 4:30pm.11

Ocean Springs Planning handles zoning, setbacks, variances, lot splits and historic-property adjustments separately from building applications.12 The Planning Department is at 1014 Porter Avenue and can be reached at (228) 875-4415.13 For land outside city limits, use the Jackson County guide for the county building-permit answer.14

Does Ocean Springs have zoning, lot-size and setback rules?

Ocean Springs administers its own Unified Development Code, with dimensional controls that vary by zoning district.35 Ask Planning to confirm the parcel’s district, eligible residential use and applicable setbacks before choosing a house footprint or proposing a lot split.1312 Ocean Springs Planning also administers subdivision regulations and publishes sketch, preliminary and final subdivision applications and checklists.15

Ocean Springs allows a detached accessory dwelling subject to owner occupancy, a notarized affidavit and a recorded covenant; the owner must occupy the principal home or accessory dwelling as a permanent residence and may not receive rent for the principal dwelling.8 The detached ADU limit is one per lot with no more than two bedrooms, and building-code occupancy standards still apply.8

How do septic permits work inside Ocean Springs?

MSDH administers individual onsite wastewater approval inside Ocean Springs, and its Jackson County Health Department and Environmental Office is the local program contact.416 A septic permit is required for installing an onsite system and obtaining the associated water meter.6 If sewer is available, MSDH directs applicants to connect and requires a Letter of Rejection from the sewer provider before proceeding with a septic application.6

Ocean Springs requires connection after official notice when an occupied or used property abuts a street, alley or right-of-way containing city sanitary sewer within 300 feet of the property line; the deadline is 60 days after notice.17 Household wastewater must go to central sewer or an approved septic system, rather than the ground, a ditch or a body of water.18

Can you live in an RV or tiny home in Ocean Springs?

We could not confirm a general Ocean Springs rule authorizing RV residence on a private lot; ask Planning about the proposed vehicle, parcel and duration before relying on that arrangement.13 Ocean Springs generally requires occupied house trailers or mobile homes to be in an approved trailer park.7 A mobile home used as a temporary residence at a residential construction site requires Planning Commission recommendation and Board of Aldermen concurrence, with a nonrenewable maximum of 120 days.7 That provision should not be treated as automatic approval for an RV.7

We could not confirm a distinct tiny-home occupancy rule or minimum dwelling floor area in Ocean Springs; ask Planning about the intended dwelling and Building about code compliance.1311 Manufactured homes also require the applicable Mississippi installation inspection before occupation.19

Building a home in Ocean Springs: what steps come first?

Use this order to resolve land use, sanitation and city construction review before committing to a design.361

  1. Ask Ocean Springs Planning to confirm zoning, setbacks and any lot-split, variance or historic-property review.12
  2. Establish sewer availability; if an onsite system is appropriate, apply through MSDH and obtain the required wastewater approval.6
  3. Ask the city Building Department about floodplain compliance and submit the building application before starting construction.91
  4. Arrange city construction inspections, and ask Building to confirm the final approvals needed before moving in; we could not confirm a general certificate-of-occupancy requirement.211

Ocean Springs applications requiring board approval are due by noon on the 7th of the month before the board meeting, so build that submission deadline into any planning application.13

What should you check before buying land in Ocean Springs?

For Ocean Springs property in a Special Flood Hazard Area, the city applies its floodplain development requirements and an 18-inch freeboard above the current base flood elevation.9 Ask the Building Department how the flood rules affect the proposed structure before pricing foundations or substantial improvements.119

For a private well, Mississippi requires a groundwater withdrawal permit for surface casing diameters of 6 inches or greater, subject to exclusions; smaller wells may still be regulated when part of a public water system.20 We could not confirm additional Ocean Springs private-well or local driveway requirements; ask Building which office should review those parts of the project.11 New driveways or alterations accessing a state highway require MDOT approval.21

Watch-outs

  • Ocean Springs zoning and building approval do not replace MSDH septic approval, and available public sewer can change the wastewater plan.316
  • Ocean Springs’ published code references differ in edition; confirm the applicable codes with the Building Department before completing plans.22
  • Ocean Springs’ temporary construction-site mobile-home approval lasts up to 120 days and cannot be renewed.7
