Do you need a building permit in Newport Beach, CA?

Newport Beach requires a building permit for all new construction, but the city lists exemptions for some finish work, fences, platforms, decks and walks; plumbing, mechanical and electrical work needs a project-specific determination.1 Ask the Newport Beach Permit Counter to identify the building permits your proposed work requires before choosing a construction schedule.13

Newport Beach adopts construction codes into its municipal code, and California’s current statewide building standards apply to permit applications dated on or after January 1, 2026.1415 The city publishes Building and Development fees effective July 25, 2026; request the fee calculation for your actual scope rather than treating a fee schedule as a flat price for a house.16

Who issues building permits in Newport Beach, and how do you search records?

Start a Newport Beach building-permit inquiry with the city Permit Counter, located with Community Development at the Civic Center.13 Use the Newport Beach Planning Division for zoning information about the parcel and proposed use.7 For land outside city limits, consult the Orange County guide: Orange County’s building-permit service covers private property in unincorporated areas and county-owned property.17

Newport Beach offers a permit search by address covering projects, plan checks, planning activities, building permits, complaints and investigations.18 The city’s online services also let applicants track plan submittals and view correction notices.18 Use the address search to identify existing project records, then ask the Building Division about the status or scope of a particular building permit.18

Does Newport Beach have zoning, lot-size rules and setbacks?

Newport Beach residential zoning standards differ by district, so identify the parcel’s district with the Planning Division before drawing a house footprint or planning a subdivision.2197 Newly created lots in the Residential-Agricultural district require 87,120 square feet for both corner and interior lots, subject to subdivision provisions and exceptions.2 In the Single-Unit Residential district, newly created corner lots require 6,000, 7,200 or 10,000 square feet, while interior lots require 5,000, 7,200 or 10,000 square feet, depending on the subdistrict.19

Residential-Agricultural primary structures have minimum setbacks of 20 feet front, 5 feet side, 25 feet rear and 10 feet at a bulkhead; setback maps, measurement rules and exceptions can change the applicable requirement.20 Single-Unit Residential front setbacks are 20 feet, with side and rear setbacks varying by subdistrict, lot width and alley conditions.5 Newport Beach subdivisions must also comply with the city’s subdivision requirements.21

How do septic permits and wells work inside Newport Beach?

California regulates new and replacement septic systems through its statewide onsite wastewater policy, with local agencies generally issuing the septic permits.22 We could not confirm which agency issues septic permits inside Newport Beach or whether a proposed address must connect to sewer; ask the city Utilities Department to identify the wastewater approval authority and service options before buying a site that depends on septic.4

Orange County Public Works reviews percolation tests and onsite sewage designs for unincorporated Orange County; that rule does not establish the septic authority inside Newport Beach.23 Well permitting is a separate question: Orange County Environmental Health’s well page places enforcement with the county Health Officer except in named cities that do not include Newport Beach, and requires a permit before well construction or destruction.12 Contact the well program about the proposed work, while asking Newport Beach Utilities about water service.124

Can you live in an RV or tiny home in Newport Beach?

California does not treat an RV as an ordinary permanent dwelling: residential occupancy generally belongs in approved mobilehome or special occupancy parks unless a local ordinance allows otherwise.6 We could not confirm a Newport Beach exception for living in an RV on private land, including while building; ask the Planning Division about the specific address and proposed duration before relying on that arrangement.7

A tiny home in California must meet an approved structure classification and have an approved location before occupancy.8 Newport Beach allows accessory dwelling units and junior accessory dwelling units in its listed residential districts, subject to the city’s ADU provisions and applicable development standards.9 An ADU proposal therefore needs its own review; the city’s ADU allowance does not establish permission to occupy a tiny home classified as an RV.98 Ask Planning and the Permit Counter to evaluate the intended unit and use together.713

What are the steps to build a home in Newport Beach?

  1. Ask Newport Beach Planning to identify the parcel’s zoning and applicable lot and setback standards, then confirm how the proposed footprint fits those standards.7195
  2. Ask Utilities about water and wastewater service; if a well is proposed, contact Orange County Environmental Health before well construction.412
  3. Take the project scope to the city Permit Counter for the building-permit requirements and current Building and Development fees.13116
  4. If applying as an owner-builder, complete the city acknowledgement and signature verification; California’s exemption concerns contractor licensing and does not waive building permits or inspections.1110
  5. Arrange the required construction inspections at the project’s specified stages; the property owner remains responsible for ensuring inspection requests are made.24
  6. Confirm the city’s completion requirements for the certificate of occupancy for a new building or change of use before moving in.25

Watch-outs

  • Newport Beach setback maps and district-specific exceptions can alter the apparent buildable area; ask Planning to confirm the parcel’s applicable standards.2057
  • We could not confirm Newport Beach’s minimum dwelling size, private-land camping rules or temporary RV living allowance; ask Planning before choosing a small dwelling or construction-time accommodation.7
  • We could not confirm Newport Beach’s operative floodplain development or driveway-access requirements; ask the city Public Works Department to identify the reviewing office for the address.26
  • Newport Beach short-term lodging is not allowed in the Residential-Agricultural and Single-Unit Residential districts; allowances in other listed residential districts remain subject to the city lodging chapter.27
