Do you need a building permit in Homer, Alaska?

Homer does not issue municipal building permits and has no adopted municipal building code or municipal building inspector.61 Homer instead requires a zoning permit before clearing or new construction, including additions.1 A small, one-story detached accessory building under 200 square feet may qualify for an exemption when a main building already exists; ask City Planning before relying on that exemption.1

State Fire Marshal approval still applies to covered commercial construction; residential housing that is three-plex or smaller is exempt from that state plan-review requirement.10 Alaska’s owner-builder contractor-registration exemption does not remove local zoning approval or applicable state review and inspection requirements.11

Who handles zoning approval and construction questions in Homer?

Contact the City of Homer Planning Office for zoning permits and flood development permits inside Homer city limits.12 Call 907-235-3106 or email [email protected]; the published mailing address is 491 East Pioneer Ave, Homer AK 99603.12 Homer’s online Customer Portal lets applicants apply for permits and track development projects.12

Homer Public Works handles city driveway permits, and permits and inspects city water and sewer connections.134 Call Public Works at 907-235-3170 or email [email protected].14 Septic-system questions go to Alaska DEC’s Soldotna office at (907) 262-5210, rather than the city zoning counter.15

Does Homer have zoning, minimum lot sizes and setbacks?

Homer zoning applies to all land inside city limits, with different requirements by district.216 In Rural Residential (RR), the minimum lot area is 40,000 square feet without public water and sewer, 20,000 square feet with approved public water or approved public/community sewer, and 10,000 square feet with both; each additional dwelling unit adds the same area again for the applicable service category.7 Urban Residential (UR) requires at least 7,500 square feet for single-family and duplex dwelling structures.17

RR and UR generally require a 20-foot setback from dedicated rights-of-way, with an exception for certain rights-of-way leading to Kachemak Bay that are unsuitable for road construction.1819 Side and rear setbacks increase with building stories, and both districts limit building height to 35 feet.18192021

How do septic permits work inside Homer?

Alaska DEC regulates onsite wastewater systems in Homer, with prior written approval required unless an applicable regulatory exception covers the system.3 Systems qualifying for authorization by rule can proceed without prior plan approval when prescriptive standards and separation distances are met, but require electronic notice at least 24 hours before construction or modification and subsequent documentation/registration.22 Systems outside those categories require prior written DEC approval.22

For engineered systems requiring plan approval, the construction-observing engineer visually observes construction and submits completion certification and record drawings for DEC review.23 If the Homer property will connect to city sewer instead, Public Works permits and inspects that connection.4 Confirm the wastewater route with DEC and Public Works before treating a city zoning permit as sanitation approval.34

Can you live in an RV or tiny home on land in Homer?

We could not confirm the complete answer for owner-occupied RV living on a vacant Homer lot or while building; ask Homer Planning to assess the proposed use in the parcel’s zoning district.12 We also could not confirm a separate Homer tiny-home occupancy rule or minimum dwelling-floor-area requirement; ask City Planning before buying a structure.12

Homer does allow a detached accessory dwelling conditionally in RR and UR when accessory to a principal single-family dwelling, excluding mobile homes.8 Mobile homes in RR are subject to additional mobile-home requirements, while UR excludes mobile homes from its listed single-family and duplex uses.24 Those permissions do not establish an answer for every tiny home or RV; the proposed structure and use need a district-specific zoning assessment from City Planning.82412

What are the steps for building a home in Homer?

  1. Ask Homer Planning to identify the parcel’s zoning district and assess the proposed dwelling, lot area and setbacks before clearing the site.271712
  2. Resolve wastewater approval with Alaska DEC, or city water and sewer connection permits with Homer Public Works; ask Public Works whether the driveway project needs a city driveway permit.3413
  3. Ask City Planning whether a flood development permit applies and identify other required approvals for the project.912
  4. Submit the other required permits to Homer Planning before the zoning permit is issued; the city states zoning review takes up to 10 working days after a complete submittal.12
  5. Obtain the zoning permit before clearing or starting new construction.1

What should you check before buying land in Homer?

Public water and sewer availability can change the minimum buildable lot area in Homer’s RR district, so resolve the service arrangement with Public Works and the lot-size requirement with City Planning before buying.74 Development in Homer flood hazard areas requires a city flood development permit, administered by City Planning.9

For land outside Homer city limits, use the Kenai Peninsula Borough guide: the borough has no specific structure building codes or borough building inspector, but separate project-specific approvals may apply.25 Inside Homer, the city’s zoning requirements still apply.2 We could not confirm the complete private-well permit or off-grid sanitation requirements for Homer; ask Alaska DEC’s Soldotna office about the proposed water supply and waste-disposal method.15

Watch-outs

  • Homer’s lack of municipal building permits does not waive the zoning permit required before clearing or new construction.1
  • Homer reports extended Army Corps processing times for wetland determinations and permitting during the 2026 construction season; raise wetland questions with City Planning early.12
  • We could not confirm Homer’s certificate-of-occupancy requirements; ask City Planning before planning a move-in date.12
