Gustavus, Alaska (Hoonah-Angoon Census Area) is a small city in Alaska's Unorganized Borough, and its strategic plan states that the City Council had not undertaken general planning, platting or zoning.1 Residential housing that is a three-plex or smaller is exempt from State Fire Marshal plan review, and we found no city building permit.2 Septic systems are regulated by the Alaska Department of Environmental Conservation, not by the city.3

Does Gustavus have zoning, and what does it mean for RVs and tiny homes?
We found no general zoning ordinance for Gustavus. The City's strategic plan states that the City Council had not undertaken general planning, platting or zoning, and we found no general private-land camping ordinance.1 Because we could not confirm a zoning code, we cannot state minimum lot sizes, setbacks or RV and tiny-home rules for private lots; ask the City Clerk before you buy.7
Some local rules do exist. No part of the small boat harbor may be used for camping or residential purposes, and overnight camping is prohibited on designated Gustavus beach lands unless specifically posted for camping.1
On state-owned land nearby, a private non-commercial camp used for less than 14 days in the same location does not require a permit from the state.8
Do you need a building permit in Gustavus, and who issues it?
We found no city building permit in Gustavus. The state rule that does apply is fire and life safety plan review: the Division of Fire and Life Safety is the State Building Official, and commercial and other larger projects need State Fire Marshal approval before work begins.29
Residential housing that is three-plex or smaller is exempt from that State Fire Marshal plan review.2 The review does not address structural requirements, so a house is not inspected for structure by the state.2
The State Fire Marshal also does not issue a separate certificate of occupancy for buildings it reviews; occupancy is granted upon completion according to the approved plans.10 Ask the City Clerk whether the city adds any local requirement.7
How do septic permits work in Gustavus?
All septic systems in Alaska are subject to Alaska regulations chapter 72, and the Department of Environmental Conservation administers them.3 A person must obtain prior written approval unless an exception applies; systems installed without prior plan approval must meet prescriptive construction standards and separation distances, and a 24-hour electronic notification is required before construction.4
For engineered systems, the responsible engineer must observe construction and submit a certification of construction and record drawings for DEC review.11 Systems outside the authorization-by-rule exceptions need prior DEC approval, and we found no rule requiring connection to a public sewer in Gustavus.5

Can you build off-grid in Gustavus?
Sanitation, yes, within the state rules. A pit privy that meets the state requirements does not have to be approved by or registered with DEC, but it must not be in a flood-prone area, and local governments may add restrictions.13 Other onsite systems must follow 18 AAC 72.5
A new driveway onto a state highway needs a permit from the Alaska Department of Transportation.14
Short-term rentals earning income require an Alaska business license.15
Building a home in Gustavus: the steps, in order
- Call the City Clerk to confirm no local zoning or permit applies to your lot.71
- Decide on wastewater and obtain DEC approval or file the required notification.412
- Check whether your project is a three-plex or smaller home, which is exempt from State Fire Marshal plan review.2
- Get a state DOT permit if the driveway connects to a state highway.14
- If you act as your own contractor, review the state owner-builder exemption.6
What stays with the state, and what should you check before you buy?
Septic approvals, fire and life-safety plan review for larger buildings, and state highway driveway permits all stay with state agencies, not the city.3214
An owner acting as their own contractor is exempt from contractor registration for one home, duplex, triplex, four-plex or commercial building every two years, and must file the form if the structure is sold within two years of starting.6
We could not confirm floodplain, well, driveway or short-term-rental rules specific to Gustavus, so ask the City Clerk.7
Watch-outs
- We found no city zoning ordinance, but a city or borough rule could exist that we did not find; confirm with the City Clerk before you buy.1
- Septic needs prior written DEC approval unless an 18 AAC 72 exception applies.4
- Overnight camping is prohibited on designated Gustavus beach lands unless specifically posted.1
